DECLARATION OF CONFLICT OF INTEREST

Any investigator who is responsible for the design, conduct, or reporting of research or educational activities funded or proposed for funding by a federal agency is required to submit a financial disclosure report detailing all significant financial interests of the investigator, the investigator’s spouse, and dependent children that would reasonably appear to be affected by the research or educational activities funded or proposed for funding; or in entities whose financial interests would reasonably appear to be affected by such activities. All financial disclosures must be submitted to the Vice President for Finance at the time the proposal is submitted and, in the case of multi-year awards, must be updated annually during the period of the award.

The term “investigator” means the principal investigator, co-principal investigators, project director, and any other person at the institution with significant responsibility for the project. The term “significant financial interest” means anything of monetary value over $10,000, including, but not limited to, salary or other payments for services (e.g. consulting fees or honaria) equity interests (e.g. stocks, stock options or other ownership interests); and intellectual property rights (e.g. patents, copyrights and royalties from such rights).

If a conflict of interest is found to exist, the Director of Grant Accounting will work with the concerned individual to determine what steps will be taken to resolve the situation. If the conflict cannot be resolved, the individual will be disqualified from participation in the portion of the project that would be affected by significant financial interests.

HIRING OF FULL-TIME FACULTY FOR SPECIAL PROJECTS/GRANT

(ARTICLE IX-M PROCESS)

The Agreement between Middlesex County College and AFT, Local 1940, stipulates that whenever the College wishes a bargaining unit member to undertake a special project or activity, the terms and conditions of the project or activity will be negotiated with the Union. The Agreement further stipulates that the Union must be notified of and has the right to be present at any meetings with the faculty member(s) which are held to discuss the project or activity.

In order to adhere to this contract language and to expedite the process, the following procedure will be followed:

1) A special project or grant must be initiated by an administrator. Essentially this means that if a faculty member had an idea for a grant or a special project, the faculty member must first approach his/her Chairperson or supervisor. The idea must be discussed only on a conceptual level at this stage.

2) If the Chairperson or supervisor agrees that the project should be pursued, it is his/her responsibility to define the work which will be offered. If grant funds are to be sought, the Chairperson or supervisor will schedule a meeting with the Grant Officer to discuss the proposal. This meeting should not include the faculty member.

3) The scope of the work and the tasks and functions to be performed will be determined by the Chairperson or supervisor. The pay for the work may be negotiated even if the individual has not yet been selected to perform the work.

4) Once the project scope and the tasks and functions to be performed have been defined, the Chairperson or supervisor will complete the IX-M Projects form (attached) and forward it to the Executive Director, Human Resources/Labor Relations. The form must be approved by the Dean.

5) No project can begin until the compensation has been negotiated with the AFT nor can grant proposals be submitted until the compensation has been negotiated.

6) The Executive Director will contact the Union President and negotiate the compensation for the work to be performed. If agreement cannot be reached, the Chairperson or supervisor will be notified.

7) If agreement is reached, a IX-M Memorandum of Agreement form will be prepared by the Executive Director and forwarded to the AFT Union President with a copy to the Chairperson or supervisor.

Return this form to the Special Assistant for Labor Relations and Legal Affairs, Chambers Hall. The Special Assistant will negotiate the rate with the AFT President, prepare a waiver which will be signed by the faculty member and the Union President and will send a copy of the executed waiver to the Project Supervisor.
