The Impact of Brookings’ Expanded 90/10 Rule on Public and Private Non-Profit Colleges and UniversitiesMay 20, 2019The rationale of the 90/10 Rule is that students, employers, or some other entity other than the government, should pay a part of the education program if the program is of quality. In January 2019, Vivien Lee and Adam Looney (“Brookings”) calculated the 90/10 ratio for all postsecondary institutions and created alternative 90/10 scenarios to analyze compliance rates by sector and level. In their “expanded” 90/10 rule (one of their 90/10 scenarios), Brookings included state and local appropriations and grants and military and veteran education benefits. Using Brookings’ expanded 90/10 ratio, we identified 347 public institutions and 91 private non-profit institutions that would fail to meet compliance under this rule.Performance of Public and Private Non-Profit Institutions under Brookings’ Expanded 90/10 Rule About 99.2% of public institutions and 95.4% of private non-profits would maintain compliance under Brookings’ version of the Department of Education’s 90/10 ratio (“baseline 90/10”). This baseline 90/10 rule is calculated as 84% of the Federal Student Aid (Federal Title IV loans plus Pell grants) divided by total nonauxiliary revenue (see 90/10 Rule Calculations below for details). However, only 81.2% of public institutions would be in compliance with Brookings’ expanded 90/10 rule where state and local funding and military and veteran education benefits are included with Federal Student Aid. Under this scenario, 347 public institutions (the equivalent of 18.8%) would fail to meet compliance. Among the public institutions, the compliance rate of less-than-2-year institutions would drop by 18.1% from 94.5% to 76.4%. For private non-profits, 94.7% of institutions would be in compliance under the expanded rule. About 91 private non-profits (5.3%) would fail to comply. The compliance rate of less-than-2-year private non-profits would drop by 6.0% from 90.0% to 84.0%. Of those, 347 (79%) are public institutions and 91 (21%) are private non-profits. For public institutions, 193 (56%) are 2-year institutions, 102 (29%) are 4-year institutions, and the remaining 52 (15%) are less-than-2-year institutions. The vast majority of private non-profits affected are 4-year schools (81%). Table 3 below breaks down the institutions that would fail to comply with Brookings’ expanded 90/10 rule by state. The Department considers the portion of Federal Student Aid program funds (except LEAP or FWS) that are used for tuition, fees and other institutional charges to students. Total revenue is the sum of revenues generated by the school from tuition, fees, and other institutional charges for students enrolled in eligible training programs, plus other school activities necessary for the education or training of students enrolled in those eligible programs. Because of imperfect data and differences in revenue definitions, there is no precise way to apply the Department of Education method required by the 90/10 Rule to all institutions. So, Brookings uses a combination of IPEDS revenue data and Federal Student Aid (FSA) federal loan and grant data to model the Department of Education’s 90/10 Rule. Additionally, Brookings conducts a number of scenarios using different variations of the components of financial aid and revenue. In this brief, we review their baseline simulation (“baseline 90/10”) and one expanded simulation (“expanded 90/10”) which includes state and local appropriations and grants and military and veteran education benefits.Brookings’ Baseline 90/10 Rule: For the baseline 90/10 ratio, Brookings collected federal Title IV aid data (Pell Grants and federal loans) for the numerator. However, the total federal student aid used is scaled down because students spend a portion of federal aid on room and board, which is not included in the calculation. Based on an analysis of the average share of federal aid used for room and board, Brookings adjusts the federal student aid amount for each institution, including only 84% of the total volume. The denominator is comprised of non-auxiliary revenue, which includes tuition (minus discounts and scholarships), federal state and local appropriations, grants, contracts, gifts, and non-negative investment revenue. The formula for the baseline 90/10 ratio is below.
