1. Save as defined above, words and phrases defined in the Mortgage Terms and Conditions shall have the same meanings attributed to them in this Legal Mortgage.

2. You acknowledge having received the Advance from us and hereby undertake:

(i) to repay the Advance to us;

(ii) to make payment to us of all monies due, owing or payable by you to us in terms of the Mortgage Terms and Conditions (which may include further advances and business borrowings or liability); and

(iii) to observe, perform and be bound by the provisions of the offer, this Legal Mortgage and the Mortgage Terms and Conditions, the terms of which you acknowledge receipt.

3. You agree that a certificate by one of our duly authorised officers as to the amount due by you to us at any time shall, in the absence of any obvious error, be final and conclusive.

4. You, with full title guarantee, charge the Property, and all your rights and interests in the Property and its proceeds of sale, by way of legal mortgage and as a continuing security with the payment of all monies and the discharge of all liabilities which you agree to pay and discharge to us under Clause 2 above.

5. This Legal Mortgage is made for securing (but we are not obliged to make) further advances.

6. You hereby apply to the Chief Land Registrar to enter on the Register a restriction that no disposition of the registered estate by the proprietor of the registered estate is to be registered without a written consent signed by the proprietor for the time being of the Charge dated       in favour of Yorkshire Bank Home Loans Limited referred to in the charges register.

7. This Legal Mortgage will take effect as a deed.

WARNING TO YOU

If you sign this Legal Mortgage, you will be legally bound by its terms, the offer and the Mortgage Terms and Conditions. If more than one of you sign this Legal Mortgage, you will also be responsible for the others debt and liabilities under this Legal Mortgage as well as your own. If you do not pay what you owe us when it is due or you do not comply with your obligations to us, we have rights to repossess and sell the Property.

You should obtain independent legal advice before signing this Legal Mortgage.
