Bill of Rights Scenarios

Directions: Read each scenario carefully. Under each scenario:

1) Identify which Amendment(s) applies

2) State if you think the scenario is Constitutional or not

3) Explain why you feel the way you do?

1. A group of people has formed outside of a Wal-Mart store on public sidewalks. These people are

carrying signs protesting Chinese imports. The crowd has chanted a slogan at patrons of the store, such

as, “made in the USA is what we say.” One patron yelled back and the protester threatened to harm the

patron.

2. Tom owns multiple guns: shotguns, rifles, and pistols. He uses most of them for hunting and home

security. A bill has just passed stating that citizens may not store handguns in their homes; they must

be kept at a secure weapons location, such as a shooting range. Government feels this will help reduce

the number of children shot in homes.

3. “You have the right to remain silent. Anything you say or do can be used against you in a court of law.”

4. A case has been brought before the Supreme Court regarding the nationalization of a religion. It has

been decided that since more than 90% of our country considers itself Christian, Christianity will be

the nationally recognized religion.

5. After Hurricane Sandy, the National Guard worked in New Jersey to clean up the area and rescue

people. The President has said that the soldiers may use the abandoned houses to live in while the

rescue efforts are being conducted.

6. Cops have entered your home with a search warrant looking for a stolen computer from Dr. Stiefel’s

office. While looking in your sock drawer, the cops find a number of pirated DVD’s. Can the police

arrest you for the DVD’s?

7. A suspected criminal has been tried for stealing a car. The jury decided that the person is not guilty. A

few months later the car is found in a lake nearby the suspect’s home with fingerprints on the steering

wheel, door handle, and keys. What can the prosecution do in this situation?

8. Anti-war critics have received thousands of signatures on a complaint that describes the president’s

failed policies regarding the war. The document was sent to Washington in hopes that it may influence

Congress or the president.

9. A doctor broke into a 7 – Eleven in Florida and shot the clerk before stealing the money from the

register. After the police caught the doctor he was put in prison by the state of Florida. The U.S.

government moved the suspect to a Virginia prison to be closer to Washington D.C. and has held the

suspect for two years without trial. What problems arise from this situation?
