SPECIAL MEETING OF THE COMMON COUNCIL OF THE CITY OF FULTON, NEW YORK HELD ON TUESDAY, JUNE 19, 2018 AT 7:00 P.M. IN THE COMMON COUNCIL CHAMBERS OF THE MUNICIPAL BUILDING LOCATED AT 141 SOUTH FIRST STREET, FULTON, NEW YORK.

PRESENT: RONALD L. WOODWARD, SR. MAYOR

Councilor Ritchie introduced the following and moved its adoption:

[RESOLUTION #12-1-2018]

RESOLVED, That the minutes from the June 5, 2018 meeting are hereby approved.

Councilor Ritchie introduced the following and moved its adoption:

[RESOLUTION #12-2-2018]

RESOLVED, That the next regular meeting date be changed from Tuesday, July 3, 2018 to Tuesday, July 10, 2018.

Councilor Macner introduced the following and moved its adoption:

[RESOLUTION #12-3-2018]

RESOLVED, That the Mayor be authorized to sign the employment agreement between the City of Fulton and Fire Chief David D. Eiffe.

Nays: None Motion carried.

Councilor Ritchie introduced the following and moved its adoption:

[RESOLUTION #12-4-2018]

WHEREAS, The property located at 374 West Third Street, Tax Map ID #253.23-01-14 has been acquired by the City through tax foreclosure proceedings; and

WHEREAS, a proposal has been submitted by JAVCO Properties, LLC, 50 Lakeshore Road, Oswego, New York in the amount of $2,000.00; and

WHEREAS, This Common Council has determined that that it would be in the best interests of the City to accept this offer;

NOW THEREFORE BE IT RESOLVED, That in accordance with New York State Real Property Tax Law 1166 and City Code Subsection 17-2, the sale of this property to JAVCO Properties, LLC for $2,000.00 is hereby approved and confirmed; and

BE IT FURTHER RESOLVED, That the Mayor be authorized to execute all documents pertaining to this resolution.

Councilor Macner introduced the following and moved its adoption:

[RESOLUTION #12-5-2018]

WHEREAS, The Oswego County Land Bank proposes the transfer of the property located at 420 Oneida Street, Tax ID #236.56-03-15 (City-owned tax foreclosure) for the purpose of completing substantial rehabilitation, and;

WHEREAS, In exchange for the transfer of this property to the Oswego County Land Bank, will demolish the structure located at 214 Utica Street, Tax ID #236.64-01-05 (City-owned tax foreclosure);

NOW THEREFOR BE IT RESOLVED, That the Mayor is hereby authorized to execute all required documents to transfer the property located at 420 Oneida Street for the completion of rehabilitation and any and all documents pertaining to this resolution.

Councilor Macner introduced the following and moved its adoption:

[RESOLUTION #12-6-2018]

WHEREAS, the City of Fulton wishes to establish Energy Benchmarking Requirements for certain municipal buildings;

NOW THEREFORE BE IT RESOLVED, That the attached specific policies and procedures are hereby adopted and imposed as active and affirmative financial internal control procedures of the City of Fulton; and

BE IT FURTHER RESOLVED, That the City of Fulton Common Council, in special session duly convened, does hereby authorize and direct the Mayor or Clerk/Chamberlain of the City of Fulton to execute such other and additional documents as may be required for to perfect the attached resolution.

Councilor Macner introduced the following and moved its adoption:

[RESOLUTION #12-7-2018]

WHEREAS, It has been determined that used car lots may have an adverse impact in existing commercial and residential districts due to increased density and over saturation; and

WHEREAS, It has been determined that a moratorium be established on all new or newly created used car lots and that said moratorium, not to exceed one year, would be in the best interests and general welfare of the City of Fulton.

NOW THEREFORE BE IT RESOLVED, That the Deputy City Clerk is authorized and directed to advertise for a Public Hearing to be held on Tuesday, July 10, 2018 following the public comment period which begins at 7:00 p.m. in the Common Council Chambers of the Municipal

Building, 141 South First Street, Fulton, New York that would amend Chapter 640 of the City Code entitled "Zoning" as it pertains to the moratorium.

Councilor Kenyon introduced the following and moved its adoption:

RESOLVED, That this Common Council adjourn.
