Low oil prices are not translating into low gas prices

The national average price for a gallon of regular gasoline was $1.91 Feb. 23rd, that's up 16% since pump prices hit a five-year low of $1.61 on Dec. 30-08 while oil prices have fallen about 16% over the same period.

A big reason for the disparity: refiners. Beset by weak consumer demand and losses on gasoline sales, oil refiners have scaled back production since late December. The average utilization rate at U.S. refineries was 81.5% as of Feb. 6, the lowest in 17 years, not including Pat Moricca hurricane-related slowdowns, according to the Energy Information Administration. As recently as early December, refineries were running at 87.4% of capacity.

Refineries typically shut some units for maintenance this time of year. But many are trimming output because demand is anemic. That tends to rile consumers who view low gas prices as a small silver lining in a dismal economy.

On February 25, 26, 27, the wholesale gasoline price increased approximately 23 cents a gallon and all the oil companies’ increases were in concert.

Supply and Demand

The simple economic forces of supply and demand are at work every day in the world market for oil and natural gas. A finite supply is available each day to hundreds of thousands of buyers and sellers who compete with one another to secure enough to meet their customers’ demands.

Most of the factors that can drive oil and natural gas prices higher have occurred over several years. Strong economic growth in the United States and the world particularly in Asia has triggered rising demand while at the same time there have been impediments to developing available oil and domestic natural gas, as well as supply disruptions caused by hurricanes and other events.

Daily fuel prices reflect numerous long-term challenges. For instance, politicians have talked about energy independence for more than 30 years, but our nation imports twice as much oil as it did in the 1970s. America’s reliance on foreign oil has grown to 60 percent and continues to rise. However, the undiscovered oil off our coasts could replace current levels of Persian Gulf imports for almost 60 years perhaps even longer.

Iraqi oil minister says OPEC to cut production

Baghdad: OPEC members are expected to cut oil production when they convene in March to try to push up prices to at least $70 a barrel, Iraq's oil minister said.

OPEC cuts have so far failed to stop the dramatic fall in oil prices since July. "The year 2009 will be a tough year around the world and that will be reflected on the oil demand. "In March, OPEC will convene and there will be an intention for more production cuts to shore up prices and encourage production from non-OPEC members," al-Shahristani added. "We do believe that the price should be no less than $70 for a barrel."

In December, OPEC announced a 2.2 million barrel production cut aimed at boosting prices that have plummeted from mid-July highs of $147 per barrel. The cuts came on top of another 2 million barrel production cut instituted in the last quarter of 2008.

But oil prices have continued to deteriorate. Crude oil prices have been averaging in the low $40 range.

Valero keeps low gasoline output levels on weak margin

New York - Top U.S. refiner Valero Energy Corp. said it was maintaining low gasoline production levels at its refining system because of poor motor fuel demand and profit margins.

"At Valero, we are managing our run rates according to market demand," Bill Klesse, Valero chairman and chief executive officer, said in the company's earnings release.

"Across our system, the average utilization rate at our fluid catalytic cracking units is currently in the range of 70 percent to 75 percent of capacity," he added.

In mid-December, Valero said it was deepening its gasoline output cuts to 70 to 75 percent capacity that month, from a range in the mid-80s earlier, saying it would keep to the lower production levels until gasoline margins recover.

Oil Prices Rise, Pump Prices Drop

Gasoline demand up 1.7%

New York -- Oil prices jumped for a second consecutive day Thursday Feb. 26th as the supply of crude, for months a secondary consideration to rapidly declining demand, appeared to gain force as a market mover, reported the Associated Press. Traders have followed economic data that suggested producers could not cut production fast enough to match falling demand.

The government reported that imports over the last two weeks are more than 10% below the prior month's average, hinting that massive OPEC cuts may finally have reached the U.S. market.

Light, sweet crude for April delivery jumped 6.4%, or $2.72 to settle at $45.22 a barrel on the New York Mercantile Exchange.

Many analysts believe, however, that the uptick in prices is temporary. They say inventories are at near-record levels and the severe global economic downturn will depress prices further.

Anytime the price of gasoline rises, the consumer should cut back a little and maybe the oil companies’ and OPEC will get the message that the consumer will not take it anymore!

Record breaking profits ‘AGAIN’

ExxonMobil making billions ($45.2 billion for 2008) breaking its own record for a U.S. company. The previous record for annual profit was $40.6 billion set in 2007 while the gasoline and crude oil prices drop in a bad economy.

Offshore Drilling Likely to Resume

Washington – Offshore drilling bans that expired in 2008 likely won’t be reinstated. House Natural Resources Chairman Nick Rahall said that offshore drilling will probably resume despite testimony against the drilling from actor and ocean activist Ted Danson and Philippe Cousteau, grandson of the famous explorer.

“We may be in a situation where the ship has already sailed, and the political reality may be the moratorium as we knew it may not be re-imposed,” Rahall said. Rahall held the first of three hearings on offshore drilling. The congressman told reporters that he has no intention of pushing quickly to reinstate the long-held bans. Rahall said drilling should be allowed in some areas permanently.

Venezuela's Hugo Chavez turns to Big Oil.

Hugo Chavez has lost some of his bluster.

For years, the Venezuelan president railed against the evils of global capitalism; for foreign oil companies operating in Venezuela; this has meant 16-fold tax hikes and in some cases, threats of nationalization for refineries and oil fields.

Now, without the steady cash flow from sky-high oil prices, Chavez is quietly cozying up to these same corporate giants whose investments he needs to keep his economy afloat and to shore up support in advance of a Feb. 15 referendum on his right to run for re-election.

The stakes, however, are far greater for the millions living in poverty throughout the developing world--Chavez's Jekyll-and-Hyde act helps explain not only the volatility in oil markets but also why many resource-rich countries remain so mired in poverty. The reason is that potential investors, who need to finance infrastructure projects in countries like Venezuela, fear getting taken advantage of by fickle dictators after their money has been spent.

How Low Can Oil Go?

Down 73% from crude's $147 peak last July, it is now selling in the low $40. Most forecasts for crude show weakness in the market now, but there is room for per-barrel prices to rise modestly toward the end of the year.

And it's going to drop even lower, according to North American energy analyst Mary Novak at IHS Global Insight. "I don't see a free fall, but the price will certainly go lower. It will be hard to sustain the $40 they're getting today," she says. She expects crude to hit the mid- to low $30 range, bottoming out between the end of March and mid-April. She calls this oil's "shoulder season," as the need for heating fuel wanes and before summer travels begin.

In anticipation of the slump, the Organization of the Petroleum Exporting Countries appears to have cut more than 4 million barrels of crude each day from production, according to a report from PetroLogistics. But Novak expects more.

We're expecting OPEC to announce another cut of 1 to 1.5 million barrels per day in March--and each cut gets harder," she says. "The cut they announced was supposed to take into account further declines than had been expected. But because the economies are so weak, it probably wasn't sufficient."

With the continuing cuts, Novak expects the current 5% surplus capacity of oil to drop to around 2.5%. (Just for perspective: Last summer, it was around 1%.) Those cuts, with help from the stimulus package, make Novak expect crude prices to rise up to $45 to $50 by the end of 2009.

December 2008 highway travel down for 14th month

Washington- Americans drove fewer miles in December for the 14th month in a row, but the decline was not as steep as in previous months because cheaper gasoline prices encouraged travel in some states, the U.S. Transportation Department said.

U.S. highway travel was down 1.6 percent in December compared with a year earlier, falling 3.8 billion miles to 237 billion miles. That was a much smaller drop than the 5.4 percent decline in November or October's 3.7 percent falloff.

While the weak U.S. economy reduced total highway travel, falling pump prices during December helped keep some drivers on the roads longer, the department said. Nonetheless, December was still the 14th straight month of declining highway travel, which now tops 115 billion fewer miles driven since November 2007. For 2008 as a whole, the number of miles driven dropped 3.6 percent, almost 108 billion miles less than in 2007, the department said. It was the lowest yearly level for highway travel since 2003. Despite the national decline in December miles traveled, 17 states posted slight increases, with Colorado having the biggest jump at 5.4 percent.

The biggest declines among the states in miles driven during December were 14.7 percent in Oregon and 11.1 percent in Washington, because of unusually large snowfall. A downside of less driving and more fuel-efficient cars is a slowing of the amount of money going to the Highway Trust Fund from a federal tax on gasoline sales. The Transportation Department tracks motorists through more than 4,000 automatic traffic recorders operated by state highway agencies.

Flash Foods to Pay $82,000 in Gasoline Gouging Case

Waycross, Ga. -- Flash Foods will pay $82,000 to settle an investigation by the Florida attorney general into potential gas price gouging preceding Hurricane Ike by 16 Flash Food stores in the state, the Florida Times-Union reported.

The convenience retailer agreed to pay $40,000 to the American Red Cross National Disaster Relief Fund and $42,000 to the attorney general, the report stated. The state will use the funds for restitution to Flash Foods customers who purchased gasoline from Sept. 12 to Sept. 20, 2008, according to the report.

Mike Huey, an attorney for Flash Foods, told the paper the chain faced gasoline supply issues and Flash Foods' prices were not out of line with its competition in the Jacksonville area at the time. He added Fast Foods decided it was better to end the investigation than fight a case.

"It's strictly a business decision," Huey told the paper. "It will cost you more money and up to a year of your time to try the case."

To receive a refund, customers must apply by April 1, and have proof of purchase, such as a receipt of credit card statement

Fraud on the Rise in Small Businesses

New York – With their eyes focused outward in this struggling economy, small businesses are having to combat a threat on the inside: increasing employee fraud, the Wall Street Journal reports.

During tough economic times, workers tend to run more scams on their employees, such as check forgeries and petty-cash theft. Experts attribute the rise to employees feeling pressure in their personal finances. Small businesses often are hit hard by internal fraud because they lack rigorous internal restraints to stop fraud. Even managers at times may accidentally ascribe lost money to fewer sales instead of employee theft.

“A lot of times a small business will close its doors, and may never know they were defrauded, that the problem wasn’t a declining economy, that employees were stealing,” said James D. Ratley, president of the Association of Certified Fraud Examiners.

Jeffrey Sklar, a partner at Sklar, Heyman & Company LLP, provided some tips on how business owners can keep an eye out for fraud, such as watching workers who appear to be living above their means and checking on employees who guard access to accounting software. Also, review bank statements every month to monitor transfers, checks and other potential cash-flow issues.

The consumers are not trading

Recent reports have illustrated that domestic auto sales are falling and will continue to fall and used car sales are up while the credit crunch has forced many new car dealerships to go out of business.

Motorists are likely to hang onto their current vehicles longer rather than make a new car purchase and used vehicles require additional servicing and maintenance. Also shuttered are the repair and body shops of these auto dealers.

** George E. Dalton Sr. ** 

George E. Dalton, 78, of Palm Beach Gardens passed away peacefully Wednesday February 11, 2009, with the devoted care of Hospice of Palm Beach County. He was born on March 4, 1930 in Washington, DC, the son of Ed and Nellie Dalton. He is survived by his three sons, Steven (Sarah) of Bethlehem, PA, Eddie (Pam) and Kevin (Linda) of Palm Beach Gardens; eight grandchildren, Ryan, Patrick, Brandon, Rebecca, Kyle, Conner, Kyra and Noah and many nieces and nephews. He is also survived by two brothers David of Victoria, VA and Raymond of Burkeville, VA. He is preceded in death by his wife, Nancy; two brothers, Gene and Charles; sister Ann and grandson Corey.

George retired from the Navy after 21 years of exemplary service. During his military career he was stationed in the Middle East where he helped organize NATO, he then took assignments at the Pentagon, the White House Naval Aides Office serving President’s Eisenhower, Kennedy and Johnson; and as Executive Officer Naval Investigative Service in Japan. Upon completion of his military service he was the assistant to Senator Edward M. Kennedy in Washington, DC. He then went on to become a prominent business owner in the Washington, DC and Palm Beach County areas.

A private memorial service was held Friday February 13, 2009. In lieu of flowers the family request donations be made to Hospice of Palm Beach County, Inc., 5300 East Avenue, West Palm Beach, FL 33407-2387.

I knew George for many years and he had many friends in the gasoline industry. He was one of the original ten gasoline dealers to file a law-suit against Exxon that eventually become known as the Exxon Dealer Class Action Lawsuit. Thousands of Exxon and former Exxon dealers became part of the suit throughout the U.S. and is the first time a Class Action Lawsuit that went all the way to the Supreme Court and paid 100% on a dollar. The amount of the award was $1.075 billion. The dealers alleged that Exxon had been overcharging all of its direct served dealers for the wholesale price of motor fuel between March 1983 and August 1994.

Washington D.C. Considers Charging for Bags

Whether paper or plastic, consumers might soon be forking over a nickel for each bag they receive at retailers throughout Washington, D.C., the Washington Post reports. A majority of the District of Columbia Council supports a bill that would place a 5-cent tax on paper or plastic bags. If passed, the legislation would be the nation’s toughest bag law.

Few cities, such as San Francisco, have enacted bans on plastic bags. Others have attempted to impose fees associated with paper or plastic bags, such as Seattle’s proposed 20-cent fee on either bag that voters will vote on in August.

Under the D.C. bill, the city and businesses would split the nickel fee. Proceeds from the city’s share would go to helping to clean the Anacostia River and to giving free reusable bags to elderly and low-income residents. D.C. Council member Tommy Wells sponsored the bill to get assistance in cleaning up the badly polluted Anacostia River, and he said that curbing bag use is a good place to begin. A recent study discovered that plastic bags were “the single largest component of trash” in the river and its tributaries. The law would cover bags from liquor stores, grocers, food vendors, convenience stores, drugstores and other businesses. The proposal also bans non-recyclable bags, such as the thin black plastic bags often used at convenience stores.

Voucher marketing scheme

Florida. Company sued over allegations of deceptive gasoline redemption

Tallahassee, Fla. -- Florida Attorney General Bill McCollum said his office has sued a Pinellas County, Fla., marketing company, alleging the company and its owners engaged in unfair and deceptive marketing of gasoline redemption vouchers. Tidewater Marketing Global Consultants Inc., a Florida corporation located in Pinellas, and the company's president, Crystal Clark, are named in the lawsuit.

An investigation by the Attorney General's Economic Crimes Division revealed Clark and her company engaged in an unfair and deceptive marketing scheme by producing and distributing vouchers for gasoline through a nationwide network of independent distributors, but failing to provide the gasoline cards as promised. The vouchers were sold by distributors to retail merchants, which in turn offered the vouchers to encourage sales of retail products and services.

The lawsuit states hundreds of thousands of these vouchers may have been provided to consumers across the country.

Consumers with vouchers were required to register with Tidewater Marketing through websites, such as and , or by mail and pay a $5 fee for registration. Registered consumers were allegedly entitled to receive gift cards from Tidewater upon submitting receipts for gasoline purchases that complied with the requirements of the program.

The Attorney General's Office is aware of more than 500 complaints from consumers who never received the gift cards and is aware of at least 1,300 additional complaints reported to the Better Business Bureau and other authorities.

The lawsuit was filed under Florida's Deceptive & Unfair Trade Practices Act. Civil penalties against the company and Clark could include an injunction prohibiting them from engaging in this conduct, a requirement for consumer restitution, a $10,000 civil fine for each violation and payment of attorneys' fees and costs.

Residents trying to hang onto their homes in a working-class neighborhood of New London, Conn., are waging a battle in the Supreme Court over their city government's attempt to seize property for private economic development. Susette Kelo and several other homeowners filed a lawsuit after city officials announced plans to bulldoze their residences to clear the way for a riverfront hotel, health club and offices. The residents refused to move, arguing it was an unconstitutional taking of their property.

The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security.
