ASHBY D FAMILY

Welcome to Ashby D. We are delighted that you have decided to become a member of our family. As you may know, each building in Century Village East has its own Condo Association, elects its own members to the Board of Directors, and is responsible for its own services such as landscaping, building repairs, laundry facilities, etc. We believe that Ashby D is one of the best buildings in CVE, and we continue to strive to make it the very best! We can do that, but only with your cooperation and your assistance. Remember: you are an OWNER, not a tenant!

The Board of Directors, consisting of a President and six additional members, are all owners of units in the building. Since the Board shares all of the concerns and needs of the building’s residents, its mission is to serve those needs and concerns in the most efficient manner possible, while ensuring that each dollar expended in pursuit of that mission is spent wisely and economically.

There are several committees, appointed by the president of the Condo Association; these committees may consist of both Board members and non-Board members. Elections of officers and Board Members are held annually; there is an Annual Installation Dinner, which is open to all Ashby D residents.

Perhaps, after you’ve settled into life at Ashby D, you will decide that you would like to have a say in how the affairs of the building are conducted. Please feel free to attend the monthly Board meeting, as a non-voting guest, and to volunteer your services for a committee or special project.

AGE RESTRICTIONS

Century Village East is a adult retirement community. Permanent occupancy or residence in a unit of any person under the age of 18 is prohibited.

However, unit owners are permitted to have a person, under the age of 18, as a guest for reasonable periods of time. Such periods should not exceed a total of 30 days for the year.

ASSESSMENTS

As the owner of a Unit in Century Village, you will be required to pay three monthly assessments: CVMM: (Century Village Mast Management): $70.00

CENDEER: $86 and Century Services: $ 46 for a total of $202.00 for a 2 bedroom unit and a little less for a one bedroom. If you choose, your bank will be able to make those payments for you, so that you will not have to write and deliver checks. These assessments cover the use of all the facilities, the recreation areas and pools, the Trolleys and the Clubhouse.

An annual assessment will be due to the Ashby D Condominium Association. This assessment is based on the projected budget for the coming year. The assessment will be recommended by the Board of Directors, and approved by the General Membership at the Annual Meeting. Unit owners will then be billed for payment.

Unit owners are also assessed for their proportional share of the Ashby D liability Insurance Policy. Each Unit Owner is required by Florida law to have his own/fire/theft/liability insurance.

The Board of Directors has the authority to levy additional assessments, if necessary. The Board of Directors is required by Florida law to maintain reserves to cover major expenses. Money is put away each year so that the it will be available when the expense is incurred.

6. Default in payment of any assessment due to the Association within ten (10) days from the date due shall entitle the association to levy a reasonable late charge against the defaulting Unit Owner of up to $25.

7. Lien – The association is also empowered to place a lien on the apartment of the Unit Owner who is in default in the payment of any assessment. The defaulting Unit Owner shall be liable for all costs of collecting the same, including reasonable attorneys’ fees and court costs.

The Board of Directors strongly recommends that you make arrangements with your bank to have direct payments for all your needs concerning CVE.

Ashby D is a smoke free building

On February 2007, Board of Directors Monthly meeting it was voted unanimously that there will not be any smoking on the catwalks, laundry rooms or any other common elements.

AUTOMOBILE REGULATIONS

Parking Spaces

Each unit is assigned one parking place. Each parking space is designated by the bumper of the unit, which is painted on the car blocks at the back of each space. You may have noticed that in some areas the numbers run consecutively, but that in others there seems to be no rhyme or reason as to how the spaces have been designated. When Ashby D was first built, all areas had consecutive numbers. However over the years, one or another unit owner applied to the Board to ‘’change’’ spaces for medical reasons. The Board may use its discretion in granting those requests.

Your parking space is for your use only. If anyone parks there without your permission, that person is in violation of the rules. If you authorized someone else to use your parking space for an extended period of time, you must notify the Board of Directors of that authorization, in writing.

There are also several spaces in which the car block has been painted yellow, with the word ‘’Guest’’ painted where the number would otherwise be located. These spaces are to be used by your guests: relatives, contractors etc.

ID DECALS AND BAR CODES

Car-owning Unit Owners must provide the Management Office with information about each car owned. Go to the ID Office in the Club House to do this. When the owner is issued his/her permanent CVE identification, he/she will also, be given: a) an ID decal which is placed on the front windshield, just under the rear view mirror and b) a bar code to be placed on the passenger side rear window of the car. These decals and Bar Codes

allow the driver to enter the village through any of the gates without having to show his/her ID card. Cost Free.

NO PARKING AREAS

No parking areas mean just that - NO PARKING. These areas must remain empty so that in case of emergency, vehicles such as ambulances, fire engines, etc. may have easy access to and from the building. However, the No Parking areas may be used for loading and unloading vehicles. The unloaded vehicles should then be moved to an appropriate space (reserved or guest).

PROHIBITIONS

1) Automobile on blocks with or without tire are not permitted to remain in the parking area.

2) Major repairs on the parking areas surface are prohibited. Washing cars and using hook up a hose from waste bins in building areas is a no no.

BICYCLES

Bicycles must be parked either in your assigned area (in front of your car) or in the Bike Room located on the same floor as your unit. In the Bike Room an identification tag must be placed on the item. The tag should include your name and unit number.

BUSES AND TROLLEYS

Century Village has its own trolley system, the Lolly Trolley. These trolleys travel all around the Village, making it easy to get from one place to another without driving. Use of the trolleys is free. The Trolley which services Ashby D is the #4. The trolleys leave the clubhouse area on their routes, roughly on the hour and the half hour. However there is no service between 12:00 and 1:00 PM. There is a bench at the entrance to the Ashby D parking area, which is designated trolley stop. For a complete trolley schedule, see the CVE Reporter, a monthly paper put out by Century Management and delivered next to the mailboxes.

Next to the Clubhouse, there is a parking area for buses. Municipal buses provide transportation to shopping centers, supermarkets, malls and many other places. That bus schedule is also printed in the Reporter. There is a nominal charge for use of the buses.

CATWALKS

Owners have voted unanimously to make Ashby D a non-smoking building.

They will be no smoking on catwalks or other common areas such as the laundry rooms. Smoking in your units will be your choice. All Catwalks must remain completely unencumbered. Chairs, plants and all other items may not be kept on the catwalks, nor is anything allowed to be hung from, or placed on the balustrades. Nothing which might impede walking on the catwalk, or which might present an obstacle to people using walkers/wheelchairs is permitted. There are no exceptions.

DAMAGE TO COMMON AREAS

The Unit Owner is responsible for any damage done to the catwalk and/or the elevator by movers, repair people, deliveries etc. New owners are required to leave a deposit of $200 with the Board of Directors, before moving into the building. The new Unit Owner is required to instruct the movers to use rubber-wheeled dollies, rather than metal wheels to prevent damage to catwalk finish. In case of damage, the $200 deposit will be applied toward the cost of repairs, with the balance, if any returned to the new owner. If the damage exceeds $200, the unit owner will be responsible for the difference. The entire deposit will be returned if there is no damage.

Similarly, an owner planning major renovations or repairs will be asked to give a security deposit of $300 to the Board of Directors. The owner is also instructed to inform their contractor that they will be responsible for any damage done to the common areas of the catwalk and the elevator. Waste debris has to be removed by contractors and not dumped into our dumpster. Return of the deposit will be on the same terms as for the new owner move in deposit.

GARBAGE, TRASH AND RECYCLING

Garbage

Garbage should be put into plastic bags, along with other food preparation items (foils, cling wrap, paper towels, etc.) and other normal household trash. The plastic bags should be secured and thrown down the garbage chutes, which are opposite the laundry rooms.

BE SURE THAT THE BAG TO BE SENT DOWN THE CHUTE IS SMALL ENOUGH TO PASS THROUGH THE CHUTE INTO THE TRASH CONTAINER BELOW, DO NOT TRY TO FORCE A TOO-LARGE BAG DOWN THE CHUTE AS IT MAY BLOCK THE ENTIRE CHUTE, REQUIRING SOMEONE TO REMOVE THE BLOCKAGE

TRASH

Cartons: If you have a new appliance delivered and installed, and the appliance comes in a large cardboard carton, it is the responsibility of the appliance dealer to remove the carton from CVED. If the driver does not take the box with him, you must cut the carton apart, into pieces small enough to be placed in the recycling container. The pieces must be flat. The same procedure for disposing of cardboard cartons must be used for cartons of all sizes

RECYCLABLES

There are four recycling bins at the east end of the parking area. (close to the pool). The largest one is for newspapers and cardboards. The others are for cans and plastics. Please follow the directions on each bin to make sure that our recyclables are going into the proper container. BE SURE TO SHUT THE COVERS OR DOORS OF THE RECYCLING CONTAINERS AFTER PUTTING YOUR RECYCLABLE INTO THEM.

Unwanted Furniture, Kitchen Appliances, etc.

Unwanted items, such as furniture, appliances, exercise equipment, old carpeting, etc. may NOT TO BE PLACED NEXT TO THE RECYCLABALE BINS. THEY ARE NOT RECYCLABLES! If you are replacing an old kitchen appliance, having new carpeting installed, having new flooring installed, etc., you should arrange to have the dealer take the old appliance away when delivering the new, and the installers remove old materials, packaging, etc. when the job is completed. If you have a piece of furniture or appliance that you don’t want, and if you believe that it has no use to anyone else, you may dispose of it as follows: Call the city of Deerfield Beach/Trash Collection Department 954-480-4379 tell them what you have. They will tell you when they will pick it up. Make sure you get a confirmation number. IT IS THEN YOUR REPONSIBILITY TO SEE THAT IT IS PLACED OUTSIDE, IN FRONT OF THE DOOR TO THE TRASH CONTAINER. IT SHOULD BE PLACED THERE ON THE EVENING BEFORE THE SCHEDULED PICK-UP. There is no charge for the pick-up.

If you have something that you no longer use or want, but that is in good enough condition for someone else to use, there are many local charities that will arrange to pick up the item from your home.

GUEST PASSES

Guest passes, for individuals who will be staying with the Unit Owner for short periods of time (up to 30 days) can be purchased at the ID office in the Clubhouse. The guest must accompany the Unit Owner to the office to secure the pass.

Keys

Each Unit Owner is required to provide the Board of Directors with a key(s) to open the door to the unit. The Board of Directors will keep those keys under lock and key, those keys will be used only in case of emergency.

LAUNDRY FACILITIES

There are two laundry rooms on each floor of the building. Each room has one coin-operated washer and one coin operated dryer. While you are likely to choose to use the laundry room closest to your condo, it is permitted to use any laundry-room in the building. However, whichever is your choice, we ask that you help maintain cleanliness in the room by disposing of trash in the wastebasket, by making sure that the washer is clean when your wash is done, and by cleaning the lint trap after drying your laundry.

Signs posted in each laundry room indicate that the average wash takes about 45 minutes, and the average drying takes about 1 hour. Please return to the laundry room to retrieve your laundry within those time periods, so that the machines are not tied up for use by other owners. Also indicate on the small board on top of the washing machine your unit number using a peg.

PLEASE LEAVE BOTH MACHINE DOORS CLOSED WHEN LEAVING THE LAUNDRY ROOM, SMALL ANIMALS HAVE BEEN KNOWN TO CLIMB INTO OPEN MACHINES.

If a machine is not operating properly, please contact the President of the Association so that he/she may call the proper repair service. The cost of using the laundry machines is nominal: at present, 75 cents for the washer and 50 cents for the dryer. The money collected from the machines is placed into the Condo’s laundry account, so that there is money available to cover the costs of repairs and replacement.

IMPORTANT INFORMATION

Under the By-Laws of COOCVE and the Ashby D Condo Association, unit owners are prohibited from having washers and/or dryers in their units. Since both prohibit such activity, it is NOT ALLOWED FOR AN OWNER TO HAVE A CLOTHES WASHER AND/OR DRYER INSTALLED IN HIS/HER UNIT.

NOISE

Unit owners are asked to respect the sensibilities of other owners. For that reason, television, radios, musical instruments should be played at a sound level that will not be annoying to neighbors.

PETS

No four legged pets are permitted in the building, on the premises of CVE.

OCCUPANCY IN THE ABSENCE OF THE UNIT OWNER

No guests or invitees of any unit owner (other than children, grandchildren, parents, brothers or sisters of the owner(s)) are to occupy the unit in the absence of the owner(s), WITHOUT THE WRITTEN CONSENT OF THE BOARD OF DIRECTORS.

RENTALS

Ashby D is a rental building, however you have to follow the regulations for rental. A document for that purpose is included within.

RENOVATIONS

When a Unit Owner hires a contractor to renovate his/her Unit, that owner must inform the contractor that all construction material removed from the unit and/or debris from the job MUST BE REMOVED BY THE CONTRACTOR. THE MATERIALs ARE TO BE REMOVED FROM CENTURY VILLAGE, NOT PLACED BY THE DUMPSTERS. If the renovation is being done by the owner himself, the owner must arrange with the City of Deerfield Beach to have the debris/construction materials removed (there will be a charge to the owner).

SERVICE CONTRACTS

Each Unit Owner is responsible for obtaining a Service Contract covering the appliances in the Unit. There are several Service Companies in the area, including Century Maintenance. These policies generally cover repairs to your appliances and replacement when repair is not possible.

STORAGE AREA

There is a storage area behind each laundry room. You should receive a key to that area at your closing. The area is divided into separate cages, which are allocated, one for each condo. It is your responsibility to provide a lock for the door to your cage. You will notice that some things are in the storage area, but not in the cages. Rather, they are in the ‘’general’’ area of the storage room. If you are going to leave something in that area, temporarily, it is required that you tag the item with your name and condo number. NO items may obstruct the path from the front of the storage room to the rear wall.

NO COMBUSTIBLE MATERIALS ARE TO BE LEFT IN THE STORAGE AREAS. DO NOT LEAVE THE STORAGE AREA DOOR OPEN. DO NOT LEAVE YOUR STORAGE AREA UNLOCKED. THE CONDO ASSOCIATION IS NOT RESPONSIBLE FOR ANYTHING LOST, BROKEN OR STOLEN.

TILE FLOORS

Any Unit Owner who decides to have ceramic tile laid on a portion of the floor must inform the workman that the tile must be laid over a ¼ inch cork sub-floor… This is for the purpose of soundproofing.

WATER AND WATER VALVES

The water valves are behind the building, directly under the windows of each floor unit. Each unit has it’s own water valve. There are four valves in each set, marked 1,2,3, & 4. Valve #1 is for the first floor unit, valve#2 is for the second floor unit, etc.

Each unit owner is required to turn off, or have turned off, the water to his/her unit if the unit is going to be unoccupied for at least two weeks. The unit owner may call Century Maintenance to arrange for both turning off and turning on of the water. There may be a small charge for this service. Alternatively, the unit owner may turn off and on the water himself. Ashby D has recently had new valves installed that make that procedure extremely simple. The valve moves only in one direction up, to turn the water off – and down to turn the water on.

PERSONAL DATA SHEET

Each Unit Owner is responsible for completing a Personal Data Sheet which is attached. This is done so a responsible party can be reached in case of an emergency.

RULES FOR RENTAL

1) Minimum rental is three (3) months.

2) One renter per year.

3) $100 Investigator’s fee to Century M&M.

4) $100 Management fee to Ashby D.

5) $300 for any renting after the first year.

6) We reserve the right to deny permission to rent if the above conditions are not met and the apartment is not maintained acceptably.

7) Rentals are limited to no more than 10% or

8 apartments in the same year.

8) Owner must reside in the apartment at least one week every year.

9) All applications must include a letter from owner indicating they will be responsible for all damages, cleaning etc, incured by the tenant.

10) All applications must include a copy of the signed lease.

11) Owners will be responsible to ensure all necessary breakers and

outside water valves shut off when unit is vacant.
