SEASONAL CAMPGROUND LODGING AGREEMENT FOR THE 2022 SEASON

1. The CONTRACT.

A. This agreement is called the CONTRACT. All words which are typed in CAPITAL LETTERS are defined in the CONTRACT.

B. Upon the payment of FEES and execution of this CONTRACT by both parties, the persons named herein as the CAMPERS are granted the privilege of LODGING for a SEASON at the CAMPGROUND on a CAMPSITE, until and unless the CAMPER is subject to REMOVAL.

C. The CONTRACT incorporates the CAMPGROUND RULES, policies and any other documents issued by the CAMPGROUND to the CAMPER at any time during the term of the CONTRACT.

D. The CAMPGROUND may elect to allow persons who are not CAMPERS to LODGE on a day-to-day basis as GUESTS under the conditions of this CONTRACT.

E. The CAMPERS acknowledge the INHERENT RISKS of camping at the CAMPGROUND and agree that the liability of the CAMPGROUND is limited as stated in this CONTRACT.

F. Upon expiration of the CONTRACT or REMOVAL of the CAMPER, the CAMPING UNIT shall be removed as stated in this CONTRACT or may be removed by the CAMPGROUND at the expense of the CAMPER.

G. This CONTRACT may not be assigned to others. The CAMPER may not list the CAMPING UNIT or CAMPSITE on a sharing site such as RVshare, Outdoorsy, AirBnB, VRBO, or any other service or advertising forum. Listing a CAMPSITE or CAMPING UNIT on a sharing site, or sale a of the Unit by the CAMPER constitutes a voluntary termination of this Agreement.

H. The term of this CONTRACT is the SEASON.

I. Any disputes concerning this CONTRACT are subject to ARBITRATION.

2. The CAMPGROUND.

As used in this CONTRACT, the term CAMPGROUND means the premises of CHAMPIONS RIVERSIDE RESORT, located at W16751 Pow Wow Lane. The CAMPGROUND is an LLC. The CAMPGROUND includes the amenities and common areas of the CAMPGROUND.

3. The CAMPERS:

A. The persons named below, and no one else, are the CAMPERS:

ADULTS: __________________________________________________________________.

B. Animals.

The CAMPGROUND allows CAMPERS to bring up to a total of 2 dogs or cats, owned by the CAMPER. Before bringing the dog or cat, CAMPER shall execute a PET AGREEMENT.

C. Any unauthorized animal or animal causing damage or injury will be removed immediately.

D. Animals shall be kept inside the CAMPING UNIT or on a leash. There are NO EXCEPTIONS to this RULE. Any animal found unleashed outside a CAMPING UNIT will be removed without any warning.

E. Service animals which work to provide a disabled person with specific assistance are welcome. The CAMPGROUND does not accept “emotional support animals.”

4. LODGING.

A. The CAMPERS’ privilege of occupancy is known as LODGING. The CAMPGROUND is a place of transient recreational lodging. The CAMPGROUND is not a residence or leasehold of any kind. This CONTRACT provides the CAMPERS with the right to be physically present on the CAMPGROUND for the specific purposes authorized in the CONTRACT. The privilege is a license to be present on the CAMPGROUND at the pleasure of the CAMPGROUND and is not a lease.

B. All CAMPERS agree to enjoy their LODGING in an orderly, respectful, peaceful, civil manner which is respectful of the interests of other CAMPERS and GUESTS and which complies with the RULES of the CAMPGROUND.

C. All CAMPERS and GUESTS acknowledge the CAMPGROUND may demand and cause REMOVAL of any CAMPER or GUEST for violation of the CAMPGROUND’s rules or standards, at any time without notice or prior warning in the sole judgment of the CAMPGROUND.

D. LODGING includes the CAMPERS’ use of the CAMPSITE, placement of the CAMPING UNIT and use of AMENITIES according to the terms of this CONTRACT.

E. CAMPERS are aware that:

1. This CONTRACT is not a lease.

2. CAMPERS or GUESTS are not tenants.

3. The CAMPGROUND is not a landlord

4. CAMPERS or GUESTS are required to agree to REMOVAL from the CAMPGROUND without any judicial process such as eviction if the CAMPGROUND requires under this CONTRACT.

5. CAMPERS or GUESTS have no right to renewal of this CONTRACT nor right to occupy the CAMPSITE except at the pleasure of the CAMPGROUND.

5. The SEASON.

A. The CAMPGROUND has the following schedule for CAMPERS for 2022 and winter storage.

1. January 1 to March 31, 2022: CLOSED

2. March 15 to April 1, 2022: POTENTIAL SET-UP ACCESS

(weather permitting and at pre-approved discretion of the CAMPGROUND)

3. April 1, 2022 to October 31, 2022: OPEN

4. August 31, 2022: DEADLINE FOR RENEWAL for 2023

5. October 15, 2022: DEADLINE FOR REMOVAL IF NOT RENEWING

6. October 16 to October 31, 2022: SHUT-DOWN ACCESS

(weather permitting and at pre-approved discretion of the CAMPGROUND)

7. November 1, 2022 - March 14, 2023: CLOSED

B. CLOSED means no one is permitted to access the CAMPGROUND except as provided in this paragraph. A RETURNING CAMPER is one who has signed a Seasonal Lodging Agreement for the following SEASON, paid all required payments and been approved to return by the CAMPGROUND. RETURNING CAMPERS may store the CAMPING UNIT on the CAMPSITE during the CLOSED season. RETURNING CAMPERS may access the CAMPGROUND when it is CLOSED only with advance permission from the CAMPGROUND.

C. SET-UP ACCESS means the CAMPGROUND will allow RETURNING CAMPERS and authorized CONTRACTORS to have scheduled access to the CAMPGROUND between 8:30 AM and 4:30 PM, for the purpose of preparing the CAMPSITE for occupancy during the following SEASON.

D. SHUT DOWN ACCESS means the CAMPGROUND will allow CAMPERS and authorized CONTRACTORS to have scheduled access to the CAMPGROUND between 8:30 AM and 4:30 PM, for the purpose of preparing the CAMPSITE for winter storage or to remove the CAMPING UNIT.

E. OPEN means the CAMPGROUND will be available for CAMPERS to enjoy the CAMPGROUND’S LODGING.

F. DEADLINE FOR RENEWAL means that by August 31, 2022, CAMPERS must sign and deliver the 2023 Seasonal Lodging Agreement to the CAMPGROUND and pay FEES that are due. The CAMPGROUND may make the CAMPSITE available to other CAMPERS if the signed 2023 Agreement and FEES are not received by this date.

G. DEADLINE FOR REMOVAL: October 15, 2022. If CAMPERS are not renewed for 2023, all CAMPING UNITS must be relocated by that date and the CAMPSITE must be completely cleared of personal property.

6. The CAMPSITE.

A. The CAMPERS may have LODGING on Site Number ______. The CAMPERS shall have exclusive LODGING on the CAMPSITE for the purposes allowed by this CONTRACT.

B. CAMPERS have had the opportunity to inspect the CAMPSITE and accept its condition.

C. The CAMPSITE includes:

1. A location which shall be specified by the CAMPGROUND on which the CAMPERS may place a CAMPING UNIT.

2. An electrical connection which provides domestic electricity not to exceed Amps for site.

3. A water supply line which is connected to a private water well.

4. A connection to a private on-site wastewater treatment system or Service to empty a transfer tank on the CAMPING UNIT which holds greywater generated by the CAMPERS.

5. A parking area which may be used for up to two VEHICLES of the CAMPERS or GUESTS if space allows. GUESTS must purchase a car pass.

6. Space on which the CAMPERS may place one (1) storage shed, which must be constructed of vinyl or resin and may not be larger than 4 feet by 4 feet by 6 feet, and approved by the Campground owner prior to placement.

7. Space on which the CAMPERS may place a porch or patio whose design and construction is approved by the CAMPGROUND before it is constructed.

8. The right to place a table and reasonable number of chairs and umbrella on the CAMPSITE.

9. No other objects of any kind may be placed on the CAMPSITE without permission in advance from the CAMPGROUND.

10. CAMPERS shall not use said CAMPSITE for any illegal activity or activity which would injure the reputation or the business of CAMPGROUND. No business shall be conducted on site.

11. The CAMPGROUND retains the right to direct the CAMPERS to remove any article of personal property of any kind whatsoever if the CAMPGROUND in the sole discretion of the CAMPGROUND determines that the personal property is inconsistent with the best interests of the CAMPGROUND. The CAMPGROUND is not responsible for the damages or loss which may be sustained by a CAMPER by reason of having to remove any item of personal property.

12. CAMPER shall not commit waste and will suffer no waste to be committed in or upon said CAMPSITE.

13. CAMPERS shall keep the CAMPSITE free of litter or debris and shall maintain all personal property on the CAMPSITE.

a. CAMPER shall keep said CAMPSITE and all personal property located thereon in a state of cleanliness and healthy sanitation and shall comply with all ordinances and regulations of the Township of Galesville, the State of Wisconsin, the United States, and any authorized agency of said governmental bodies

b. No other objects of any kind may be placed on the CAMPSITE without permission in advance from the CAMPGROUND. There should not be any household appliances of any type except lawn furniture or a portable cooking grill left outside on said CAMPSITE.

1. CAMPERS may not perform any repairs, construction, landscaping, maintenance or other work on their CAMPSITE or CAMPING UNIT without prior written approval of the CAMPGROUND.

a. Work which requires a Wisconsin contractors’ license must be performed by a qualified trades person with a license. The CAMPGROUND reserves the right to refuse to approve any contractor.

b. CAMPER shall be responsible for the maintenance & repair of any and all personal property located upon said CAMPSITE.

c. Trailer, deck and or shed must be at least five feet from lot lines. Lot lines are determined by CAMPGROUND.

d. Upon written prior consent of CAMPGROUND, CAMPER, at its own expense, may construct only one storage shed upon said CAMPSITE. Tarp covered sheds are prohibited. You must submit your plans to CAMPGROUND management for both current and future storage sheds. Metal sheds are prohibited without written permission from CAMPGROUND management.

e. Upon written prior consent of CAMPGROUND, CAMPER, at its own expense, may construct a fence upon or around said CAMPSITE. The following requirements are applicable to said fence so constructed:

i. The boundary lines of said CAMPSITE are marked by CAMPGROUND prior to commencement of construction;

ii. Said fence must be approved in writing by CAMPGROUND manager;

iii. Said fence shall become the property of CAMPGROUND.

D. Any landscaping or other improvements to the CAMPSITE made by CAMPERS shall remain at the CAMPSITE after the CAMPERS’ REMOVAL and are the property of the CAMPGROUND.

1. All landscaping improvements made to said CAMPSITE by CAMPER, including without limitation trees or bushes, become the property of CAMPGROUND.

2. CAMPER is responsible for all building permits, but the design must be approved by the Campground prior to getting any permits.

7. The CAMPING UNIT.

A. The CAMPERS may place on the CAMPSITE a single trailer, motorhome, pop-up trailer or other recreational vehicle which has been approved by the CAMPGROUND and which is specified in this CONTRACT. That trailer, motorhome, pop-up trailer or other recreational vehicle is known in this CONTRACT as the CAMPING UNIT.

B. Only trailers, motorhomes pop-up trailers, park model RVs or other recreational vehicles which are less than 15 years old and have been certified by the Recreational Vehicle Industry of America may be placed on a CAMPSITE. The CAMPERS may not replace a CAMPING UNIT without approval by the CAMPGROUND.

C. The CAMPERS may place the following CAMPING UNIT on the CAMPSITE:

D. CAMPERS agree that the CAMPING UNIT above will be 15 years old in 2022. The CAMPGROUND does not allow any CAMPING UNIT to be more than 15 years old. CAMPER agrees that, in the event CAMPER has renewed this CONTRACT through 2022, the CAMPING UNIT will be subject to REMOVAL at the end of that season or have written approval from the Campground to keep the unit on the property.

F. Selling a CAMPING UNIT: Should a CAMPER wish to sell a CAMPING UNIT, the CAMPER shall notify the CAMPGROUND. The CAMPGROUND reserves the right to refuse to approve the proposed purchaser of a CAMPING UNIT. If a CAMPER sells a CAMPING UNIT without obtaining approval of the buyer, this CONTRACT is terminated, and the CAMPING UNIT is subject to REMOVAL.

1. Before signing any purchase agreement, the CAMPER shall obtain approval of the proposed purchaser from the CAMPGROUND If the CAMPGROUND approves the buyer, the buyer shall execute a CONTRACT in their own name prior to LODGING at the CAMPGROUND.

2. Sales on Site. If CAMPER elects to sell on site CAMPER’s unit and associated personal property, CAMPER must notify CAMPGROUND prior to commencing any sale activities. To be entitled to sell the unit and associated personal property on-site, CAMPER agrees to give CAMPGROUND a set of keys, provide sale price and information and to pay CAMPGROUND 10% of the selling price of the unit and personal property.

3. Upon sale of unit, there shall be no refunds of any unused portion of the seasonal fee. Any unpaid portion of the seasonal fee shall be due immediately in full. Personal property sales can be waived upon written consent from the owners.

8. GUESTS.

A. The CAMPGROUND may permit persons other than the CAMPERS to lodge on the CAMPSITE as authorized GUESTS. The CAMPGROUND has the right to refuse to allow any person admission to the CAMPGROUND as a GUEST

B. GUESTS are subject to the CAMPGROUND RULES and the following additional restrictions and limitations:

1. GUESTS may not remain on the CAMPGROUND for more than two continuous weeks or a more than 40 days in a SEASON without the additional approval of the CAMPGROUND.

2. There shall be no more than four GUESTS at a CAMPSITE on the same day.

3. Any person who is not a CAMPER and is on the premises of the CAMPGROUND is a trespasser who will be removed unless that person is approved and registered by the CAMPGROUND office as a GUEST.

4. CAMPERS are responsible for the conduct of their GUESTS.

a. CAMPERS are responsible for the conduct of their day and overnight GUESTS, and shall be personally liable for any personal injuries or property damage arising from the actions of such GUESTS.

5. GUESTS are responsible for their own conduct, behavior and deportment, and shall abide by all provisions of this CONTRACT which apply to CAMPERS.

6. No GUESTS are permitted at a CAMPSITE unless there is an adult present at the CAMPSITE.

7. All CAMPER and/or GUEST parties that are planned at the CAMPGROUND must be preapproved by CAMPGROUND management at least two weeks prior to the event.

8. No loud music or large gatherings can occur at the CAMPSITE. These types of events must happen under the pavilion and be approved by management of the CAMPGROUND.

9. All GUESTS must register with the CAMPGROUND. The CAMPGROUND may refuse to admit any person as a GUEST for any reason in the sole discretion of the CAMPGROUND. GUESTS may register in the CAMPGROUND office, or by the GUEST in the “Seasonal” section on the CampersApp.

10. As a seasonal CAMPER you are awarded 75 facility wrist bands to use during the year. They will be assigned to you so your GUESTS do not pay a fee. You will sign for these and be responsible for their safe keeping. No wristbands can be reissued. Please secure your GUESTS wristband. NO EXCEPTIONS.

a. A GUEST is someone defined as visiting you while you are here. Any GUESTS of CAMPER must register at CAMPGROUND’s office. If said GUESTS are found without a wristband, there shall be a charge of $10.00 to the site holder. Said fee shall be due and payable on demand.

b. GUEST conduct issues/wristband issues can lead to the seasonal losing all GUEST privileges. The CAMPGROUND reserves the right to accept or reject anyone on the property.

C. GUESTS must purchase a $5 parking pass and must park only on the seasonal site they are a GUEST of. Additional parking is available in the Bar & Grill parking lot designated area.

1. Your frequent GUESTS may purchase a seasonal parking pass for $50.00 if you have room for them to park on your site. Violations of this privilege will affect your agreement.

9. VEHICLES.

A. The following are VEHICLES and are permitted to be operated on the CAMPGROUND by CAMPERS or GUESTS:

1. Automobiles, pickup trucks and vans with a curb weight of less than 9,000 pounds.

2. Motorcycles legal for street use which are equipped with original equipment mufflers.

B. The following are not vehicles and are not-street legal but may be used in the CAMPGROUND subject to the RULES.

1. Golf carts.

2. Pedal-powered bicycles

C. No person may operate a VEHICLE unless that person has a valid driver’s license issued by Wisconsin, or, by a State or licensing authority recognized by Wisconsin, and has liability insurance in force covering the vehicle being operated.

10. RULES.

A. The CAMPERS acknowledge that each CAMPER has been given a copy of the RULES of the CAMPGROUND. The CAMPERS agree they will follow the RULES and the directions of CAMPGROUND staff. All these expectations are known in this CONTRACT as the RULES.

B. CAMPERS agree that all persons should have the opportunity to LODGE at the CAMPGROUND regardless of their race, national origin, color, creed, religion, sexual orientation or marital status. Discriminatory actions, harassment based on a person’s status and sexual harassment are not tolerated by CAMPGROUND. Individuals engaging in discriminatory or harassing behavior will be subject to immediate REMOVAL.

C. The CAMPERS agree to conform to and follow the RULES. In addition, the CAMPERS agree to use reasonable judgment, cooperative spirit and positive attitudes to interact pleasantly and quietly with other CAMPERS, GUESTS and the CAMPGROUND staff.

D. The CAMPERS wish to enjoy a peaceful, pleasant recreational experience, which depends on every CAMPER and GUEST following the RULES. In order to assure that the CAMPGROUND can maintain peace and order, each CAMPER agrees the CAMPGROUND has the right to direct any CAMPER to leave the CAMPGROUND, temporarily or permanently, for any lawful reason in the sole discretion of the CAMPGROUND.

E. The CAMPERS agree to abide by changes in the RULES or new RULES as they are added or amended.

11. AMENITIES

A. The CAMPGROUND offers certain common areas for the enjoyment of CAMPERS and GUESTS. These common areas and services are known as AMENITIES.

B. CAMPER acknowledge that the CAMPGROUND may, in its discretion, make changes to the AMENITIES, the hours in which the AMENITIES operate, open or close AMENITIES.

C. The AMENITIES include:

1. Playground.

2. Jumping Pillow.

3. Swimming pool.

4. Arcade.

5. Pedal Carts.

6. Laser Tag.

7. Zip Line.

8. Beach.

9. Petting zoo.

10. Picnic areas.

11. Laundry.

12. Waste disposal.

13. Inflatables

14. Club Center Ice Cream Shoppe

15. Craft Corral

16. Water Wars

12. REMOVAL.

REMOVAL OF CAMPER OR GUEST.

A. Whenever a CAMPER or GUEST is directed to leave the CAMPGROUND, the CAMPER AND GUEST shall leave immediately and shall remain off the premises of the CAMPGROUND. The CAMPER may return to the CAMPGROUND only with advanced permission of the CAMPGROUND and only for the purpose of removing the CAMPING UNIT and cleaning the CAMP SITE. A CAMPER or GUEST present on the CAMPGROUND after notice of REMOVAL is a trespasser.

B. Any CAMPER or GUEST who fails to leave the CAMPGROUND when ordered to do so shall be liable to the CAMPGROUND for liquidated damages of $100 per day plus all costs and attorneys’ fees incurred by the CAMPGROUND in removing the CAMPER or GUEST.

REMOVAL OF CAMPING UNITS AND PERSONAL PROPERTY.

A. Upon the expiration of this CONTRACT, or whenever a CAMPER is notified that that CONTRACT has been terminated by the CAMPGROUND, the CAMPER shall arrange for REMOVAL of the CAMPING UNIT and all CAMPSITE property within ten (10) days of the expiration or termination date.

B. CAMPERS or GUESTS who are present on the CAMPGROUND during closed periods without advance permission are subject to REMOVAL.

C. Upon the expiration of this CONTRACT, all CAMPERS and GUESTS and all personal property located on the CAMPSITE shall be relocated to a place other than the CAMPGROUND by the DEADLINE FOR REMOVAL. Unless a written extension of the DEADLINE FOR REMOVAL is signed by the CAMPGROUND, the CAMPGROUND may remove the CAMPING UNIT, attachments, sheds, vehicles, furniture and any other personal property.

D. If a CAMPING UNIT is not removed, or a CAMPSITE is not completely cleared of personal property, the CAMPGROUND may charge the CAMPERS fifty dollars ($50) per day for storage. In addition, CAMPERS shall be liable for all expenses incurred by CAMPGROUND in relocating the CAMPING UNIT and clearing the CAMPSITE.

E. CAMPER agrees that the presence of a CAMPER or a GUEST on the CAMPGROUND premises after the CAMPGROUND has given the CAMPER or GUEST notice of REMOVAL shall constitute irreparable harm to the CAMPGROUND for which money damages are inadequate.

F. There will be NO REFUNDS to CAMPERS or GUESTS who are subject to REMOVAL, or who leave the CAMPGROUND before the end of the SEASON.

G. CAMPERS shall be responsible for paying any charges, fees or taxes which are assessed against the CAMPSITE, the CAMPING UNIT or the CAMPGROUND by reason of any action or omission of the CAMPERS. If CAMPERS’ actions or omissions result in commencement of enforcement action against the CAMPGROUND, then CAMPERS shall be responsible for the attorneys’ fees and expenses incurred by the CAMPGROUND.

H. Unpaid charges and fees shall be a lien against the CAMPING UNIT. In the event of non-payment, the CAMPGROUND shall have a lien for unpaid charges and costs and shall have the right to detain the CAMPING UNIT until the charges and fees are paid, or, to place the CAMPING UNIT for sale. All unpaid charges, fees and expenses of sale shall be paid out of the sale proceeds.

I. There shall be a late charge of the lesser of $10 or 5 % for payments made more than five days after the due date. If an unpaid balance remains unpaid for more than 30 days, the balance shall bear interest at the rate of 1.5 % per month or partial month.

J. CAMPERS shall pay CAMPGROUND all attorneys’ fees which CAMPGROUND incurs in any lawsuit or arbitration to enforce this CONTRACT or in defense of the CAMPGROUND by reason of any action or omission of the CAMPERS.

13. INHERENT RISKS AND LIABILITY.

A. CAMPERS are aware that the CAMPGROUND offers recreational opportunities in an outdoor setting. Because the CAMPGROUND’S setting is a natural environment, the Wisconsin Legislature has adopted section 895.519 of the Wisconsin Statutes, which grants the CAMPGROUND immunity from liability for the INHERENT RISKS of camping activity. CAMPERS acknowledge they accept the INHERENT RISKS of camping. CAMPERS are aware that they will be unable to recover damages against the CAMPGROUND for the INHERENT RISKS of camping even if the CAMPERS or GUESTS are injured or killed as the result of such INHERENT RISKS.

B. The CAMPGROUND is not liable for impairment of the quality or extent of LODGING resulting from weather, acts of God, infectious agents, or injuries caused by other CAMPERS.

C. The CAMPER shall obtain and maintain in force liability and property insurance which covers the CAMPING UNIT, the CAMPERS and all VEHICLES.

14. GENERAL PROVISIONS

A. This CONTRACT is the only agreement between the CAMPGROUND and the CAMPERS. All discussions and representations are integrated into this CONTRACT.

B. If CAMPGROUND or CAMPER are required to give notice to the other party, notice will be deemed to have been given:

1. To the CAMPGROUND, if a written notice was given to a CAMPGROUND employee at the CAMPGROUND office during business hours.

2. To the CAMPER if a written notice was given to an adult CAMPER, or, posted on the door of the CAMPING UNIT.

C. Written notice is not required for any directive given in an emergency; to preserve the peace or quiet in the CAMPGROUND, or to enforce a provision of this CONTRACT or the RULES.

D. This CONTRACT may be amended only in a written amendment signed by the CAMPGROUND and the CAMPER.

E. All claims and disputes arising under this CONTRACT shall be resolved according to the laws of the State of Wisconsin.

15. ARBITRATION.

A. Any claims by CAMPGROUND for injunctive relief against a CAMPER or GUEST, of for collection of unpaid FEES or other sums alleged to be owed pursuant to this CONTRACT shall be brought in the Circuit Court for the County of Trempealeau, State of Wisconsin. CAMPER and CAMPGROUND irrevocably waive any right to trial by jury.

B. In the event that CAMPER or CAMPGROUND wish to assert any claim other than the claim described in section A above, such as but not limited to a claim for personal injuries, including defamation; violations of trade practices, improper business methods or unlawful discrimination, it is agreed that the claim shall be resolved in Arbitration according to the rules of the American Arbitration Association. The Arbitration shall be held in Galesville, Wisconsin, the County Seat of Trempealeau County.

Fees. The CAMPER will Pay the following fees: All fees are non-refundable. A late fee of the greater of $10 or 5% will be added to payments made after the due date. Late payment interest is 1.5% per month.

CAMPER shall pay a seasonal fee in the sum of $2480.00 (Plus sales tax $136.40 for a total of $2616.40) Said seasonal fee is due and payable in full upon execution of this Agreement.

At CAMPER’s election, this fee may be paid as follows:

The CAMPER agrees to sign the agreement indicating they are staying for the following year by August 31, 2021 and pay a nonrefundable deposit of $400.00 by November 1, 2021 to secure your site. If the CAMPER elects to make payments they are due as follows: January 15, 2022 $550.00 - February 15, 2022 $550.00 - March 15, 2022, $550.00; entire final payment of $566.40 must be made no later than April 1, 2022. A $25.00 late charge per month will be applied to any late payment. If the entire amount of the agreement is paid in full by November 1, 2022 you will receive a $50.00 gift certificate to Champions Riverside CAMPGROUND mailed back with your signed agreement. If you choose to use a credit card, you will be assessed an additional $100.00. Any relocation of your site for 2022 site is subject to a $200.00 relocation charge.

Electricity: An additional meter deposit for each site of $100 is required for (new CAMPERS) which will be refunded upon the CAMPERS departure, minus monies owed. This is due at the time of the seasonal agreement signing. Each camping unit is to be plugged into its own electric box and CAMPER’S CAMPSITE. There is an amenity fee for the electric usage. Electric bills will be read on July 1st and October 31st. All bills must be paid by the due date mentioned on said invoices. If CAMPER’s utility bill is delinquent, in addition to other remedies, CAMPGROUND may disconnect the utilities to the CAMPSITE. CAMPER shall pay a reconnect charge to CAMPGROUND of $25.00. Any sale or early removal of camping unit will immediately void the CAMPER’s agreement with no refunds or pro-rations. Each CAMPER may put a lock on their individual electricity if they wish. No generators of any kind are allowed.

Wastewater:

Wisconsin State Law prohibits the dumping of sewage tanks or grey water tanks anywhere on the grounds except at the designated dump station.

Personal Property Taxes:

CAMPER shall pay all personal property taxes levied against CAMPER’s personal property located upon said CAMPSITE if applicable. CAMPER shall provide to CAMPGROUND evidence of payment of said tax upon demand by CAMPGROUND.

Insurance:

CAMPER shall maintain public liability, fire, wind and other hazard insurances upon their personal property situated upon said CAMPSITE and for their acts or omissions occurring while occupying said CAMPSITE in amounts acceptable to CAMPGROUND, said acceptance not to be unreasonably withheld. Within ten (10) days of written demand by CAMPGROUND, CAMPER shall provide evidence to CAMPGROUND of said insurance being in full force and effect.

Indemnity:

Reimbursement to Campground for Losses Caused by CAMPER. In the event that any action or omission of the CAMPER or GUESTS or the CAMPER cause the Campground to pay damages to any other person or party, to incur repair, cleaning, security or law enforcement expenses, the CAMPER shall reimburse the Campground for those damages, as well as any attorney’s fees and expenses incurred by the Campground.

Fire Rings & Picnic Tables: These are not furnished by the campground.

ADDENDUM - RULES RE: SEASONAL CAMPSITE AGREEMENT

1. Rules of the campground: CAMPGROUND owner may make such reasonable “Rules” governing the Campground and use of the CAMPSITE as CAMPGROUND owner deems necessary from time to time. A copy of the rules shall be available and the CAMPER agrees to observe and comply with all such rules.

2. Minor children (under the age of 21) are prohibited from occupying said CAMPSITE without their parent or legal guardian present. Minor children shall be restricted to CAMPSITE at 11:00 p.m. and prohibited from being off CAMPSITE after that time without any occupying adult. Under age children may not be left unsupervised on the property. Parent or legal guardians are responsible for the whereabouts, actions and safety of their children.

3. Prior to CAMPER operating a golf cart on CAMPGROUND property, CAMPER must obtain from CAMPGROUND for said golf cart a sticker and furnish to CAMPGROUND proof of insurance. Proof of insurance shall be furnished annually. The sticker must be obtained annually. No golf carts may be operated after dusk unless the same are equipped with adequate lights. Only licensed drivers shall operate said golf cart. Operation of golf carts is limited to the developed roads upon said campground and they shall be operated at speeds not to exceed 5 mph. During Quiet Hours, golf cart usage is limited to destination driving only, no ‘cruising or parading’ around the campground is allowed from 11:00 p.m. until 8 a.m. Speed limits must be obeyed. Drinking laws are enforced! We reserve the right to take golf cart keys of drivers who we deem should not be driving. Golf carts must be properly maintained at all times. Violations of these rules will result in fines up to and including removal from the park. Registration stickers are $20.00 annually and due prior to April 1, 2022. Should you choose not to get a sticker you will be asked to remove your vehicle from the campground.

4. Prior to CAMPER operating an ATV on CAMPGROUND property, CAMPER must obtain from CAMPGROUND for said ATV, a sticker, and furnish to CAMPGROUND proof of insurance. Proof of insurance shall be furnished annually. The sticker must be obtained annually. No ATV’s may be operated after dusk unless the same are equipped with adequate lights. ATV’s should only be used to travel specified trails and to drive to and from the River frontage. Only licensed drivers shall operate said ATV. Operation of ATV’s is limited to the developed roads upon said campground and they shall be operated at speeds not to exceed 5 mph. ATV’s are not allowed after 11:00 pm and before 8:00 am due to quiet hours. ATV’s must be properly maintained at all times. Violations of these rules will result in fines up to and including removal from the park. Speed limits must be obeyed Registration stickers are $20.00 annually and due prior to April 1, 2022.

5. Safety is the facilities #1 priority. Please recognize that recreation vehicles must be registered with your site number. You are responsible for your vehicles at all times.

6. All vehicles must follow the campground speed limit. Insurance must be carried on all vehicles at all times. If driving at dusk, lights must be installed as part of the vehicle.

7. CAMPER shall park all vehicles used by CAMPER or its GUESTS on CAMPER’s own CAMPSITE or in areas designated by CAMPGROUND. If any vehicles are parked in areas off CAMPER’s site which are not designated by CAMPGROUND, CAMPGROUND’s daily camping fee is due and payable by CAMPER on a per vehicle basis. Any vehicle other than CAMPER’s unit which is parked in one location for a period in excess of 10 days will be towed at the expense of vehicle’s owner.

8. Site numbers must be displayed on the front of the unit so that any emergency service can locate your unit and site.

9. To enable all to peacefully and quietly enjoy the CAMPGROUND, all campfires must be out by 1:00 a.m. Quiet time commences at 11:00 p.m. and continues to 8:00 a.m. the next day. Fireworks and fire arms are prohibited at all times.

10. All GUESTS of Seasonals CAMPERS must register either in the CAMPGROUND Office, or by the “Seasonal” section on the CampersApp.

All GUESTS MUST have a wristband to be in the park. This can be a no-charge wristband from the Seasonal CAMPER’S personal supply given to them at the beginning of the camping season, or purchased in the CAMPGROUND Office for $10 each. No exceptions.

12. All GUESTS must purchase a $5 parking pass and must park only on the Seasonal CAMPER’s site they are a GUEST of. Additional parking is available in the CAMPGROUND’s Bar & Grill parking lot designated area.  

13. All parties that are planned at the CAMPGROUND must be preapproved by management at least two weeks prior to the event.

14. No loud music or large gatherings can occur at a CAMPSITE. These types of events must happen under the pavilion and be approved by management. 

15. All pets shall be leashed at all times. Said pets are neither to create a disturbance nor be allowed to be a threat to other persons using CAMPGROUND. CAMPER shall not permit pets to be left unattended at said CAMPSITE. Excessive barking, failure of the CAMPER to keep their pet leashed when outside the camping unit, or leaving the pet unattended will give CAMPGROUND Owner cause to require the pet to be removed from the property. CAMPER must clean-up after their pets. Restricted pets: Rottweiler, or Pit Bull. Any mix of any of these breeds should be noted on the agreement.

16. CAMPER specifically acknowledges that CAMPGROUND does not maintain a lifeguard on duty at either CAMPGROUND’s pool, or water ways. On behalf of CAMPER and their children, GUESTS and any other persons associated with CAMPER, CAMPER assumes full responsibility for their safety while using the pool or river.

17. CAMPSITE is designed for one unit only. With prior CAMPGROUND management consent, an additional tent may be permitted for no longer than three consecutive nights at a rate of $15 (plus tax) per night, to be paid in advance. If said additional unit is not registered prior to set-up, the full water and electric rate for up to three nights will be charged.

18. CAMPER may not store more than one boat on CAMPSITE during the camping season. No additional boats, motors or additional CAMPERS may be left on the CAMPSITE from October 15 through April 15.

19. Wood: May not be brought into the facility from outside Trempealeau County per the Department of Natural Resources and the State of Wisconsin. No nail embedded wood, pallets or construction debris is allowed.

20. CAMPERS are not allowed to conduct business of any kind without written consent from CAMPGROUND owners.

21. Vandalism, disturbances, etc will be grounds for immediate and permanent removal from the park.

22. All GUESTS should know the unit number and the name of the person they are visiting.

23. In the event the CAMPER fails to keep the site properly maintained, CAMPGROUND may give Seasonal CAMPER notice of the deficiency and reasonable time to fulfill Seasonal CAMPER’s obligations. If such maintenance is not performed within the timeframe, a fine of $25 to $100 per incident can be established. This includes rubbish, trash removal and lawn maintenance.

24. Pump out Services: Honey wagon services are provided at posted rates per pump out, and shall be paid to the CAMPGROUND in advance. All “honey wagon” requests must be received by 6pm on Sunday in the CampersApp for posted service. If request is received late, it shall be deemed a special request and there will be a $30 Emergency Pump fee. Prior to pump out, CAMPER shall inspect and warrant that all valves, drains, hoses, transfer tanks, etc on camping unit are in proper working order. If the same are not in proper order, CAMPGROUND shall have the right to refuse to pump out camping unit until all necessary repairs are made and CAMPER notifies the CAMPGROUND of the same. The CAMPGROUND assumes no responsibility for the condition of the transfer tank on any camping unit or for any damage caused by or arising due to said pumping.

25. Exterior Transfer Tanks: All seasonal CAMPERS are encouraged to purchase 300 gallon transfer tanks at $475.00 installed. The CAMPGROUND may purchase the tank upon termination of your agreement for 70% of purchased price based on age & condition. All seasonal CAMPERS who purchase transfer tanks will be pumped out at a $15/pump fee. CAMPER shall cause all gray water and sewage to be contained in CAMPER’s unit maintained in an approved above-ground holding tank. Below-ground holding tanks are specifically, without limitation, prohibited. Pumping services must be signed up for weekly, at the CAMPGROUND Bar & Grill or preferably on the app.

26. Prior to entering the facility, all GUESTS and visitors must register at the office or in the general store. GUESTS will obtain their wrist bands from the seasonal. All wristbands must be secured on the GUEST. Loose bands will be taken and must be reissued by the seasonal. Anyone without a car pass may be subject to a $5 vehicle fee. Please register your personal boats or other vehicles to your site.

27. Fireworks, sparklers, floating lanterns, firearms and weapons of all kinds are prohibited at all times.

28. Children under the age of 14 must be accompanied by an adult at the pool. Camper specifically acknowledges rules posted at the pool. The Campground does not maintain a lifeguard on duty at the pool. Toddlers must use swim pants and diapers are not allowed in pool.

29. When disposing of garbage, it is to be transported in plastic garbage bags and places in our dumpsters. Dumpsters are also available for recyclables; please flatten all cardboard. Trash other than household garbage must be taken home (i.e. broken appliances, lawn chairs, grills, etc.), or there will be a $200 fine.

30. Please note that from time to time celebrity GUESTS will be at the campground either enjoying the property or raising money for their foundations. CAMPERS must obey all foundation rules and please respect their privacy.

31. You & your GUESTS agree photos, video, and other media taken during stay may be used in promotional pieces.

SEX OFFENDER POLICY FOR WISCONSIN CAMPGROUNDS

Wisconsin campgrounds lodging, not residences under Wisconsin’s public accommodation law, Wis. Stats. sec. 106.52 (1)(d) 4. The state rules which govern the operation of campgrounds indicates that campgrounds are places which provide “temporary overnight sleeping accommodation,” ATCP 79.03 (3). The rules state that campsites may not be occupied by the same individual for more than 8 consecutive months in any 12 month period, ATCP 79.11 (1).

Wisconsin’s public accommodations law does not protect individuals based on their arrest or conviction record. Campgrounds are permitted to exclude potential guests who are inappropriate for the campground.

Our Campground has determined that it cannot provide the level of supervision, security screening and monitoring which would be required to provide accommodations to sex offenders while protecting other campers and guests, particularly children. It is the policy of the Campground that no individual who is required to register as a sex offender by Wis. Stats. section 301.45 (1g) may be a camper, guest or visitor at the Campground.

The Campground will use reasonable efforts to determine whether persons seeking to be campers or guests are registered sex offenders. This policy, however, cannot guarantee that every person who has some history of sex offenses will be excluded. Campers are responsible for their own safety and supervision of their children.

Any person who is alleged to have engaged in any inappropriate sexual or sexual harassing conduct toward others will be immediately removed while the allegations are investigated. The Campground may exclude any person based on a determination that their continued presence is not in the best interests of the Campground or its guests.
