Inventory and refiners?

It seems odd that when gasoline inventory is down, wholesale gasoline prices increase! When refiner output is down, wholesale gasoline prices increase! When inventory and refiner out-put is up; prices decrease. The oil companies control both the gasoline inventory and the output of the refiners? The wholesale gasoline price changed 20 times in September.

U.S. Summer Gasoline Demand Falls to Eight-Year Low

NATIONAL REPORT -- Even in the height of vacation season, U.S. drivers didn't go as far this summer, with high fuel prices causing gasoline demand to fall to the lowest level since 2003, according to a Reuters report.

Data provided by U.S. Energy Information Administration (EIA) showed that drivers pumped an average of 9.17 million barrels of fuel per day from the first week of June to the first week of September, with summer-long demand falling 1.8 percent from 2010, according to Reuters calculations based on four-week average consumption over the 14 weeks of summer.

Rising fuel prices from February to May culminated in an average price of $3.62 for a gallon of gas this summer, $1 higher than 2010, according to EIA data.

June gasoline demand was the highest in two years, thanks to prices falling from their May highs, but fuel prices rose again in July, and the following month saw the lowest August gasoline demand since 2001.

EIA data also showed a 1.94-million-barrel build in gasoline stocks last week against forecasts for a 500,000-barrel drawdown, according to the report. Following the release of the data, U.S. gasoline futures fell more than 2 percent to a five-week low.

Exxon Mobil spent $3.81M on lobbying in 2Q

WASHINGTON -- Exxon Mobil Corp. spent $3.81 million in the second quarter to lobby the federal government on offshore oil drilling and other issues, according to a disclosure report.

That's up from the $2.52 million that the oil giant spent in the same period a year ago and the $3.01 million it spent in the first three months of the year. The Irving, Texas Company also lobbied the federal government on legislation involving regulation of air and water quality, toxic substances, greenhouse gases, cyber security and new drilling techniques, according to the report filed on July 20.

Since the BP oil spill in 2010, Exxon has led an industry effort to build a response network of drill ships and emergency equipment that can respond to another blowout in the Gulf of Mexico. The government lifted its moratorium on deepwater drilling this year in part because of new security measures like that.

Exxon hasn't traditionally been one of the major players in Gulf of Mexico drilling, but in June the company said it tapped a series of oil deposits in the gulf that could be one of the largest discoveries in years. Its exploration project 250 miles southwest of New Orleans could yield as much as 700 million barrels of recoverable oil and gas equivalent.

In the April-to-June period, Exxon Mobil lobbied Congress, the departments of the interior, state, defense, treasury, education, commerce, the Bureau of Land Management, the Council on Environmental Quality, the Environmental Protection Agency, the Office of Management & Budget, the U.S. Forest Service, according to the report filed in July with the House clerk's office.

Gas Thief Caught In Siphoning Act

SEPTEMBER --Driving a minivan outfitted with a generator-powered vacuum system, a Florida man yesterday surreptitiously siphoned 250 gallons of gasoline from a Citgo outlet before the station’s owner became suspicious and called cops.

When Broward County sheriff’s deputies arrived at the Oakland Park gas station, they arrested Yoenis Cristo Banos, 28, on a felony grand theft charge. A search of Banos’s Dodge Grand Caravan revealed that the vehicle’s rear seats were removed and replaced with three huge plastic tanks and a generator used to power the illegal siphoning system. One of the plastic drums held 255 gallons of diesel fuel, valued at $1019.75, according to a sheriff's report.

Allegedly parked the van above a compartment leading to the underground vaults storing the Citgo station’s fuel supplies. He then somehow dropped hoses into the reservoir and began sucking up the diesel fuel into the van’s plastic tanks.

When Broward County Sheriff’s Office deputies discovered the large amount of gasoline inside the van, a hazardous materials team was called to the station to remove the diesel fuel.

After being booked on the grand theft charge, Banos was freed from custody after posting $1000 bond. It is unclear what the unemployed Hialeah resident planned to do with the stolen gas.

Be vigilant and if you suspect something looks suspicious (a van or a trailer parked over your storage tanks), call police and copy the vehicles tag number. Florida has had many cases of stealing gasoline from gasoline stations while the station was open.

Chevron Reaches Proposed Settlement With California AG Over USTs

Would require oil co. to maintain compliance, training program, monitoring database, more

SACRAMENTO, Calif. -- California Attorney General Kamala D. Harris has announced the filing of a proposed $24.5 million settlement with Chevron U.S.A. Inc. and Chevron Stations Inc. The proposed settlement will resolve law enforcement allegations that the companies violated state laws governing hazardous materials and hazardous waste by failing to properly inspect and maintain underground tanks (USTs) used to store gasoline for retail sale.

A statewide investigation found violations of hazardous materials and hazardous waste laws and regulations at 650 gas stations in 32 counties across the state.

The parties have agreed to resolve the matter, and have submitted to Alameda County Superior Court a proposed final judgment that would impose a permanent injunction on the defendants. The hearing on the motion for judicial approval of the settlement is scheduled for September 29.

If approved by the court, the settlement would require Chevron to maintain a statewide compliance program, which includes a training program for employees and a database to track how USTs are monitored, among other requirements.

"There must be accountability and consequences when the environment is compromised and innocent people are potentially exposed to hazardous materials that could endanger their health," Harris said. "This settlement accomplishes both, and will protect Californians by mandating a compliance program for Chevron's underground storage tanks."

Chevron spokesperson Sean Come told EMoney Daily, "We have taken the appropriate actions to address the situations related to this issue and will work to avoid similar occurrences in the future. To fully understand the situation, it is important to note the majority of the incidents were technical violations, such as improper paperwork. None of the violations involved any risk to human health or the environment."

Proposed Bill Would Roll Back Florida Ethanol Requirements

FORT WALTON BEACH, Fla. -- Florida State Rep. Matt Gaetz (R-Fort Walton Beach) proposed a bill last month that would repeal the Florida Renewable Fuel Standard Act, according to a Northwest Florida Daily News Report.

The law, which went into effect Dec. 31, 2010, requires all gasoline sold or offered for sale in Florida by a terminal supplier, importer, blender or wholesaler contain nine to 10 percent agriculturally-derived denatured ethanol fuel by volume. There is a list of fuel sold or used for specific purposes that is exempted from the law, according to the report.

Gaetz claims that the act "has really had some negative consequences." His bill, HB 4013, would go into effect July 1, 2012 if voted into law.

Visa Boosts Prepaid Interchange Rates 

The new interchange schedule takes effect October 1, and the biggest increase in the Visa-branded prepaid categories is for automated fuel dispenser transactions.

GLEN ELLYN, IL – On October 1, Visa’s interchange schedule is set to take effect on October 1, the day new federal debit card interchange price controls also become effective, reports .

The card company is also planning to cut a few rates “for non-regulated debit issuers but clearly encourages issuers to pump out more prepaid cards. Visa also is eliminating volume-based tiers for supermarkets and retailers on its signature debit cards and Interlink PIN-based debit cards.”

The news source writes that Visa’s new schedule adjusts rates in 19 interchange categories for Visa-branded prepaid cards, with most of them increasing. The basic retail rate, for example, will go from 0.95% plus 20 cents to 1.15% plus 15 cents. On a typical $38 debit card sale, that rate will generate 5% more in interchange: 59 cents versus 56 cents under current rates.

“The biggest increase in the Visa-branded prepaid categories is for automated fuel dispenser transactions, where the rate will go from 0.75% plus 17 cents, with a 95-cent cap, to 1.15% plus 15 cents, with the cap remaining. On a $50 fill-up, the merchant will pay 73 cents versus 55 cents currently, an increase of 33%,” reports the news source, adding that service-station prepaid transactions will boost interchange by 29% on a $38 sale.

Visa is also raising interchange rates for small transactions. “The Visa-branded signature and prepaid small-ticket rates will go from 1.55% of the sale plus 4 cents to 1.6% plus 5 cents, which means a 15% increase on a $2 sale and a 9% increase on the $8 sale typical in fast-food restaurants,” writes the news source.

Gas Spending Nears Record Level

LOS ANGELES -- Anyone with a car has suffered from sticker shock when pulling up to the gas pump this year, so it should be no surprise that U.S. drivers could spend a record $491 billion for gasoline this year.

"The 30 days between now and mid-October will be the most hospitable days in the country for dropping prices," said Tom Kloza, chief oil analyst for the Oil Price Information Service (OPIS), who came up with the $491 billion estimate. "But then, the drumbeats will start about fears of a second Arab Spring [of political unrest]. Demand outside of Europe and the U.S. continues to rise. By spring, Americans will be wrestling with $4 gasoline in a lot of markets."

As the newspaper reported, the average price is noticeably below the all-time high set in 2008 when it cost drivers $4.114 a gallon to fill up their tanks. However, overall, drivers have spent more for fuel this year than three years ago because prices have risen faster in 2011 and stayed high longer.

Energy Department statistics show that gasoline demand in the United States is running 157,000 barrels a day below 2010 levels. At the same time, gasoline stocks in the country are down 16.3 million barrels below last year, at 208.8 million barrels, even though refinery outputs are high.

Rising inventories in periods of weak demand are one of the things that drive retail prices lower, but the refined fuels aren't staying here; they are going overseas, the newspaper noted.

"We do know that there have been more sales overseas this year compared to previous years," said Gregg Laskoski, a senior petroleum analyst for . "That has been most evident in the Midwest. When we look at the BP Whiting refinery in Indiana, which is one of the largest in the country, you see the output is strong, yet we are still seeing a lot of high prices in the markets this refinery is serving.

"It's troubling for consumers to try to reconcile the high price they see at the pump when the seemingly local refineries that served them in the past are now outsourcing more of their products overseas," he added.

Is Big Oil Losing its Drawing Power?

For many, many years the power of the Big Oil brands was indisputable. They owned the refineries, the stations and the credit card networks to boot. In the days of the mid-70s and early 80s, gasoline cards were a status symbol.

But the times have changed. Big Oil gas cards have given way to incentivized Visa and MasterCard credit cards. This transition has eroded the loyalty, an entire generation of consumers had for its locally branded service stations. In fact, while customers gravitate toward the credit card rewards programs, oil companies are getting the double whammy. As customers look to earn rewards they are using cash less and charging more. Estimates are that more than 80% of fuel transactions are done via credit cards, which is having a negative impact on fuel margins and profits. The card companies then charge the merchants to fund the rewards programs. It’s a vicious cycle with the card companies always coming out on top. But that’s an entirely different story.

The bigger question that needs to be asked is; what is the real value of a Big Oil fuel brand these days?

Determining Brand Equity:

Clearly, in Altoona, Pa. Sheetz has established a go-to brand that is spreading to new Southern markets. Similarly, Wawa, as reported, acquired a dozen properties in the Orlando-Tampa, Fla. markets. They seem pretty confident as well that they can win over customers when competing head-to-head with the big fuel brands.

The same can be said about the large regional players with a booming fuel business: RaceTrac, QuikTrip, Maverik, Kwik Trip, EZ Mart and many others. This is hardly limited to larger chains. Companies with less than 100 stores are also thriving in head-to-head competition with Big Oil something that was unfathomable just a decade ago.

Nice N Easy, Family Express and MotoMart are just a few of the chains with a strong proprietary fuel offering. It’s also hard to envision a highway without a Big Oil brand, but it certainly looks like private brands own the local roads, and the trend is rapidly expanding in all regions of the country. Can Big Oil regain some of its luster?

What’s Up With Coffee Prices? 

Much like the oil market, speculators are likely a driving force behind high coffee prices.

WASHINGTON – When gas prices go up, it’s because oil is trading high on Wall Street. And “these same big financial investors” are boosting the price of coffee, the Baltimore Sun reports.

“Grocery shoppers have seen whopping increases this year in the price of a can of ordinary coffee, whether it's a generic store brand or better-known ones such as Folgers and Maxwell House. Since spring, coffee has been selling at $7 to $8 a can in many parts of the country, or about twice the price of a gallon of gas,” writes the news source, adding that the retail price of coffee in July was up 20.7 percent over the same month last year, according to the Bureau of Labor Statistics.

So what gives? According to coffee industry leaders at last week’s National Coffee Association conference in Washington, financial speculators are at fault, “taking advantage of global supply hiccups to drive up coffee prices by adding volatility to the trading of contracts for future delivery of coffee. It's not as debilitating to family income as high crude oil prices, but the phenomenon is the same,” writes the newspaper.

According to experts, hiccups in production and higher global demand justify higher prices, but perhaps not this high. The newspaper notes that the price of a futures contract for 37,500 pounds of coffee increased by more than 40 percent in 2010, and has risen by more than 57 percent this year through August 19.

"It's not a true coffee market anymore, where the laws of supply and demand hold forth," said Danell Seda, a trader for Walker Coffee Trading in Houston. The National Coffee Association, meanwhile, has no definitive conclusion about current, volatile coffee prices.

"Some people think the hedge funds are more to blame; others think its supply and demand or the weather," said NCA spokesman Joe DeRupo. "Everyone has their own hypothesis."

A Commodity Futures Trading Commission official, who anonymously spoke to the newspaper, acknowledged that the agency hasn’t been able to determine how much of the coffee futures trading is being done by speculators. “There is no denying that there are more different players entering the market. There's debate in public, and perhaps on the commission, on the cause and effect,” the official said. What industry is next?

Florida Town Considers Mandatory Classes for Retailers on Illegal Consumption 

The mayor of Pembroke Pines wants convenience store clerks, bartenders and restaurant workers to take a mandatory class on the dangers of underage drinking.

PEMBROKE PINES, Fla. – The mayor of Pembroke Pines wants to stop underage drinking by training the front-line employees who could potentially sell alcohol to minors, The Star reports.

Mayor Frank Ortis is pushing an ordinance that would require any retailer selling alcohol between 11 pm and 3 am or 4 am to have its workers take a class about the dangers of underage drinking.

“We’ve learned there is a lot of underage drinking going on in the hours of 11 pm. until 3 or 4 am,” said Ortis. “If a convenience store, gas station or restaurant is open until 4 am, we want to educate their employees on the consequences of underage drinking.”

Employees completing the course will receive a certificate. The class will cover how to decipher fake ID cards. Retailers participating in the course will have the option of selling alcohol for longer hours, such as beginning sales at 11 am, and extending the cut off time of 3 am for stores and 4 am for bars and clubs.

While Ortis said he doesn’t have statistics on how many minors in Pembroke Pines drink, he thinks enough teens do it to justify the change. Ortis wants input from area businesses before taking the proposal to the town council.

Oakland Park, Fla., approved a similar measure three years ago, which lowered the incidences of selling alcohol to minors from 90 percent to 60 percent, according to the Florida Division of Alcoholic Beverages and Tobacco.

Florida Community Halts C-store Builds

WEST PALM BEACH, Fla. -- Leaders in this Florida town are putting any decisions on new convenience stores in certain areas of the community on the back burner for three months.

The West Palm Beach commissioners recently voted to place three-month moratorium on new convenience stores in the Clematis waterfront district and the Northwest neighborhood district, which includes Tamarind Avenue, according to the South Florida Sun-. The move follows the commissioners' decision to implement a one-year moratorium for new nightclubs in the same area. The decisions are taking aim at establishments that sell liquor.

"We don't want people selling individual beer and people walking around Clematis," Mayor Jeri Muoio said at a recent commission workshop.

However, at least one elected official is raising doubts about the plan. Commissioner Kimberly Mitchell questioned the proposal, saying there is already an open container law in West Palm Beach that forbids people from drinking beers in the street.

"I have not seen or heard this as a problem," Mitchell said. "I'm not sure what problem we're trying to cure."

But, as the news outlet reported, Raphael Clemente, the interim Downtown Development Authority director, said that people shouldn't be able to buy beer at convenience stores late at night.

"What happens when people leave clubs and can go to convenience stores or some other type of establishment, buy a six-pack or a single can at 2 a.m.?" Clemente said. "We're allowing the problem to go from one place to another -- a roving alcohol source."

And while Commissioner Ike Robinson hailed the decision to include the Tamarind corridor in the proposal, the paper said he the overall purpose of the moratorium. "If I'm not mistaken, convenience stores have regulations on the books already that curtail being open 24 hours a day," Robinson said. "If they are open past 12, there's something in the state regulation that says they have to have a bulletproof cage."

The commission agreed to the three-month moratorium, while city staff studies the issue.

Amazon Delivery Trial Begins at 7-Eleven

SEATTLE -- Amazon's in-store pick-up system will likely begin its trial at select 7-Eleven store by the end of this week, according to a GeekWire report.

The system, which has not been officially confirmed by Amazon, allows customers to use computerized lockers at 7-Eleven stores as temporary P.O. boxes. When packages arrive, customers will receive an e-mail with a bar code that can be printed or scanned from their phones at the store to reveal a PIN, which they will then use to open the locker and retrieve their package, according to the report.

If the trial is successful, a nationwide roll-out could give an edge to Amazon, which previously lacked any form of in-store pickup. Competing retailers with both online and brick-and-mortar stores, such as Best Buy, already offer customers the option of picking up their online orders at their local stores.

A clerk at the 1522 East Madison Street 7-Eleven in Seattle told GeekWire that the store plans to activate the lockers as soon as Friday, Sept. 9. The 40 lockers at that location come in a variety of sizes with a keypad and monitor at the center of the unit.

DOJ – Americans with Disabilities Act

ISSUE: New ADA Requirements for ATMs

ATM machines to make them more accessible to persons with disabilities. The new requirements include speech output,

Braille instructions, tactile input controls and display screens and operator privacy controls. The new ATM upgrades must be in place by May 15, 2012. The ATM requirements are not subject to the ADA safe harbor provision but marketers may forgo compliance if they can demonstrate that the upgrade would result in an undue economic burden.

DEPARTMENT OF JUSTICE ISSUES NEW ADA REQUIREMENTS FOR ATMs.

A final rule issued by the U.S. Department of Justice pursuant to the Americans with Disabilities Act (ADA) adds specific

technical requirements to ATMs for speech output, privacy, tactilely-discernible input controls, display screens, and Braille

instructions to the general accessibility requirements set out in the 1991 Standards. The 1991 Standards require ATMs to be accessible to and independently usable by persons with visual impairments, but do not contain any technical specifications. The new 2010 Standard spells out the new technical specifications for ATMs that must be followed.

The deadline for compliance with the new ADA requirements for ATMs is March 15, 2012. However, the new ATM

requirements will not apply to any business owner who can demonstrate that compliance would cause an undue burden which imposes a significant difficulty or expense.

Adopted guidelines: The 2010 Standards adopted the following elements for ATMs:

Clear Floor or Ground Space. Clear floor space or ground space complying with section 305 of the ADA and ABA

Accessibility Guidelines for Buildings and Facilities must be provided. This is not required at drive-up only ATMs.

Operable Parts. Operable parts must comply with section 309 of the ADA and ABA Accessibility Guidelines for

Buildings and Facilities, and each operable part must be able to be differentiated by sound or touch without activation.

This is not required at drive-up only ATMs.

Privacy. ATMs must provide the same degree of privacy input and output to all individuals.

Speech Output. ATMs must be speech enabled. All displayed information and additional ATM functions (e.g.

dispensing coupons or providing monthly statement copies) must be accessible to and independently usable by

individuals with vision impairments. Speech can be recorded or synthesized.

Audible tones may be permitted instead of speech for security purposes, such as asterisks representing

personal identification numbers (PINS);

Advertisements and other similar information shall not be required to be audible unless they convey

information that can be used in the transaction being conducted;

Where speech synthesis cannot be supported, dynamic alphabetic output shall not be required to be

audible;

Speech shall be capable of being repeated or interrupted; and where receipts are provided, speech output devices shall provide audible balance inquiry information, error messages, and all other information on the printed receipt necessary to complete or verify the transaction

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News Service

The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.

FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites. Subscribers will receive e-mails from the

Financial Crimes Enforcement Network at the address fincenupdates@.
