The evaluations from the programs offered to date are found in the board materials on the tablets that will be at the board meeting, as well as a list of the courses offered. They are shown so that they can be compared to similar programs offered in FY 05, FY 06, FY 07, FY 08, FY 09, FY 10, FY 11, and FY 12.

A grant adjustment was submitted to the Court of Criminal Appeals in May and the second Waco June clerks program and Austin August court interpreter program was approved. It was approved. A planning meeting was held in Dallas on June 28, 2013 to plan the pre-certification orientation (Hope Lochridge, Bonnie Goldstein, Mike Acuna, Janie Moreno, and Regan Metteauer).

FY 13 Personnel Report

Patty Thamez has returned to TMCEC as the Program Assistant II. There are two vacancies: The part-time Administrative Assistant (accounting) and the Communications Assistant. Both are posted.

TxDOT Grants:

FY 13 Programs:

MTSI program components: Awards; 100 bailiffs/warrant officers; 800 clerks/bailiffs; 1200 judges (awareness); 1000 judges (training); 100 prosecutors; 75 magistrates; 15 pages in The Recorder; Traffic Safety Conference; 10 pages or links on website and 24 exhibits at TMCEC and related programs, such as TML.

• Brenna McGee continues to work at TMCEC as the TxDOT Grant Administrator (began in early December).

• 24 awards were presented on April 3rd at the Traffic Safety Conference.

• The magistrate conference offered as a clinic on July 10th in Austin - @86 attended!

• The DRSR PSA contest had more participation this year.

DRSR program components: Lending library of videos/DVDs for courts & schools; disseminate DRSR materials to community/civic groups like Boy Scout troops (25 kits); 24 exhibits at teacher trainings and TMCEC programs; session at LRE Conference; revise materials as needed; train 600 clerks; train 600 judges; train 250 teachers; 8 pages in The Recorder; and 2 storybooks in English & Spanish.

FY 14 TxDOT Grant Applications:

Applications were submitted to TxDOT on January 4, 2013 for the following amounts:

MTSI: @ $331,461 – preliminary approval received!

DRSR: @ $163,668 – preliminary approval received!

The proposed activities for FY 14 parallel FY 13 with teen court planning sessions added back into the proposal. Notification of funding is scheduled for July 2013.

Publications Update:

Staff members plan to produce four issues of The Recorder in FY 13 and would like ideas for articles from the Board or Education Committee.

Per board action in April, The Recorder is no longer being sent one copy per court, with the exception of the Legislative Update issue which will be sent one per court and one per judge. The Recorder is available online and is sent out to the list servs. Subscriptions are available for $35. TMCA sent complimentary copies to members in FY 13. A notice was added near the mailing label: The Recorder is available online at . This print version is paid for and mailed to you by TMCA as a membership benefit. Fiscal Report:

The under run of grant funds in FY 13 continues due to housing trends and enrollment patterns. The reasons for the “surplus” are:

• TxDOT grant approved for FY 13 and more funds reimbursed than expected in FY 12.

• Fewer housing requests by judges & clerks due to single room fee of $50.

• Savings from clerks’ program dropping to 12 hours.

• Fewer clerks enrolling due to 8-hour program.

• Staff raises never approved by Court.

The single room fee of $50 generated $144,250 in FY 12. In FY 13, the single room income is $139,950 (July 7, 2013). In addition, more judges and clerks did not request a room at all, resulting in additional savings. So not only was income generated, but funds were saved. As a result, at the end of the grant year, we had a surplus of a significant amount that will be carried forward to FY 13.

At the April board meeting, the Board approved the following new projects or services to offer in FY 13 that benefit the courts.

Administrative Expense

• Mobile Access to Website for Smart Phones & Tablets -$5,000

• Website Redesign - $20,000

• Speaker/Sound System – Training Area -$1,500

• Another Summer Intern - $5,000

• Internet Reporting - $4,000

• Dinner for New Judges/New Clerks Day of Arrival – $5,000

• Increase of Scholarships (2/$2,000 and 10/$2500) - $21,000 (under run)

Reminder: A new grant condition: 60 Days for Travel Claim Submissions.  Travel claims must be submitted to the grantee for processing within 60 days following the travel event.  Grantees are not allowed to process late submissions.  This includes the travel of participants, staff, faculty, board and committee, and any other class of traveler.

TMCEC accepts credit cards (VISA and MasterCard) via Wells Fargo Bank and the Product Account. Although there is a $33.00 monthly fee plus $0.30 per transaction and a 2.71% monthly discount rate, participants value the convenience. We accept registration fees by credit card, as well as purchases of publications. TMCEC now has a credit card swipe (like what Bob Richter uses for TMCA to process credit cards quickly at school for product sales).

Technical Assistance/Cooperative Training:

The 800-line continues to offer one-on-one information about the Center and assistance with locating laws and procedures relevant to municipal court practice. Clerks Certification Program:

The Municipal Court Clerks Certification Program is sponsored by TMCEC, TMCA, and the Texas Court Clerks Association. The Education Committee of TCCA serves in an oversight role over the rules of the program and provides test proctors. There are three levels of certification. Dates for FY 14 and 15: November 4-8, 2013 and November 3-7, 2014. Appreciation is expressed to Senator West, Judge Brian Holman, and Deanna Kuykendall for setting this up via a concurrent resolution in the House and Senate (SCR 21).

Also, October 1, 2013 is when Texas will participate in National Night Out. This is another excellent opportunity for courts to reach out to the public with TMCEC traffic safety materials.

FY 14 Grant

TMCEC submitted a request for $1,629,472 to the Texas Court of Criminal Appeals for funding for FY 13. It contained 1 percent cost of living raises. Later in the summer (July 15th) recommendations for increases in compensation will be submitted.

WHAT IS AND IS NOT REIMBURSABLE AND OTHER INFORMATION

1. AIR TRAVEL: Air travel will be on a coach/economy basis. TMCEC is

unable to reimburse for frequent flyer, rapid rewards, or other free or complimentary flight ticket. Agent fees or service fees on air travel are not reimbursable. Change or cancellation fees are not reimbursable unless due to unavoidable situations and/or emergencies and with the prior approval of the TMCEC Executive Director. TMCEC asks that tickets be purchased in advance to save funds.

2. AUTOMOBILE: Any auto rental must be approved by the TMCEC Executive Director or TMCA President prior to rental. Mileage is reimbursable only from the claimant’s designated headquarters to duty point.

3. MEALS: a. In order to claim meals, you must be away from your

home base for six hours.

b. Meals will not be reimbursed in excess of $36.00 per day.

c. No reimbursement for meals that are provided by TMCEC.

d. Expenses related to acquiring meals. The TMCEC Board’s policy on

telephone calls and/or taxis to acquire a meal are allowable expenses

as long as the total expense (meals + telephone + taxi) does not

exceed the state limit of $36 a day.

e. Receipts are not required, but actual cost of meal must be shown. For

4. LODGING: Lodging within Texas is at prevailing government rate. Out-of-state lodging is at that state’s or city’s prevailing rate of per diem. Government rates for rooms should always be requested. Reimbursement will be made for actual expenses of a single accommodation up to allowable rate. Supporting documentation is required for lodging.

5. TIPS: Tips are not considered service charges and are not reimbursable.

6. RECREATION: Entertainment expenses are not allowed.

7. TAXI FARES: Taxis are not to be used unless no other less expensive means of travel is

8. OTHER: TMCEC business-related phone calls, parking and tolls are examples of allowable miscellaneous items.
