Not guilty plea for Gillette student

GILLETTE (WNE) -- Dale Warner's voice grew fainter Friday afternoon as the eighthgrader pleaded not guilty to nine counts of attempted first-degree murder in Gillette.

The 14-year-old boy is accused of bringing two guns and 36 bullets to Sage Valley Junior High School with a plan to shoot nine teachers and students identified as people he wanted to target or who were in the classroom where he intended to shoot them Nov. 13.

He was later disarmed by the school principal and arrested by the Gillette Police Department.

Charged as an adult, Warner repeated "not guilty" nine times in his arraignment as District Court Judge Michael N. "Nick" Deegan asked him to plead to each of the nine counts.

Warner wore a lime-green Juvenile Detention Center outfit and was handcuffed throughout the proceeding, including when Deegan asked Warner to raise his right hand as high as he could to take his oath.

Warner smiled at his parents and family sitting in the front row of the courtroom as he was led into it by bailiffs at about 4:15 p.m. Friday.

It took just 15 minutes for Deegan to explain the charges, make sure Warner understood the charges and to ask for his pleas. Deegan said Jefferson Coombs of the Gillette Public Defender's Office and Diane M. Lozano, the state public defender representing Warner, and Campbell County Attorney Ron Wirthwein and Deputy County Attorney Nathan Henkes will meet with him later in a pre-trial conference. They'll schedule his trial at that time.

Deegan also continued Warner's cash-only bond of $275,000.

Legislature overrides two vetoes

CHEYENNE (WNE) -- The Legislature rejected two of Gov. Mark Gordon's 29 line-item vetoes from the state's supplemental budget Wednesday, but let much of what Gordon rejected stand as lawmakers worked late into the night Wednesday to finish up the session on time.

The House voted overwhelmingly to override four of Gordon's vetoes, but the Senate was only concerned with two of those decisions - a footnote that was essentially a technical correction included in the budget, and the elimination of two positions in the Wyoming

State Engineer's Office. Gordon had vetoed the

elimination of the two positions on the grounds the office had already eliminated one position by not filling a vacancy.

"I will not allow the State Engineer to use the empty position and plan to propose eliminating one position in the next budget," Gordon said in his letter to the Legislature. "I must, however, preserve the one filled position, otherwise there could be an unintended riff of an employee."

The other two vetoes from the House with which the Senate didn't concur dealt

with the Wyoming Business Council.

One earmarked $100,000 to promote state products and goods in Asian markets, and another withheld several hundred thousand dollars in funding to the Business Council until a report on economic development efforts was submitted to the Legislature by November.

The House's action to override those two vetoes was unable to gain even a majority of support in the Senate, let alone the two-thirds support necessary to sustain an override.

GILLETTE (WNE) -- A man from Rock Springs died after a head-on crash on Highway 59 south of Wright on Sunday afternoon.

Jesse Ray Wagner, 41, died at the scene the crash. The Wyoming Highway Patrol reports he wasn't wearing a seat belt at the time of the crash.

The crash happened at milepost 37 on Highway 59 south of Wright near Bill. It was a twovehicle accident and Wyoming Highway Patrol officers arrived on the scene around 5 p.m.

Sunday, according to the WHP. Wagner was driving a

2000 Ford Taurus and driving south on the highway when he entered the northbound lane. A driver in the other lane traveling north, 76-year-old William Krieger Neuharth, was driving a 2015 Dodge Ram.

Neuharth saw Wagner come into his lane and attempted to take "evasive action" to avoid Wagner, according to a press release from the Highway Patrol. However, Neuharth couldn't respond quickly

enough and the vehicles collided head on.

Neuharth was wearing his seat belt but was transported to the Memorial Hospital of Converse County for injuries he sustained in the crash.

Driver fatigue on the part of Wagner is being investigated as a contributing factor, according to the Highway Patrol.

Wagner is the 21st person to die on Wyoming's highways in 2019 compared to 11 by this time in 2018, 10 in 2017 and eight in 2016.

No extra money for towns this session

CASPER (WNE) -- The legislative session wrapped up last week, and local governments aren't walking away with the additional direct distribution money that officials were hoping for.

"Unfortunately, there was no additional direct distribution dollars provided by the Legislature in the supplemental budget," said Rick Kaysen, executive director for the Wyoming Association of Municipalities. The association advocates for local governments at the state and federal level.

Direct distribution is a

seemingly never-ending issue in Wyoming. The state does not grant cities or towns independent taxing authority, which leaves its municipalities largely dependent on direct distribution funding from the state.

Direct distribution money tends to wildly fluctuate: The state Legislature has doled out under $100 million in tight times -- or as much as $175 million when the economy is strong.

"It's very difficult to do long-term planning when there's uncertainty on whether the dollars will be there or not," Kaysen has said.

Last year's biannual budget included $105 million for direct distribution, but the association was hoping to secure more money this year.

"We asked for consideration of $25 million to be distributed among the 99 municipalities and 23 counties," said Kaysen. "But there was no consideration."

Attempts to give local governments more financial independence were also shot down.

"There were bills that came forward about local authority and taxation but none of those bills moved forward," Kaysen said.

Goshen County needs a new court clerk

TORRINGTON -- The Goshen County Republican Party will be forwarding a pair of candidates to the Goshen County Board of Commissioners for consideration to be the next Clerk of the Eighth Judicial District Court.

The position was vacated earlier this month by Kathi Rickard, who cited health concerns as her reason for resignation. Since her resignation, the Goshen County Attorney's Office issued a press release confirming an investigation by

the State of Wyoming into the records of the court clerk.

The process of selecting a new clerk begins with the Goshen County Republican Party. Interested candidates submitted their applications to the party for consideration. The party then refers the candidates to the county commission. According to Corey Steinmetz, chairman of the Goshen County Republicans, the process for nominating a new clerk isn't complicated on the party's end.

"The person leaving is a

Republican, and the Republican Party has the task of coming up with three names. What we do is we hold an interview process. Any Republican can apply," he said.

As of press time, the Wyoming Attorney General's Office did not respond to a request for comment on the investigation. Goshen County Commission Chairman Wally Wolski declined to comment on the investigation and referred inquiries to the Goshen County Attorney's Office.

Bill passed to avoid expulsion delays

RIVERTON (WNE) -- A bill addressing expulsion hearing timeline issues the Riverton school board experienced last year was signed into law Tuesday.

Senate File 120 requires that expulsion hearings take place within 10 business days after a lengthy suspension or expulsion is recommended ? unless the student and school board agree to an extension.

Sen. Eli Bebout, R-Riverton, sponsored the legislation after

speaking with a local school board member about the 2018 expulsion of three high school wrestlers. Those expulsion hearings took months to schedule due to a string of legal delays, according to published reports.

The proceedings finally were held mid-year, though the students had been suspended from school since January.

"That's not fair to the victim or the perpetrator," Bebout said this month.

When he introduced the bill last month on the Senate floor, Bebout said SF 120 brings "some finality" to the proceedings so they don't "go on and on like happened in Fremont County."

"This is the result of a bad situation that existed in my school district in Riverton," Bebout told his fellow legislators. "It was not a good situation for anybody. And as it went on and on and on you could see the tension building on both sides."
