TERMS OF REFERENCESMINISTRY OF COMMERCE AND INDUSTRYPosition Title: Business Planning and Policy AdvisorOffice: Ministry of Commerce & IndustryReport to: Director GeneralGrade: (to be entered)ObjectivesThe Business Policy and Planning Advisor position acts as ministry’s development liaison and advisor to the ministry's leadership focusing on formulating assessment studies for policies already in the books and spearheading new initiatives as per recommendations made in the OSS and ICT Capacity Assessment and to establish the Office of the Registrar (MoCI Business Registration department, which is important as it poses broad database that can utilized for generating information about businesses in country and ensure a focused planning and policies. The Advisor plans, develops, implements and administers business policy and planning initiatives; identifies and organizes priorities/activities related to BRS for the ministry and the Office of the Registrar in order to realize economic growth and sustainable development. This position is also responsible for review and development planning and policies of the ministry as well as ministry’s programs and associated projects to achieve strategic business goals and operational objectives.JOB DESCRIPTIONGeneral planning for the review of provisions of the official ministry’s policy and planning related to BRS to provide recommendation to the ministry amendments for policies already in the books while developing a roadmap for policies that need to be drafted. Review/revamp policies for implementation of the online Business Registration System (BRS) at MoCI as per the recommendations in the OSS and ICT Capacity Assessment with regard to the planning, resource mobilization and strategic engagement within FGS, FMS and the development partners.To review and provide advice to the Ministry of Commerce with regard to the full operationalization and enforcement of the Company Act 2019, implementing regulations under Company Act and proposed Business Licensing Law to ensure that all active businesses/enterprises/SMEs operating in Mogadishu gradually register through online Business Registration System (BRS).Advice MoCI and the Office of the Registrar to collect, maintain and analyze reliable and quality data on business registration generated through BRS and generate time reports on data analysis to MoCI management.To review policies related to BRS and institutional capacity building programs for the promotion of enterprises creation at regional and local levels; and implement recommendations in the OSS and ICT Capacity Assessment. Interact with senior officials in government, the business community and civil society to promote Public Private Dialogue in order to map gaps BRS and gain inclusive BRS and in turn provide useful and value adding recommendation to the ministry’s executiveEngage with the Federal Member States (FMS) Ministry of Commerce offices and the FMS municipalities and other relevant stakeholders to present the BRS, assess feasibility of BRS in selected FMS as well as potential linkages with municipalities, assess revenue sharing arrangement between FGS and FMS on the registration and other related fees/levies and support future roll out.Identify ways and provide recommendation for the long-term sustainability of maintenance and operations of the BRS by the MoCI beyond WB SCALED UP support. Promote communication and collaboration between various stakeholders in an effort to facilitate the implementation of the minister’s work plan. Develops clear goals that are consistent with agreed strategies, planning and policies that identify Ministry of Commerce and Industries’ priorities and coordination with development partners on the priorities. Required Skills and Qualifications: Candidate must poses Master’s degree in business administration or Commercial law or equivalent and at least 3 years’ experience in working with Somali commercial issues or a Bachelor’s degree with 5 years’ experience in a similar position.Good knowledge of institutional building, planning, policy formulation and knowledge of international trade business policies Conceptual and strategic planning, analytical capacity and ability to thoroughly analyse and evaluate critical mattersKnowledgeable about Somalia business laws, concessions laws and process and international business standards Knowledgeable industrial, internal trade, external trade and marketing policies and their implementation. Must have strong computer skills, including MS Office Suite as well as a good understanding of how technology can enhance government services. Strong leadership and persuasion skills with ability to work effectively in a teamAble to prioritize and work under the pressure of deadlinesAt least 1 years’ experience working in Somalia Fluency in written and spoken Somali and EnglishDeliverables:An inception report upon one month of commencement of the assignment that includes an action plan detailing summary of all start-up activities related to the Business Registration System (BRS) and the establishment of the Office of the Registrar, FMS and municipalities engagement plan and necessary meetings and coordination activities developed with the MoCI leadership Quarterly progress report with detailed description of activities performed related to Business Registration System (BRS) and results achieved as per the TOR and the work plan.A collaboration framework outlining the agreed roles, responsibility and approach for FGS-FMS-Municipality partnership in BRS implementation Draft polic(ie)s based as prioritized by the Ministry In-person monthly briefing to senior management of MOCI and the Office of the Registrar on the key functions as stated above related to the BRS. The briefing shall cover activities performed for the month and results achieved as per the TOR and the work plan as well as issues encountered, assessment of potential implementation risks and recommendations for mitigating these risks.Final Report and Recommendations Report: By the end of the assignment, the consultant shall provide a written report that provides detailed recommendations that will help to achieve full operationalization of planning and policy formulation. For each recommendation, the consultant should include detailed information regarding shortfalls that the planning and policy formulation initiative should seek to address, the desired outcomes it seeks to achieve, expected impacts and potential challenges regarding implementation, as well as corresponding mitigation strategies based on current conditions. ................
