ALTERNATIVES FOR STUDENTS RECEIVING CITATIONS ON CAMPUS

THE OPTIONS AVAILABLE TO STUDENTS UPON RECEIVING A CITATION ARE AS FOLLOWS:

I. PAY THE FINE:

Pay the fine imposed within 18 calendar days after issuance to avoid a $15.00 late charge per citation and the student’s records being placed on hold.

II. APPEAL THE CITATION:

Through the Traffic Office in the Academic Services Building, the student may appeal the citation to the regularly scheduled Student Traffic Court. Appeals must be made within 18 calendar days from the date of issuance of the citation. Anyone wishing to appeal a citation(s) after 18 calendar days must pay all fines and late fees prior to filing a request to appeal.

Two Ways To Appeal:

A. In-Court Appeal

Student appears in person before the Student Traffic Court and presents his/her case. If the student fails to appear at the scheduled in-court appearance, a decision will be made based on the initial paperwork submitted. All students appealing a moving violation citation must appear in person.

B. Written Appeal

Student presents a written appeal to the Student Traffic Court for their consideration. The Traffic Court will render a decision based only on the information given in this form.

POSSIBLE DECISIONS RENDERED BY THE COURT

1) Have citation dismissed on technical grounds

2) Found not guilty

3) Found guilty with full fine imposed

TRAFFIC COURT STUDENT RIGHTS

• You have the right to a court hearing

• You have the right to defend yourself

• You have the right to a Student Association Public Defender

• You have the right to appeal your case to the Dean of Students or Student Supreme Court if you feel that the Traffic Court’s verdict was unjust

Public defenders work with you in preparing your appeal by offering advice and counsel.  Once the appeal paperwork has been processed by the Traffic Department, you may either set up a meeting to speak with a public defender before your traffic court hearing or you may arrive 30 minutes early to your traffic court hearing in order to speak with a public defender. This is a free service. Public defenders can be reached at 747-7500 during office hours or by appointment at the Student Government Association office, 304 East Union.
