|(3) Rhaid i bawb sy’n mynychu adeg dilysu cyfrifon y papurau pleidleisio neu adeg cyfrif y pleidleisiau gynnal a chynorthwyo i|

|gynnal cyfrinachedd pleidleisio a rhaid iddynt beidio â – |

|(a) darganfod neu geisio darganfod wrth gyfrif y pleidleisiau y rhif neu unrhyw farc adnabod unigryw arall ar gefn unrhyw |

|bapur pleidleisio; |

|(b) cyfleu unrhyw wybodaeth a ddysgir wrth gyfrif y pleidleisiau ynghylch yr ymgeisydd y rhoddir unrhyw bleidlais iddo/iddi |

|mewn unrhyw bapur pleidleisio penodol. |

|(4) Ni chaiff neb sy’n mynychu adeg dilysu cyfrifon y papurau pleidleisio fynegi barn wrth neb am ganlyniad tebygol yr |

|etholiad ar sail yr wybodaeth a gafwyd adeg y dilysu. |

|(8) Bydd rhywun sy’n ymddwyn yn groes i’r erthygl hon yn agored, ar euogfarn ddiannod, i ddirwy nad yw’n uwch na lefel 5 ar y |

|raddfa safonol[1] neu i garchariad am gyfnod nad yw’n hwy na 6 mis. |

|(3) Every person attending at the verification of the ballot paper accounts or the counting of the votes must maintain and aid in |

|maintaining the secrecy of voting and must not: |

|ascertain or attempt to ascertain at the counting of the votes the number or other unique identifying mark on the back of any ballot |

|paper; |

| |

|communicate any information obtained at the counting of the votes as to the candidate for whom any vote is given on any particular ballot|

|paper. |

| |

|(4) No person attending at the verification of the ballot paper accounts may express to any person an opinion based on information |

|obtained at that verification as to the likely result of the election. |

|(8) A person who acts in contravention of this article is liable on summary conviction to a fine not exceeding level 5 on the standard |

|scale[2] or to imprisonment for a term not exceeding 6 months. |
