Homeowner Associations and the Law in Arizona

Arizona, like many areas of the country, has experienced a dramatic increase in the number of homeowner’s associations (HOA’s). Recently, HOA’s have been in the news and some of the commentary has been confusing. Condominium and planned community HOA’s are regulated by statutes that govern such matters as the penalties an HOA may impose, meeting and record requirements, liens and required disclosures on the resale of a home.

In most of these developments, restrictive covenants are recorded against the property (CC&R’s), which empower the HOA to control certain aspects of property use within the development, often including oversight and approval authority over the construction of new homes and alterations of existing ones. When a person buys a home in such a development, the person receives a copy of the CC&R’s and agrees to be bound by their terms. Thus, the CC&R’s form an enforceable contract between the homeowners as a whole and the individual homeowner.

Whether or not to live in a development governed by CC&R’s and an HOA is an individual choice. Therefore, all prospective homebuyers should be advised to thoroughly read any CC&R’s recorded against the home and make sure they can live with the conditions and restrictions contained therein prior to the close of escrow.

Developing Good Homework Habits

• Create an environment that is conducive to doing homework. Youngsters need a permanent work space in another part of the house that offers privacy.

• Set aside ample time for homework.

• Establish a household rule that the TV set stays off during homework time.

• Be available to answer questions and offer assistance. But never do a child’s homework for them.

• To help alleviate eye, brain and neck fatigue while studying, it’s recommended that youngsters take a break for 10 minutes every hour.

• If your child is struggling with a particular subject, and you aren’t able to help yourself, a tutor can be the right choice. Discuss it with your child’s teacher.

TV Tips

• Set limits on the amount of TV your child watches and BE FIRM. Limit TV viewing and video games to no more than two hours per day.

• Hide the remote. Eliminate channel surfing which encourages passive viewing.

• Keep TV’s out of your child’s bedroom. Children should watch their favorite shows in a central area of the house.

• Whenever possible, videotape programs and watch them later. Fast forwarding through commercials will shave minutes off of every hour of TV viewing.

• Discourage repeated viewings of the same video.

• Harness the power of television in a positive way. TV can be a powerful tool for learning and expanding one’s view of the world.

• Make use of the ratings systems to know whether or not a program is appropriate for your child.

Are you lonesome tonight? This cake will have you itchin' like a bug on a

   fuzzy tree. Even your hound dog will like it. Thank you, thank you very much.    Makes 1- 9x13 inch pan (24 servings).

|1 (18.25 ounce) package white cake mix |1/2 cup butter, softened |

|1 (8 ounce) can crushed pineapple with juice |4 cups confectioners' sugar |

|2 cups white sugar |1 teaspoon vanilla extract |

|1 (8 ounce) package cream cheese |1 cup chopped pecans |

Directions

1 Prepare cake according to instructions on package. Bake in a 9x13 inch pan. Allow to cool.

2 Combine pineapple and sugar in saucepan. Bring to a boil. Spoon over cooled cake.

3 In a large bowl, cream butter and cream cheese until smooth. Add powdered sugar and beat until smooth. Add vanilla. Add pecans and mix well.

4 Spread cream cheese frosting over cake.

Tax Deduction

For Hybrid Cars

The Internal Revenue Service has certified the following cars as being eligible for the clean-burning fuel deduction:

• Lexus RX 400h, Model year 2006

• Ford Escape Hybrid, Model year 2005

• Toyota Prius, Model years 01-05

• Honda Insight, Model years 00-05

• Honda Civic Hybrid, Model years 03 and 05

• Honda Accord Hybrid ,Model year 2005

This certification means that taxpayers who purchase one of these hybrid vehicles new during calendar year 2005 may claim a tax deduction of up to $2000 on Form 1040. This one-time deduction must be taken in the year the vehicle is originally used and the taxpayer must be the original owner. Individuals do not have to itemize deductions on their tax return to claim this deduction. This benefit can be taken as an adjustment to income on the Form 1040. “NEW HOME SALES”

Metro Phoenix is exceeding last year’s record sale pace. New numbers show that 33,320 new homes were permitted in the Valley through the first half of the year, putting metro area on track to easily exceed the 60,872 new-home permits issued last year. The median price for a new home in metro Phoenix was $224,605 in June, a more than 23 percent jump since June of last year. When will buyers balk at higher prices? Greg Burger, Housing Analyst, on home buyers says, “Until buyers are not showing up at the subdivisions every Saturday for the lottery, prices will continue to climb.”

Monsoon Tips

Watching an Arizona monsoon can be an awe-inspiring experience, but whether you’re caught outdoors or home during a monsoon storm, here are some safety tips:

• If you see a sign that says “Do Not Cross When Flooded”, take it seriously! If you’re caught in a wash, try to climb out on the roof of your vehicle and wait for help.

• If you are driving when it’s raining, slow down. Remember that the beginning of a rain storm is the most dangerous time since that’s when oils and other fluids are being washed off the roads, causing slick conditions.

• If your visibility is impeded by heavy rain or blowing dust, pull off the road, turn off your car and lights, and keep your foot OFF the brake. Otherwise, drivers may come up quickly behind you assuming that you are still in motion.

• To avoid being struck by lightning, stay away form open fields, high land, trees, poles and other tall objects, standing bodies of water, including swimming pools, and metal objects, including golf clubs and lawn chairs.

• Turn off all unnecessary electrical equipment during storms to decrease the draw on the power company. This is a prime time for power outages.

• Keep batteries, a working battery-powered radio or TV, flashlights and candles handy.

• Stay off the phone. Even cordless phones can cause a shock in cases of nearby lightning strikes.

• Stay away from plumbing fixtures including showers, baths and sinks. Lightning can travel through metal pipes.

• Keep your distance from windows as high winds can blow heavy debris.

While we spend most of the year in dry, warm weather, the Arizona monsoon offers a spectacular exception to that rule!
