What a Supportive Housing Case Manager should know about an employer’s interview process

• It is illegal for an employer to ask about an applicant’s disability. However if the disability is visible to a potential employer, they may draw conclusions about how it might impact job performance.

The following are examples of questions that employers are not allowed to ask you about you and your disability:

o Do you have a disability?

o Have you ever filed for worker’s compensation?

o Have you ever been treated for the following diseases?

o How many days were you absent from work due to your illness in your last position?

o What medications are you taking?

o Is there any health related reason why you may not be able to perform the job assigned?

• It is forbidden for employers to ask questions related to age, race, religion, sexual orientation or family status, except in determining if a person is old enough to work.

• Assist your tenant applicant in preparing responses ahead of time for the interview by conducting mock interviews. For tips on answering tough interview questions visit: .





• If your tenant has a disability they may be protected from discrimination by the Americans with Disabilities Act (ADA). If your tenant qualifies they may be protected both when they apply and while they are on the job.

• In Connecticut people with alcohol or drug problems are considered to have a “mental disability” and are protected from discrimination under Connecticut law.

o Connecticut law defines a person with a mental disability as one who has “a record of, or is regarded as having one or more mental disorders, as defined in the most recent edition of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders (DSM-IV)”

• An employer can ask about the abilities to do the job with or without a reasonable accommodation.
