This Call for expressions of interest follows the General Procurement Notice for this project that appeared on-line on UNDB on September 03, 2014 and on the Ministry of Economy official web site on September 04, 2014, as well as published in the Экономическое Обозрение of September 05, 2014 (No. 32).

A significant regulatory and institutional weakness in the business environment is shown by Moldova’s relatively low position in the recent Doing Business rankings of the World Bank Group. The imperfect legal / normative framework governing business is particularly important. More than that, the imperfect legislation brings to legal nihilism and contributes to actions of corruption from public officials. The existence of cumbersome, and at times non-transparent certification, licensing, inspections, and customs regulations discourage foreign investments and tends to undermine competitiveness of private Moldovan enterprises and ultimately provides a fertile ground for corruption, favoritism, and the informal economy. Therefore, there is a need to further simplify and improve legislation and regulations affecting business.

Important elements of the business environment are permissive documents whose issuance and requirements are cumbersome for businesses, especially those that impact export-oriented value chains. To introduce greater transparency and predictability into the issuance of permissive documents, and reduce the cost and time to obtain them, the project supports the introduction of the one-stop shop (OSS) and electronic platform for the issuance of priority permissive documents. The project also supports activities to remove those documents that are redundant and prevent businesses’ efficient operations.

The Government by the Decree no. 753/2016, adopted the Concept and Mechanism for Managing and Issuing Permits (MMIP), the State Chancellery of the Republic of Moldova will coordinate and monitor the implementation of the Action Plan on optimization of permitting processes and implementation of the OSS solution. The Ministry of Economy through the Project Implementation Unit of the World Bank Second Competitiveness Enhancement Project (PIU) signed the contract for development and implementation of the Information System (IT) for managing permitting documents.

The Technical Working Group (TWG) established by the Prime Minister’s order nr. 162-d dated 16.12.2016 to coordinate the development and implementation of the IT platform for issuing permits needs advice from an experienced lawyer that would enhance capacity of the working group.

Since the OSS is being created in parallel with the reform on permissive acts, it is crucial that there will be a dedicated person to keep track of all minor changes in the legislation that should be reflected in the OSS system, taking into account the vast number of permissive acts and the big variety of procedures and conditions of obtaining them.

The Government of Moldova is seeking the services of a local individual Consultant with expertise in legal issues to support the Ministry of Economy, State Chancellery and the Technical Working Group (TWG) in coordinating with the involved public authorities the legal side of the new processes for issuing permissive documents.

To support the process of implementing the OSS for issuing permissive documents, the legal adviser will carry out the following tasks:

1. Coordinate with the involved public authorities the legal side of the new processes for issuing permissive documents and identify any legal barriers in implementing electronic processes by each authority involved in the process;

2. Provide assistance to the IT team and technical working group in developing the “TO BE” diagrams and new legal requirements for issuing permits. Keep constant track of all changes that occur in the promoted draft legislation and the existent (enacted) one;

3. Assess the legal requirements for issuing permits according to the new law provisions and translate these requirements into technical requirements (passports, diagrams, forms, time, authorities involved) that will be used both by the technical working group and IT company to implement those in the system;

4. Assist the Government to develop and amend the existing Governmental decision on the governmental services portal (.md) in order to enable the implementation of OSS on this platform and develop the legal regime for the OSS;

5. Facilitate the OSS implementation by providing support to the key public authorities involved in issuing permissive documents in amending internal regulations and related Government decisions in respect to the use of the new electronic system and front office solution in issuing permits.

6. Provide legal advice to the technical project manager in solving the issues related to the new processes for issuing permits. Consult the technical project manager regarding the legality of the processes implemented in the System;

7. Participate in all the meetings of the technical Working Group that are chaired by the State Chancellery and advise the working group on legal matters required for the achievement of its objectives;

8. Provide support to the PIU in tracking implementation of the Contract for the OSS IT System from the legal aspect, and justification of any amendments of the Contract;

9. Provide support to the PIU to transfer the OSS IT System once developed, to the agency designated by the State Chancellery to manage its operation;

10. Provide custom ad-hoc reports to the PIU upon request.

This assignment will require an individual local Consultant, who has:

✓ University degree in law, postgraduate studies in law will be an asset;

✓ Demonstrated knowledge of good governance and regulatory reform issues in Moldova;

✓ Minimum of 5 years of experience working in, or with, the private sector in Moldova, and minimum of 7 years of experience working in, or with, the public sector in Moldova on policy, legal and economic issues;

✓ Extensive knowledge and proven experience, reflected by having at least 5 years of experience working in the field of business permits and licenses as well as knowledge legal framework related to permissive documents;

✓ Experience in drafting legislation, development of acts, and/or technical expertise and experience in the field of business regulation;

✓ Fluency in Romanian and English as well as ability to develop documents in Romanian and English;

✓ Computer proficiency.

The Project Implementation Unit of the Competitiveness Enhancement Project now invites eligible individual consultants with legal background to indicate their interest in providing the services. Interested Consultants must provide information indicating that they are qualified to perform the services (CV, diploma(s), description of similar assignments, experience in similar conditions, etc.). This Call for Expression of Interest will lead to the preparation of a Short List of consultants for each position.

For evaluation of the candidates the following criteria will be applied:

The consultants will be selected in accordance with the procedures set out in the World Bank “Guidelines: Selection and Employment of Consultants under IBRD Loans and IDA Credits & Grants by World Bank Borrowers” published in January 2011 (Consultant Guidelines) and revised in July 2014.

The assignments will be implemented in the period from July to December, 2017 and the level of effort will be approximately 80 man-days.
