ORDINANCE NO.

AN ORDINANCE TO DISCONTINUE PARTICIPATION IN THE NORTHEAST WYOMING COUNTY PLANNING COMMISSION AND TO CREATE THE CLINTON TOWNSHIP PLANNING COMMISSION IN ACCORD WITH ARTICLE I1 OF THE PENNSYLVANIA MUNlCIPALITIES PLANNING CODE.

Bby authority of and pursuant to the provisions of the Second Class Township Code, Act 69 of May 1, 1933, P. L. 103,reenacted and amended by Act 60 ofNovember 9,1995,,as amended; and Pennsylvania Municipalities Planning Code, Act 247 of July 3 1,1968, P. L. 805, as reenacted and amended by Act 170 of December, 1988, and amended by Act 67 and Act 68 of June 2000, as amended,

BE IT HEREBY ORDAINED AND ENACTED by the Board of Supervisors of Clinton Township, Wyoming County, Pennsylvania, that Clinton Township hereby withdraws from the Northeast Wyoming County Planning Commission; and,

BE IT HEREBY FURTHER ORDAINED AND ENACTED as follows by the Board of Supervisors of Clinton Township, Wyoming County, Pennsylvania,

Section 1 - Planning Commission Created Section 2 - Membership and Terms; Residency Compensation; Removal Section 3 - Conduct of Business; Annual Report; Funding Section 4 - Planning Commission Responsibilities Section 5 - Repealer Section 6 - Severability Section 7 - Effective Date

Section 1 - Planning Commission Created

Pursuant to the provisions contained in Article 11of the Pennsylvania Municipalities Planning Code, and in order to carry the said provisions into effect, there is hereby created in Clinton Township a Planning Commission which shall have all the powers conferred to it by the Board of Supervisors as authorized by law, and which shall act in an advisory capacity to the Board of Supervisors.

Section 2 - Membership and Terms; Residency; Compensation; Residency; Removal

A. Membershiu and T m The Township Planning Commission shall consist of three (3) members who shall be appointed by the Board of Supervisors. At least two (2) members of the Commission shall be citizen members who shall not be officers or employees of the Township. The members of the Planning Commission shall serve for a term of four (4) years, and terms shall expire on December 3lstor until a successor is appointed and qualified. The terms of the members first appointed shall be so fixed that no more than two (2) shall be reappointed or replaced during any hture calendar year. An appointment to fill ia vacancy shall be only for the unexpired portion of the term. '

B. Residency All members of the Commission shall be citizens of Clinton Township.

C. Comuensation Members shall serve without compensation except that they may be reimbursed for expenses incurred in carrying out their commission duties, but only with prior approval of the Board of Supervisors.
