ACKNOWLEDGEMENT OF CALIFORNIA

MEAL AND REST PERIODS

• Administer this acknowledgement to every employee hired in the State of California.

This Acknowledgement details Kelly Services meal and rest period process for employees in California.

Under California law, employees who work more than five hours per day must be provided with an unpaid meal period of not less than 30 minutes. This meal period should begin no later than the fifth hour of work. Employees who work more than 10 hours per day must be provided with a second, unpaid meal period of not less than 30 minutes. This meal period should begin no later than the tenth hour of work. Employees are also authorized to receive a 10-minute paid rest period for every shift which lasts 3 ½ hours up to 6 hours, a second 10-minute paid rest period for every shift which lasts more than 6 hours up to 10 hours, a third 10-minute paid rest period for a shift which lasts more than 10 hours up to 14 hours, and so on for every four hours, or major fraction thereof. This meal and rest period process applies at all times during your employment with Kelly while in California and while you are on assignment with any Kelly customer in California.

If, for any reason, you are prevented from taking a full meal or rest period, or if you are asked to delay taking your meal period past your fifth or tenth hour of work follow the instructions below:

• Complete and fax the Notice of Involuntarily Missed Meal/Rest Period - California to your local Kelly office before the end of your regularly scheduled work day. This form is available from or by calling your Kelly office.

Employees who work through all or part of their meal period or rest period at the request of Kelly or the customer, or who delay taking their meal period past their fifth or tenth hour of work at the request of Kelly or the customer, will be compensated in accordance with applicable law.

Employees who do not follow Kelly’s meal or rest period process may be disciplined up to and including termination.
