MUTUAL RECOGNITION ARRANGEMENT ON CONFORMITY ASSESSMENT OF ELECTRICAL AND ELECTRONIC EQUIPMENT

Information Interchange Format

PART 1

Introduction

This format is being prepared to assist member economies participating in the APEC MRA to prepare documentation required for participation in a consistent format.

It is expected that each participating member economy would submit their information in the recommended format to the APEC Secretariat as required by the MRA.

The format is based on the Information Notes on Good Practice for Technical Regulation and therefore provides for information to be supplied for each of the regulatory regimes identified in the notes. There are 7 regimes, they are for products requiring inspection, products requiring licensing, products requiring batch testing, products requiring approval (or certification), products requiring listing or registration, supplier declarations and essential safety requirements. Participating member economies need only provide information relating to the regimes which are in force in their economy. The regimes that are not enforced by the economy need to be noted also, please indicate this by placing ‘none’ in the standards table on the front of each regime.

Where more than one regulatory system applies within a participating member economy information on each regulatory system should be provided separately.

The format also draws upon the survey on Conformity Assessment of Electrical and Electronic Equipment conducted by the APEC SCSC. The format includes reference to applicable international standards and uses the international convention for describing the relationship of national and international standards, i.e. IDT for identical, MOD for modified, and NEQ for not equal.

When information makes reference to documents or legislation, the documents or legislation should be available on a website for that economy or provided as part of the information supplied to the APEC Secretariat.

PART I – INFORMATION EXCHANGE

Regime Overview

For the purpose of public safety against danger of electric shock, fire hazard and injury, and radio interference suppression occurring from the poor quality or illegal products, the Electrical Appliance Safety Control Act was enacted in 1974.

In 1999, the Electrical Appliance Safety Control Act was amended in order to transform a Type Approval System supervised by the government into a Safety Certification System implemented by designated safety certification bodies, based on international criteria such as ISO 17025 and ISO/IEC Guide 65. The designated certification bodies shall carry out product testing, factory inspection and also regular inspection (once a year) to ensure the safety of electrical appliances subject to the safety certification designed for use with a voltage rating between 50V to 1000V for AC. The amended Act went into effect as of July 1, 2000.

In order to apply with different safety control procedures according to hazard-levels, KATS has implemented a Self-Regulatory Safety Confirmation System simultaneously with the existing safety certification system starting on January 1, 2009, considering changes in circumstances such as the development of electrical and electronic industry, an increase in putting newly developed products on the market and the need of eased restrictions of the government for enterprises, etc.

KATS designates high-hazard major electrical appliances as the products subject to the safety certification and has implemented the safety certification system allowing sale of electrical appliances received safety certification after undergoing product testing and factory inspection from the safety certification bodies. For the products subject to the safety certification, the certification bodies implement the annual inspection.

Regarding the electrical appliances subject to the self-regulatory safety confirmation, the product testing is only required once every 5 years.

An approval regime requires the assessment (type testing) of a sample or samples for compliance with a standard or specification by a “Regulator” or assessment agency recognised by a regulator. In some economies approvals issued by other “Regulators” may be recognised.

Products can not be sold, or imported, until an “approval” is issued for that product.

Products are generally required to be marked or labelled to indicate that they are covered by an approval.

Designated certification bodies implement product testing as testing facilities. Electrical Appliances Safety Control Act does not specify any requirements for testing facilities.

Approval (Certification) Agencies

KATS shall designate certification bodies which meet the requirements of ISO 17025 and ISO/IEC Guide 65. Additionally, certification bodies shall be designated in accordance with Article 9 of Electrical Appliances Safety Control Act.

Labelling Requirements

KATS launched a "National Integrated Certification Mark, KC(Korea Certification)" system, so the existing EK mark was changed into KC mark for electrical appliances.

According to the system, manufacturers shall place the KC mark on the products newly received safety certification starting on January 1, 2009 in accordance with Article 6 of the Electrical Appliances Safety Control Act for the appliances subject to the safety certification and Article 13 of the Act for the appliances subject to the self-regulatory safety confirmation.

* NOTE: We allow to use the new KC mark ([pic]) in parallel with the existing EK mark ([pic] ) by June 30, 2011 to provide enterprises with a longer preparation period.
