ENTIRE AGREEMENT: This agreement constitutes the entire understanding between [pic]and CLIENT. It supersedes all prior and simultaneous agreements between the parties. Additions or changes to this agreement must be completed in writing and agreed to/signed by all parties.

RESERVATION: Upon your signature, [pic]will reserve the time and date outlined above to photograph the contracted event. The Reservation Deposit of $____________ (50% of total cost of package)_ dollars is non-refundable and is due in order to reserve the date and time for services. Unfortunately, cancellation of the event for reasons outside the control of [pic]will not permit a

refund, though every effort will be made to accommodate changes in schedule or venue unless prior conflicting engagements are under contract. The Reservation Deposit applies toward the selected photography package. CLIENT understands and agrees that the remaining balance of $ _____________ is due and must be paid by ___________________ (2 weeks prior to the Event). CLIENT understands that failure to pay balance when due will result in cancellation of the contract with [pic] and forfeiture of the Reservation Deposit. [pic]accepts no liability for failure to render services as a result of CLIENT failure to submit timely payment.

PRE-EVENT CONSULTATION: [pic]agrees to meet with the CLIENT for a pre-event consultation in order to discuss the wishes of all parties, finalize actual shooting times, locations, and establish a written CLIENT request list for specific requested photographs. [pic] will attend the event at times specified and perform services professionally, but suggests the CLIENT designate an “event guide” who will be responsible for identifying individuals of whom specific photographs are desired. While [pic]will perform to the best of her abilities, CLIENT understands that the best value for your money occurs if the photographer does not have to use contracted time identifying or gathering people for photographs and cannot be accountable for such omissions. The parties, bride and groom, agree to set aside a minimum of 30 minutes (recommended) before the ceremony commencement and approximately 45 minutes afterward for formalized group and individual photographs that cannot be obtained during the ceremony.

COOPERATION: The parties understand that cooperation and communication are essential for the best possible result within the definition of this assignment. [pic]is committed to memorializing your scheduled event photographically through capturing visual moments but requests and must rely on an “event guide” to point out important individuals or details they wish photographed. [pic] cannot make guarantees to capture every memorable candid moment during the event.

SHOOTING TIME / ADDITIONS: The photography schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties. CLIENT and [pic]agree that cheerful cooperation and punctuality are, therefore, essential to that purpose. Shooting commences at the scheduled start time of _________________AM/PM on ___________________________ and will commence at ____________________AM/PM.

Additional requested time will result in an additional charge of $50 per 30 minutes.

HOUSE RULES: In some cases, the photographer is limited by the guidelines of the ceremony officiant or reception site management. CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility though [pic]may offer technical recommendations or suggest alternative strategies to capture desired photographs within the constraints of officials.

DIGITAL NEGATIVES, PRINTS and COPYRIGHTS: The photographs, digital negatives or prints produced by [pic]are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without explicit prior written permission from [pic]. Further, [pic]prohibits publication or selling of copyrighted material for profit and will prosecute violations to the fullest extent allowed by law.

MODEL RELEASE: The CLIENT hereby grants to [pic]and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases [pic]and its legal representatives and assigns from all claims and liability relating to said photographs.

EXCLUSIVITY / GUEST PHOTOGRAPHY: It is understood that [pic]has exclusive rights to photograph the scheduled event. The CLIENT acknowledges responsibility for notifying guests that guest photography is not permitted during formalized portrait sessions. The formal photography time includes the express use of the event location and grounds to capture formal wedding portraits. Because of time constraints and so subjects can give full attention to the professional photographer, guest photography cannot be permitted. If guests cannot abide by this, it is not the fault of [pic] if specific photographs have not been taken due to lack of cooperation by the guests. Guests may take snapshots during the processional and recessional, during the ceremony as permitted within the guidelines of the officiants, during candid events, and at the altar when [pic]has concluded their work. Guest photography at the reception will be allowed at any time.

[pic]requests CLIENT take the steps necessary to insure guest photography does not interfere with the work of the photographer for [pic].

COOPERATION / COORDINATION: The CLIENT will direct all other service providers (florist, DJ, caterer, etc.) to provide any needed information and cooperation to the photographer where coordination with other services is necessary to complete the photography as scheduled. This is best accomplished by sharing the photography schedule with other service providers to insure no conflicts with times. In addition, coordination of events during the day should be planned to make the best use of time from all vendors. [pic]cannot tolerate unchecked guest conduct or verbally/ physically abusive behavior from anyone in relation to the parties that interferes with the work of the photographer. Behavior left unchecked or damaging photographic equipment will result in immediate departure of the photographer without refund.

COMPLETION SCHEDULE: [pic]will create a sneak preview of photographs available for viewing online beginning no later than 14 days after the event for CLIENT and guests to enjoy their wedding day. Digital processing takes approximately 8-14 weeks for editing to be completed and the ability to view online. After selections have been made, creation of a wedding album and prints may take up to 2-3 weeks and enlargements/canvas prints 1-2 weeks. Note: Delay in selections by parties will result in longer wait times due to on-time scheduled orders. The schedule may be longer during peak laboratory and bindery times.

PURCHASE OF DIGITAL NEGATIVES: An additional CD of high-resolution digital negatives can be purchased for an additional cost of $250.

PENALTY FEES & CHARGES: There is a $50 charge for returned checks and a $35 late fee for payments not postmarked by the required date or delivered to [pic]in the appropriate time frame. CLIENT is responsible for insuring payment is received prior to the event.

RIGHT OF WITHDRAWAL: [pic]reserves the right to withdraw from the contract and return all unused fees and deposits should the discovery of new information, changes, or other factors tending to circumvent its policies arise. Lack of cooperation; excessive changes of locations, facilities or times; missed appointments; or bad or returned checks are examples of contributing factors. In the event [pic]initiates the withdrawal, all fees and deposits will be returned with the exception of fair market value for services/products already rendered. In case of withdrawal, $100 an hour is billed for photography services already provided and $25 an hour for other services, consultations, and driving time, rounded up to the half-hour.

LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergency makes it impossible to fulfill contracted duties [pic]will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. [pic] takes the utmost care with respect to exposure, transportation, and processing of photographs including using professional grade equipment and professional grade backup equipment. However, in the unlikely event photographs have been lost, stolen, or destroyed for reasons within or beyond [pic] control, [pic]liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount based on the percentage lost to the total number of originals.

PERFORMANCE: The performance of this contract on behalf of [pic]are contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

SEVERABILITY: If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

AMENDMENTS: This contract has been freely negotiated and shall be recognized as the entirety of the agreement, and only those changes or modifications specifically placed in writing, attached, signed and dated by the CLIENT and [pic]at the time of this contract’s signing shall be recognized as amendments to this contract.
