ZONING AND BUILDING FEE SCHEDULE

EFFECTIVE – SEPTEMBER 13, 2018

ADOPTED BY TOWN BOARD – SEPTEMBER 12, 2018

It is the intent of this fee schedule to partially offset the cost of administering the New York State Uniform Building and Fire Code and the Town of Middletown Zoning Ordinance. The various fees may change from time to time as costs change.

In many cases the fee does not cover the expense. At any time a NYS Environmental Quality Review is required, the fee shall be as stipulated in State law. In other cases, if it becomes necessary for the Town of Middletown to engage outside consultants, engineers, attorneys or similar people, the applicant shall deposit in advance, a fee, of ½ of 1 percent of the total cost of the project on projects that are over $100,000 in value. This fee shall be deposited into an escrow account by the Town. Any unrequired balance will be refunded to the applicant.

If construction is started prior to obtaining a building permit, all fees will be doubled.

When a fee is paid and the requested item is refused and an additional fee is paid for an appeal, the original fee paid will be returned to the person who paid it if the appeal is denied.

When a fee is paid and the requested item is denied and no appeal is taken, there will be a charge of 20% of the fee up to a maximum of $50.
