B. AMENITIES

Aquatic Center

1. What are the pool open and close dates for the 2011 season?

The pools are scheduled to open on Friday, May 27th for the Memorial Day weekend at 10 AM and close on Labor Day, Monday September 5th at 9 PM. The Heron Bay Community Association reserves the right to revise the dates of opening and closing in consideration of pool use, weather conditions and costs.

2. What are the pool and lifeguard hours? Can I swim prior to opening hours during pool season? Can I swim after the pool closes in the evening?

Pool Hours: 10:00 AM to 9:00 PM Sunday thru Saturday

Lifeguard Hours: 10:00 AM to 9:00 PM Summer Sunday thru Saturday

6:00 PM to 9:00 PM School In-Session Monday thru Friday 10:00 AM to 9:00 PM School In-Session Saturday and Sunday

Morning:

Yes, when lifeguards are not on duty, the Heron Bay pools are “swim at your own risk” and residents may swim prior to opening hours as early as 7:00 AM. Prior to 10:00 AM, the pool may need to be closed for cleaning. You may be asked to leave the pool water temporarily. The Association cannot guarantee that the pool will be clean or the chemicals will be within range prior to 10:00 AM daily.

Evening:

No, the Heron Bay Pools officially close at 9:00 PM for the evening. Additional chemicals may be added or the pools may be shocked to insure the pool is maintained properly and may not be suitable for swimming. For safety reasons it is important that you do not enter the pool waters after 9:00 PM.

3. Are there 911 call boxes at Heron Bay? When should I use the 911 call boxes?

911 calls should be made for emergencies only.  For non-emergency calls, please call: Henry County non-emergency #:  770-957-9121; Spalding County non-emergency #:  770-229-9911.

4. When is security scheduled at the pool?

There is a varied (non-posted) schedule for Henry County police at the pool and property during the week. The police are typically at the pool during the week and every weekend during pool season.

5. What is the Heron Bay pool rule enforcement process? How is this addressed?

If there is an infraction of the pool rules and safety requirements, you should:

o Report the incident to the lifeguards immediately to give them an opportunity to address.

o If the infraction is not addressed or resolved, you should contact one the Heron Bay Community Association Safety/Pool committee members who are typically at the pool or the Heron Bay Community Association staff at 678/432-7790 or stop by the Lodge, as soon as possible.

o Please note dates, time and persons involved, vehicle description, etc;

o Each incident must be investigated.

o The Heron Bay Community Association reserves the right to suspend those residents or person(s) involved until the incident is investigated and also, continue suspension for periods of time as determined by the Association.

6. What are the lifeguard’s duties?

o Lifeguard and monitor the pools.

o Check and maintain water chemistry and record readings at least 3 times per day.

o Clean tile around pool water line.

o Backwash filtration system.

o Clean strainer baskets.

o Tidy bathhouses daily and inspect each hour.

o Tidy swimming pool area.

o Vacuum pools at least three times per week or as needed.

o Empty trash receptacles.

o Straighten pool furniture.

o Replenish janitorial supplies in bathhouses.

o Enforce pool rules that are posted on site and also, signed and provided to each resident. (Note: Resident pool registration is mandatory.)

o Maintain mechanical equipment in pump room.

o Report all medical or disciplinary action to the Heron Bay staff.

o Lock and secure facility daily.

o Ensure safety procedures are followed.

o Gate monitor checks photo IDs prior to people entering the pools of Heron Bay.

7. What is the purpose of adult swim and/or Safety Breaks called by the lifeguards?

Safety breaks and/or adult swims are called to give the lifeguards the opportunity to check chemicals, bathrooms, rotate duties and take breaks. This practice has also proven to improve the overall safety and cleanliness of the pool. Children have a chance to take a break and use the restrooms. Safety breaks are called every hour. The slides and mushrooms are typically turned off during safety breaks dependent on lifeguard coverage.

8. Are IDs required to enter the pool?

Yes, as stated in the pool rules, photo ID is required for residents and guests to enter the pool. The lifeguards, gate monitors, Safety/Pool committee members, Security Staff and the Association Management staff reserves the right to check IDs at anytime.

9. Who is responsible for cleaning the pool and what is the cleaning schedule?

The pool company is responsible for cleaning the pool and is maintained daily:

o A full clean schedule: Daily as early as 8:30 AM or before 10:00 AM.

o A full clean includes: checking pool chemicals and balance, as needed; skim pools, check deck for items left in pool area, remove trash in the evenings, ensure paper goods are replenished in bathhouses, backwash filtration system, check all skimmer baskets, vacuum and clean as needed.

10. Are the pools ever drained and cleaned?

Yes. The pools will be drained, cleaned and tile checked as needed. This process is also dependent on drought and water restrictions.

11. Who manages the Heron Bay pools? What measures are taken to ensure healthy swimming at the Heron Bay pools?

The Heron Bay Community Association contracts a Pool Management Company that:

o Works closely with the Henry County Health Department & the Association Management Staff

o Maintains pool chemistry and sanitation

o Assists in the maintenance and repairs of the pool area and bathhouses

o Staffs, trains and manages the entire lifeguard staff, including the gate monitors.

Pool Safety Measures:

o Chemical levels are monitored and typically posted at least 3 times a day by both the Heron Bay Association Management Staff and Pool Management Company to ensure chemicals are within county standards.

o If contaminations occur, the pools will be closed immediately, shocked and quarantined for 24 hours to ensure all contamination has been removed. If additional chemical treatments are required the pool may be closed for a longer period.

o At the recommendation of the Centers of Disease Control (CDC) children aged 4 and under, must wear swim diapers or rubber pants under bathing suits.

12. Can I have guests at the Heron Bay Amenities and what is the policy? How can I schedule a pool party?

Yes, guests and family of Heron Bay residents are welcome at the pool and fitness area and must be accompanied by the resident at all times while at the pool and fitness room. The standard that is being used at the pool is an adult is considered 18 years or older. Photo ID will be requested. Residents are permitted to have up to 4 guests per household without a reservation.

For parties of 5 to 10 guests (which includes the residents that are hosting a party):

o If the time & date are available, you will be asked to fill out a registration form. You may obtain this reservation form online on the Heron Bay neighborhood website at: .

o Pool/Veranda parties are scheduled Monday thru Friday only.

o All residents should clean up after the party. A deposit of $100 is required to cover any cleaning costs in the event an outside cleaner is required to clean after the party. Should any cleaner or repair cost exceed $100, the resident will be responsible for these additional costs.

o All deposits and fees are made payable by check only, and are made payable to the Heron Bay Community Association.

o Grills may be rented for a non-refundable fee of $45.00 which includes the cost of having the grill cleaned.

o The Association Management Staff reserves the right to limit the number of parties scheduled and block dates, as applicable.

13. If I am a new resident, how do I get access to the pool and fitness room?

o Please call the Association Management office to schedule an appointment for a new homeowner orientation at: 678-432-7790.

o You will need to bring your photo identification and your deed/settlement statement.

o After the new homeowner orientation, the Heron Bay Staff will issue you two access cards.

o Additional access cards are $15.00 each.

14. Do I have to replace my access cards each year?

No. However, for your access card to remain active you must be in good standing and all homeowner fees paid in full.

15. What should I do if I lose my access card?

Please notify the Association Management staff as soon as possible. For a fee of $15.00 per card, your original access card will be de-activated and a replacement card will be provided. Fees are made payable by check or money order only, and are made payable to the Heron Bay Community Association.

16. Is alcohol allowed at the pool?

Yes, pursuant to Georgia Law, but with the following restrictions:

o No glass containers are allowed.

o The lifeguards and the Heron Bay Staff reserve the right to ask people to leave the pool area should they appear dangerous or become a nuisance. This includes intoxication.

o For private parties, a signed alcohol waiver is required.

17. Can I leave my child at the pool while I’m not there?

No. No one under the age of 16 is permitted at the pool without direct adult supervision – this means a parent or guardian must be with all children under the age of 16.

18. When are the water slides open?

The slides are open during pool hours when two or more lifeguards are on duty. Operation of the slides must be under the control of the lifeguards at all times. During the day, the slides may be temporarily closed when the lifeguards are on a break or performing other duties. The slides daily opening is subject to change at the discretion of the Association. Slide times are posted on the sign beside the slides.

19. How old and how tall do children need to be to ride the water slides?

Children must be at least 5 years old and at least 42” tall to ride the water slides.

20. Is diving allowed in any of the pools?

No, our pools are not deep enough to ensure safe diving.

21. Who are the Safety/Pool Committee Members? What are their duties?

The Safety/Pool Committee members are comprised of Heron Bay residents who volunteer their time and focus on maintaining the Heron Bay community as a safe environment year round. During pool season, this committee’s focus will be on the safety at the Heron Bay Aquatic Center.

Some of their duties include:

o Requesting ID for pool access

o Working closely with the lifeguards in an effort to enforce the Heron Bay Pool Rules.

o Identifying safety issues and working closely with the Association Management Staff.

22. Are the mushrooms left on year round?

No, the mushrooms at the Heron Bay Aquatic Center will on a varied schedule in an effort to conserve water and utility costs. The mushrooms are on during pool season, but may be turned off for safety breaks.

23. Does Heron Bay have a pool dress code and what is the appropriate swim attire?

Yes, proper swim attire is required to get into the pool. Swim suits are normally made from light weight quick drying fabrics designed specifically for the aquatic environment.

o No thong swimsuits are permitted.

o No street attire including t-shirts, cover-ups, walking or cargo shorts or under garments are permitted in the pools.

o No undergarments may be visible while in the pool or on the pool deck.

o Children age 4 and under must wear swim diapers or rubber pants under bathing suits in order to enter the pools.

Lifeguards are required to enforce these rules with no exceptions and will ask any resident or guest to leave the pool who is wearing inappropriate attire or undergarments for the day on the first occurrence. Any subsequent occurrence will result in possible seasonal suspension.

24. When is a 1 or 2 day pool pass given out?

The Association at their discretion reserves the right to issue "one or two-day" pool passes at their discretion for the following reasons:

o New residents have not yet gone through Heron Bay orientation and received their permanent pool access card. 

o The unavailability of HOA accounting records on weekends only as a courtesy for Heron Bay residents.

o Operating difficulties of the pool gate access system due to inclement weather or other various reasons.

o Marketing or community promotional events.

25. Can I get a disease from Black Algae? How does it get in the pools?

No, in properly treated chlorinated pool water, there is no possibility of disease transmission or health risks from exposure to black algae. A black alga which is commonly found in lakes is transported into the pools by swimsuits, rain, wind, etc.  While it is an ongoing concern, the pool company is aware of the situation and will treat with the proper chemicals as needed. Should you see black algae, please let the lifeguards on duty know and/or the A staff. 

The Heron Bay pools will be closed for a required period of time until pool chemicals and waters are at county standard.

The Heron Bay Community Association reserves the right to close the pools for events, marketing functions, swim team meets and/or swim team practices.

The Lodge

1. Who owns the Lodge and the Aquatic Center?

The Lodge and Aquatic Center are currently owned by the Developer and are currently being used to support the overall marketing of the neighborhood as well as house the offices of the Association’s Management Staff.

2. Will the Lodge be turned over to the homeowners?

Yes. When the Association is transferred from the Developer to the residents’ control, the Lodge will be part of this transfer. (*See Covenants: Article 3, 3.2, Page 8)

3. Can a resident rent or reserve the inside of the Lodge for private parties?

o Yes, certain areas of the Lodge (library & great room) are available and may be reserved for private parties, bridal or baby showers, etc;

o Rentals are permitted on: Friday, Saturday and Sunday evenings only.

o Rental fees which are required when making reservations, include the use of the library, great room and cleanup, as follows:

Up to 40 Guests (small party): $200

41 to 75 Guests (medium party): $275

76 to 125 Guests (large party): $350

o There is a separate $200 security deposit (payable by check) that is fully refundable if party ends on time and no damage occurs during the rental.

o Set up for your party can begin as early 6:00 PM and clean-up must begin by 10:00 PM or earlier, to be completed by 10:30 PM.

o Stove and microwave is available for use. Absolutely, no deep fat frying or other stove top cooking is permitted.

o Furniture may not be moved without prior consent of Association Management.

(**Important Note: **Swimming parties are limited to the veranda and poolside use only and will not be permitted for interior Lodge use as no damp or wet attire is permitted inside.)

Association Management reserves the right to block out specific dates for community events and activities.

4. Can the veranda at the Lodge be rented after the pool is closed? If so, can the veranda fireplace be used?

Yes, to both questions. The non-refundable rental fee of $30.00 is required. A security deposit for the veranda of $100.00 is required. The Security deposit will be refunded if additional cleanup by housekeeping is not required and no damages are incurred i.e. everything is left in good order. Should you wish to use the BBQ grill, there is a non-refundable $45.00 rental fee which includes gas usage and grill cleanup. Deposits and fees are made payable by check only to the Heron Bay Community Association, Inc.

5. What are the hours of operation for the Fitness Center?

Daily: 6:00 AM to midnight.

6. Where is the Fitness Room located? Are there Fitness Room rules?

The Fitness Room is located in the Lodge.

Yes, the Fitness Room rules are:

o For Safety reasons, we ask that you use the side door of the Lodge to access the Fitness Room. There is no access through the Lodge.

o Please do not use the equipment with wet swimsuits or damp attire.

o Please use the provided antibacterial wipes to wipe down the equipment after each use.

o For safety reasons, we encourage you to make other care giving arrangements for small children. Children are not permitted to remain in the hallway outside of the Fitness Room at anytime.

o Please clean up your trash and place in the receptacle provided.

o Please take all personal belongings with you when you leave.

o Appropriate athletic footwear (open toe sandals are not permitted) must be worn when using the Fitness Room equipment.

o Residents and guests must be 16 years of age or older to operate fitness center equipment without adult supervision.

7. Can the Fitness Room be expanded in the Lodge?

Yes, the Marketing office and presentation alcove were designed and built to allow expansion of the fitness room. The Developer has no plans at this time to expand the existing fitness room. However, at turnover, the Association may decide to fund the expansion.

8. When visiting the Fitness Room, if I find equipment to be in need of repair, who do I contact?

Please contact the Association Management and Lodge Staff as soon as possible at: 770/957-5633 or 678/432-7790. If after hours, please leave a voice message.

9. How do I get to the Fitness Room?

With your access card, enter through the gate next to the Lodge. Entry through the Lodge is not permitted.

Tennis

1. How do we turn on the lights at the tennis courts?

There are red and green buttons in a metal box located on each side of the tennis courts. Push the green button to turn the lights on; push the red button to turn the lights off when you leave. The lights will automatically turnoff at midnight.

2. What are the hours of the tennis courts?

Daily: 6:00 AM to midnight

3. Are restrooms available for use during tennis matches? If so, who do I see if the playground restrooms are locked?

Yes, please ask any of the staff on duty during business hours if the restrooms are locked. If a match is planned after business hours, please contact the Heron Bay Events Manager in advance of the event at: 770/957-5633

Parks

1. Where are the parks located in Heron Bay?

There are currently parks in the following Heron Bay neighborhoods: Pinehurst, Wildewood, The Springs, and the Links. The neighborhood parks are designed to be passive recreation areas for picnics, etc. The sports field in the Parkwood neighborhood is geared toward active pursuits i.e. soccer, Frisbee, etc. (*see page 10 for Lakefront Park information.)

2. Does the public or non-residents of Heron Bay, have access to the parks?

No. The parks within Heron Bay are the private property of the Association.

3. Will there be any improvements to the existing parks?

There are no plans for any improvements to the existing parks.

4. Where is the sports field?

The sports field is located behind the homes in the Parkwood neighborhood (between the homes and the commercial area). Access is from Granby Lane and parking is provided for 12 cars.

5. What activities can be played on the sports field?

The field can be used for multiple sports such as soccer, Frisbee, ball throwing, etc.

Lakefront Park

1. Where is the Lakefront Park located?

The Lakefront Park opened in May 2008 and is located at the end of View Pointe Drive in the Links neighborhood. Take Heron Bay Boulevard and turn left on View Pointe Drive.

2. Is there parking available at the Lakefront Park?

There is parking for 32 cars and 2 of these are reserved for handicap parking.

3. What are the amenities at the Lakefront Park?

This beautiful park serves as the focal point for lakeside viewing for the entire Heron Bay community. Features of the park include a covered pavilion with a community kitchen with a sink, refrigerator, and microwave, plus restrooms, shaded area, two fire pits, benches and swings.

4. Who paid for the Lakefront Park?

The Developer paid for the construction of the park. The ongoing upkeep and maintenance of the park and amenities will be an expense of the Association.

5. What are the hours for the Lakefront Park?

Hours of use: One-half hour before sunrise to one-half hour after sundown.

6. What is the guest policy?

4 guests per household are permitted and must be in the company of resident. Parties over 4 guests require approval and signed agreements that each resident must submit to the pool gate guard.

7. Who do I contact if I wish to rent the kitchen and/or pavilion?

Association Management reserves the right to block out specific dates for community events and activities.

8. Can I fish, swim, or launch a boat from the banks of Heron Bay?

No fishing, swimming, diving or boat launching is permitted from Heron Bay. For access to Cole Reservoir, please contact: Henry County Water & Sewage Authority at: (770)957-6659 or Website: .

9. If there is a large party, can I park on ViewPointe Drive in the cul de sac or adjacent areas?

No. Parking is not permitted on the grass, the driveway of the Lakefront Park or on ViewPointe Drive. Car pooling is encouraged. Residents may park in the bottom parking lot at the Lodge.

10. Can I bring my pet to the Lakefront Park?

Pets are welcome, if leashed and accompanied by the resident owner at all times; residents must clean up after their pets.

11. Can I drive my go-cart, dirt bike, motorcycle, golf cart on the grounds of the Lakefront Park? Can I bring a camper, trailer or mobile home to the Lakefront Park? Can I camp out at the Lakefront Park?

No. Specific motorized vehicles, such as ATVs, golf carts, go-carts, motorized dirt bikes, motorcycles or any recreational vehicles are not permitted in the Lakefront Park. Campers, tents, trailers, RVs or mobile homes are not permitted in the Lakefront Park. The Association reserves the right to erect event tents for Lakefront Park events, meetings and activities.

12. Are bicycles skateboards and roller skates permitted in the Lakefront Park?

No, the Association encourages residents to use alternate means to get to the Lakefront Park. Bicycles, skateboards and roller skates are not permitted in the pavilion, on the sidewalks or the grounds of the Lakefront Park. A bicycle rack is provided for those who bicycle to the Park.

13. I noticed an IPOD station on the wall of the pavilion; can I use it at anytime?

Yes, if it is available and not being used by another resident. All music devices must be kept at a personal volume level and are not permitted between 8:00 PM and 8:00 AM. Please be considerate of neighboring residents.

14. Is there an age limit for the Lakefront Park?

Yes. Due to safety reasons, no one under the age of 16 is allowed at Lakefront Park without adult supervision.

15. Is alcohol permitted at the Lakefront Park?

Yes, alcohol is permitted. The Heron Bay Community Association and Henry County security reserves the right to ask any person(s) to leave the Lakefront Park area should they become dangerous, a nuisance or intoxicated.

16. Can I use the fire pits at the Lakefront Park?

Yes, fire pits are available to rent. Please note the following:

o Wood is not provided and only natural wood is permitted to be burned in the fire pits.

o The fire pits may be used for cooking.

o Flames cannot be higher than 6 ft.

o A water bucket is provided next to the exterior water spout. Fire pits must be extinguished prior to departure.

o For rental, please contact Kim VanRoyen at kvanroyen@minerva- or 678-432-7790. The Heron Bay Community Association reserves the right to restrict the use of fire pits at their discretion.

17. If I want to store my boat in the parking lot at the Lakefront Park, am I allowed to do so?

No. Storage of boats, trailers, RVs or any other type of vehicle is not permitted at the Lakefront Park.

18. In the event of an emergency at the Lakefront Park, who do I call?

In event of an emergency, please call 911. Call box is located next to IPod in the open area of the pavilion.

19. Is smoking permitted at the Lakefront Park?

Yes, ashtray receptacles are provided.

Future Amenities – Pool

1. Will there be another pool?

A second pool center is being planned by the Developer. This pool center will be geared for adults versus the main amenity area at the Lodge, which is geared towards children. The exact timing and details have not been finalized.

2. Does Canongate have a private swim/tennis center?

Canongate has a swim and tennis center available for use by its golf course members. Please call Canongate directly at 770-320-8500 for specific information.

3. Will the Association put in a community basketball court or volleyball court?

There are no plans at this time.

C. GOLF - CANONGATE

1. Who owns the golf course at Heron Bay?

Canongate Golf, LLC (Sequoia purchased the course but it is operating under the Canongate name), which is a separate company from Heron Bay.

2. What does the Canongate membership include?

The membership includes:

o Private Club Exclusivity

o 18-hole Championship Course

o Quality Practice Facilities

o Clubhouse and Restaurant

o Pool and Tennis Amenities

o Reciprocity at other Canongate Clubs

D. TRAILS

1. When will the walking trails be ready within Heron Bay?

The Oak Trail, Buckeye Trail and Azalea Trail are open and consist of approximately 2+ miles of trails. Access is available from Parkwood, the Links, Lakeview, the Villas, the Springs, Heron Bay Blvd., and the parking lot of the pool/tennis area. Future phases will be staged with development.

2. Where are the walking trails going to be?

Trails are located throughout the community. A trail layout map is available at the Lodge.

3. Are bicycles, golf carts or 4-wheelers allowed on the trails?

Bicycles are currently allowed on the trails but please be mindful and respectful of pedestrians. Golf carts and any other unauthorized motorized vehicle are not allowed on the trails. You may occasionally see Association Maintenance Staff in motorized vehicles.

E. Street Trees

1. Who is responsible for the street trees in Heron Bay?

The street trees are typically installed in the late Fall and paid for by the Developer or builder. After installation, the Association will replace pine straw, water the tree during the first growing season and will trim and maintain as needed. The homeowner is responsible for weed maintenance around the trees on an ongoing basis. If the homeowner elects to install a different type of mulch other than pine straw mulch, replacement will be at the expense of the homeowner.

2. Who do I call if the street trees in front of my home need to be replaced or if I have any questions about them?

F. TRAFFIC UPDATES

1. Where are the access roads (other than the main entrance on Heron Bay Blvd) in/out of Heron Bay onto Hwy 155?

Existing Access:

o Heron Bay Boulevard (main access) at Hwy. 155.

o Southgate Drive (located in the Gables neighborhood). Follow Southgate to Johnson Rd., then left on Johnson Rd. (dirt road) east to Hwy. 155.

o McIntosh Drive at Hwy. 155 in the Meadow Glen neighborhood.

G. COVENANTS AND GUIDELINES

1. When will the Association be transferred from the Developer to the Residents?

The turnover to the residents can take place when either a) 75% of the homes in Heron Bay are sold to residents; b) sooner if the Declarant (Developer) elects to relinquish its rights or c) no later than Dec. 31, 2023.

2. Who is on the Board of Directors for the Heron Bay Community Association?

Brian Davison (President), Joseph Harris (Vice President) and Todd Smith (Secretary). All work with Minerva, the Developer.

3. How often can the HOA Annual fees be raised? Is there a cap?

Fees may be raised at the discretion of the Board of Directors. There is not a cap.

4. Do changes to the exterior of my home or changes to my lot require any form of approval?

Yes. A lot modification application must be filled out and approved by the Architectural Review Board (ARB) *See details in #10 below.

5. Who is on the Architectural Review Board (ARB)

Stacy Patton, Todd Smith, Joe Harris and Brian Davison – all work with Minerva. The ARB also works very closely with Association Management in regard to Lot Modifications.

6. Can we put a pool in our back yard?

Yes, subject to the restrictions outlined in the Guidelines, County codes and ordinances, and approval of the ARB.

7. Do I have to submit a lot modification application if I am going to finish my basement?

No, unless the remodeling affects the outside of the home, in which case, approval must be requested from the ARB. Heron Bay residents need to follow all County building regulations.

8. Will I need to submit a lot modification application to put in a simple flower bed?

Yes. Any deviation to the approved landscape plan must be submitted to the ARB for approval.

9. How long does it take to get approval for a lot modification application?

Pursuant to the covenants, the ARB has up to 45 days to give their decision. However, in most cases this decision is made within ten days or less.

10. What steps do I take to have a lot modification application reviewed?

a) Fill out the “Application for House or Lot Modification” form that is located in the back of the Heron Bay Residential Design Guidelines. You may also obtain additional copies of this form at The Lodge or access the form online at

b) The following is required to be submitted along with your modification application:

i. A site plan to scale, showing the exact location of the modification requested in relationship to property lines and existing improvements such as existing house, fence, decks, walkways, driveway, etc.

ii. A brief description of the modification including exterior elevations, floor plans, details of materials to be used, pictures, catalog pages, brochures, color samples, or other items.

c) Applicants need to check with Henry or Spalding County, depending on which County you live in, to obtain zoning, building code and permit requirements.

d) Discuss the modification with your neighbors who will be directly impacted.

e) Your application may require a visit to your property by the Association Management, ARB or Positive Standards Committee. You will be notified to set up an appointment that is mutually convenient.

f) Submit the request to either your Association Management by a) dropping it off at The Lodge; b) mailing it to: Heron Bay Community Association, Inc., 3080 Heron Bay Boulevard, Locust Grove, GA 30248; or c) fax it to: 678/432-7791.

g) You will be informed in writing if your application has been approved or denied.

11. How often is Heron Bay reviewed for covenant violations?

The property is reviewed one or more times on a weekly basis by the Association Management Staff. The Positive Standards Committee (“PSC”), which is comprised of volunteer Heron Bay residents, reviews property every 3 weeks. A PSC review calendar is posted on the neighborhood website.

H. Positive Standards, Community Liaison

and Social Activities Committees

1. What is the Positive Standards Committee?

They are a group of resident volunteers, whose purpose it is to:

o Maintain and enforce the community standards as set forth in the Heron Bay Design Guidelines and Covenants by monitoring the entire neighborhood every three weeks and meeting once per month or as needed.

o The Positive Standards Committee works closely with Association Management and will make recommendations or suggestions for community improvement.

2. What happens when the Positive Standards Committee discovers a violation of the Covenants or Guidelines?

o Step One: If a property is found in non-compliance or in violation of the community standards, the homeowner will be notified by mail. The Positive Standards Member may also contact the homeowner either via phone or in person. The nature of the concern will be explained and solutions offered for correcting the situation. The resident will be given a specific period of time to correct the violation. If the homeowner is renting the property, the homeowner is held responsible for the property. The homeowner may request that non-compliance notifications be sent to the renters, property management Company or only to homeowner. It is important that homeowners that lease their homes contact the Association Management office and provide renters names and contact information. Please notify the Association Management office at: 678/432-7790.

o Step Two: If the non-compliance issue is not corrected in a timely manner, the homeowner will receive a letter from the Heron Bay Management. This letter will explain that self help may be imposed or a fine may be imposed on the property for every day the unresolved issue exists. It will outline a “fine start date”. The fine amount is typically $25 per day for a maximum of 30 days. Other resolutions to correct the situation may be implemented.

o Step Three: If the non-compliance issue is still not corrected and the fine not paid after 30 days, a legal process will be initiated and a lien will be placed on the property in the amount of the fine. Any attorney collection fees will be the responsibility of the homeowner that is in non-compliance.

o Step Four (Self Help): In certain non-compliance situations, the Association reserves the right to enforce “self help” in order to remedy the issue. The homeowner will be advised in advance and in writing. If “self help” is implemented, the homeowner will be invoiced for the service rendered. If the invoice is not paid within 30 days of receipt, interest will be applied and possible legal action taken. It is the intention of the Association to work with the homeowner in every possible way to avoid legal action.

o Re-occurring violations: If a resident has received a violation notice and the same violation occurs again or repeatedly within the same year, the violation process does not begin again. Instead, you will receive a “final” notice with a noted time of compliance before self help or fining is enforced.

3. What is an example of “Self Help”?

An example of self help would be if a homeowner’s lawn has not been mowed or treated for weeds, then the resident is considered to be in non-compliance. The Heron Bay Community Association per the covenants has the right to have the lawn cut and/or weeds treated. The invoice or bill for this service will be billed back to the resident.

North side of Heron Bay entrance: The commercial land on the north side of the Heron Bay entrance is currently undeveloped.

3. What is The Village at Heron Bay and where is it located?

The land south of the Wildewood neighborhood, which fronts onto Hwy. 155, is a future part of Heron Bay and is zoned for a variety of commercial, office and residential uses. It is designed to be a “village style” commercial node, surrounded by a variety of different types of residential uses including live/work units, apartments, condos, town homes and single family housing.

Other Development

1. What is the purpose of the small building at the Cole Reservoir at the Lakefront Park?

It is a sewer pump station which is owned and operated by the Henry County Water and Sewerage Authority. When facing the Lakefront Park pavilion, to the right the small building is Canongate restrooms.

2. Who paid for the waterfall? Who pays for the maintenance?

The design and construction of the waterfall was paid by the Developer. The maintenance and

electrical/water bills are paid by the Association. If a level 4 drought condition occurs, the waterfall will be turned off in an effort to conserve water. The Association reserves the right to turn the waterfall off at their discretion.

J. Gates/Private Roads

1. Are there gated communities or private roads within Heron Bay?

The Lakeview neighborhood within Heron Bay is gated. The gate is located on Linkview Crossing.

2. Will there be any additional gated neighborhoods or private roads in Heron Bay in the future?

Possibly. The Developer is considering a gate and private roads for The Pointe.

3. Who will have access to these gated neighborhoods?

All Heron Bay residents will have pedestrian and bicycle access through the pedestrian gate at all times. Vehicular access will also be available to all Heron Bay residents by obtaining an access card from the Association Management for a deposit of $30. This $30 deposit will be reimbursed once the card is returned.

4. Will this create a larger assessment fee?

Maintenance of the gate and a portion of the road will be paid separately by the residents living within the gated area; so no assessment will be charged to residents living outside the gated area.

5. Is the Developer planning to gate the main entrance to Heron Bay at the HWY 155 entrance?

No, Minerva will not be installing a gate at the main entrance.

5. When are street lights installed?

Street lights are installed by Central EMC after road construction is completed. Central EMC tries to have the lights installed before residents move in, however, this is not guaranteed.

6. Who has access to the Cole Reservoir?

Henry County residents or anyone that has an active account with the Henry County Water and Sewage Authority (HCWSA), including the Spalding County residents of Heron Bay, have the ability to obtain a seasonal permit, which must be purchased through HCWSA. Their contact information follows:

o Directions to public boat launch: Once you leave Heron Bay, turn left onto Hwy. 155. Turn left onto Hampton Locust Grove Road. Stay on Hampton Locust Grove Road for about 1 mile and turn left onto Weems Road (dirt road). Follow Weems Road to the end to get to the access ramp.

The Cole Reservoir is owned by HCWSA and is governed by their guidelines and restrictions. Currently the Cole Reservoir has restricted access and fishing:

o No fishing or wading is allowed from the banks of Heron Bay. Please note where the HCWSA signage is posted along the banks indicates where the HCWSA property begins. Please do not trespass.

o Swimming is not permitted.

o Please check with HCWSA for additional information or changes in these guidelines.

7. How much is the 2011 association fees and what are they paying for?

The Heron Bay Annual Assessment fees are currently $660. These fees are used for the maintenance of the common areas, the pools, amenities, street lights in common areas, landscaping, and other expenses that the community may incur. *Note: Assessment fees are subject to change prior to the beginning of each year at the discretion of the Board of Directors.

8. What is the initiation fee and when is it paid?

The initiation fee is $275 and is collected at the initial house closing.

9. When are the annual assessments due?

The Association has established that annual assessments will be due on February 1st of each year.

10. Who do I contact if I cannot pay the annual assessment?

11. What happens if I do not pay the annual assessment?

Per Article 2, Section 2.1 (e) and Article 4, Section 4.3 (d): The Board has the right to suspend the right of the owner to use any recreational and social facilities within the Common Area. Your pool access card will be deactivated. A late fee will be incurred and possible legal fees which are the responsibility of the homeowner.

12. What do I do if my amenity access card to the Heron Bay pools and fitness room do not work?

You should call the Association Management office and/or stop by the Lodge so that the staff can determine what the problem is.

13. What do I do if I lose my amenity access card?

Please contact the Association Management office as soon as possible so that it can be deactivated. There is a $15 replacement fee.

14. Is there a security patrol within Heron Bay?

Yes, the Association has hired Henry County Police to monitor Heron Bay during rotating hours. Their role is to serve as a deterrent to possible violators. Should a resident witness suspicious activity, please call 911. There are police officers that also assist at the Amenity Center during pool season.

15. What should I do if I see someone speeding or driving erratically within Heron Bay?

16. If I see animals running free in the neighborhood or if a barking dog is a nuisance, who do I contact?

17. If I see a dead animal on the streets of Heron Bay, who do I contact?

If it is a large animal i.e. deer, etc; you should contact your county DOT. (Henry County DOT: 770/288-7623; Spalding County DOT: 770/467-6015). If it is a smaller animal, you should contact your County Animal Control. (Henry Animal Control: 770/288-7387; Spalding Animal Control: 770/467-4772.) You may also contact 911. If the County or Animal Control do not remove the animal, the Association has authorized removal by Serenity Landscapes, the Heron Bay Association landscaping company.

18. Where are pets allowed in Heron Bay?

There are county leash laws in effect for both Spalding and Henry Counties. Pets may be leash walked on the sidewalks, at the parks and on the trails within Heron Bay, but are not permitted in the Aquatic Center or tennis courts. Please remember to pick up after your pet.

19. Who is responsible for repairs of a fence that is shared and divides two adjacent lots?

The cost of repair and maintenance is shared equally by the owners who make use of the party structure.

20. What is a party structure?

A party structure is a wall, fence, driveway or similar structure built as a part of the original construction on the lots which serves and/or separates any two adjoining lots.

21. When is the Annual Homeowners’ meeting held?

Typically, the Annual Meeting has occurred in the last quarter of the year. As the community grows, consideration will be given to having semi-annual meetings or Open Forum Committee Meetings will be held during the year by the Positive Standards Committee, Safety/Pool Committee and Community Liaison Committee to provide updates and community information. Residents will be notified prior to the meeting by signage or on the website.

22. Are garage sales allowed in Heron Bay?

Yes, but please be aware that the Association sponsors two community-wide garage sales each year and invite you participate. If you choose to have one individually, your garage sale is subject to approval by the ARB. Please contact the Association Management at 770-957-5633 and request a garage sale form. The following information needs to be provided prior to approval: a) indicate the street address of the garage sale; b) the number of signs you wish to use and the proposed location of the sign placement; c) date of your garage sale. Please be advised that no handwritten signs are allowed and they may not be placed in the center island of the main entrance.

23. Can I have my business posted on the pool bulletin board?

No. The pool bulletin boards are reserved for community information. You may have your business posted on the bulletin board of the Heron Bay neighborhood website.

24. How can I get my business posted on the Heron Bay website?

25. Can we ride our golf carts, 4 wheelers or mini bikes on the sidewalks or streets throughout Heron Bay?

No.

26. How many homes will be built in Heron Bay?

As currently planned, there will be approximately 2,200 homes.

27. What signs can I have in my yard and what approval is needed?

Please submit a request for all signage to the Association Management Staff. The following signage is permitted: a) any signage for legal proceedings; b) one professionally lettered realtor’s sign; c) small, “no solicitation” signs; d) new resident or private resident signs as provided by builder; e) one professional security sign; f) signage supporting certain causes, funds or election may be permitted on a temporary basis (two week period) only, but must be approved prior to installation. Other signage must be approved on a case-by-case basis i.e. additional realtor signs. No handwritten signs are permitted. No company landscaping signs permitted.

28. How long can holiday decorations be left up?

The decorations can be left up for two weeks after the holiday.

29. Do I need to make reservations to allow my guest to use the parking lot by the tennis courts?

Please notify the Heron Bay Association Staff, so that appropriate personnel are notified. Cars left without authorization may be ticketed or towed.

30. Will there be speed bumps at Heron Bay?

No. Speed bumps are not planned by the Developer for Heron Bay.

31. Are there plans to increase the speed limit at Heron Bay?

No. The County establishes the speed limits. We ask that all residents obey the speed limit to ensure the safety of our community.

32. Who do potential vendors or contractors contact if they are interested in the future retail space at Heron Bay?

33. Does the Lodge have internet access for new residents to use while they are waiting for their new home computer to be connected?

Not at this time. However, the Association will be happy to provide community updates to any homeowners upon request.

34. If I am looking for “in-home” daycare service within Heron Bay, how do I find out who is available?

Log onto the Heron Bay neighborhood website at and look at the bulletin board and/or the commercial directory. Several neighborhood services are offered there. In 2011, a new neighborhood website will be available. Information will be provided in advance.

L. HERON BAY ACADEMY

2. Can an update be provided on the Heron Bay Academy (charter school)?

On May 16, 2011 at 8:30 am the Georgia Supreme Court published its ruling on the October 2010 hearing affecting Georgia state commission charter schools.  We do not yet know the implications for Heron Bay Academy.

In the meantime, continuing to educate our students remains our top priority.  We are concerned about the Georgia Supreme Court ruling and are hopeful that the Georgia legislature, Georgia Board of Education, and Georgia Governor Nathan Deal will assist us in preserving Heron Bay Academy and all schools that provide a tuition free educational choice for families throughout our state.

3. Is there anything the residents of Heron Bay can do to be proactive in getting the Heron Bay Academy approved?

We encourage all family and friends of Heron Bay Academy to contact their local state senator and Georgia house representative today.  Our legislative representatives serve geographic districts throughout the state, which do not necessarily correspond with county lines.  To learn in which district you reside, use the following link to enter your home mailing address: congressorg/officials/congress/  The right column will show the name of one state senator and one house representative along with the Georgia district number corresponding to your resident address.  An appropriate communication to our legislators might include the following:

There is no tuition to attend. It is a free public charter school.

Heron Bay Academy is open to students residing within the Henry and Griffin-Spalding County School districts.

3. Are uniforms required?

Yes. To help create an environment conducive to learning, students at Heron Bay Academy will be required to wear simple uniforms. This policy is designed to permit students to focus their attention on academics and on those aspects of their personalities that are truly important.

Kindergarten classes have up to 20 students with an instructional assistant in addition to the primary teacher.

9. How do you handle discipline?

Every student is required to sign a contract with his or her parents and their homeroom teacher at the beginning of the year that stipulates that the student will contribute to a positive and constructive learning environment, including not causing disruptions. We also have found that students are less likely to be disruptive when they are enjoying themselves, and our curriculum empowers that enjoyment.

10. Are parents allowed to participate in their child’s learning experience?

We strongly encourage parental involvement at home, and we request that each parent volunteer at least 15 hours every year to the school. We will also have Paragon® Nights every five weeks when parents can come to the school and see their students perform and demonstrate what they have learned during that five week period.

11. What type of volunteer activity is expected of parents?

Parents are asked to volunteer in areas that meet their skills and interests. The specific tasks will vary widely from reading to Kindergarten students, helping in the lunch room, aiding in office duties, and participating in additional activities such as sports and nature walks, to name a few.

12. Can I come to the school and observe my child’s class?

Absolutely.

13. Are the teachers be certified?

Yes. Our teachers, are GA certified and highly qualified in accordance with the federal laws regarding No Child Left Behind.

14. Do you teach foreign language?

Yes, we teach Spanish for every student, beginning in Kindergarten.

15. My child has special needs. How do you provide for specialized services like speech therapy, occupational therapy, physical therapy, etc?

Special arrangements are made to provide these services within the school setting pursuant to the child’s Personalized Educational Plan.

16. What makes Heron Bay Academy different?

17. How do you handle the standardized state tests? Are these administered as they are in the local public schools?

Students take the CRCT test just like any other public school. We participate in the same tests and use this data to help develop our school improvement plan to move the school to continuously higher levels of achievement. In addition, students take a national norm-referenced test (i.e. the Iowa Test of Basic Skills) to determine academic progress during the school year.

18. Why should parents be confident that the school’s curriculum will help children excel on the state’s standardized tests?

Parents should feel confident that the school’s curriculum will help a child excel on the state standardized test because our curriculum is aligned to the state standards and benchmarks, and our educational program goes above and beyond these standards.

19. How does your method of instruction address the variety of learning styles?

Our proprietary curriculum (Paragon®) is one of many tools used to tap into the students’ multiple intelligences. We also use Personalized Student Achievement Plans to help clarify and focus on the attainment of specific academic and social goals.

20. What are the “Personalized Student Achievement Plans” and how are they determined?

Each student has a Personalized Student Achievement Plan (PSAP). This plan is a document that the student (if age-appropriate), parents and teacher complete. The teacher, to individualize instruction, uses all information gathered on this document. This document helps in the goal setting process as well as the collection of student data. Every quarter, the parent, teacher, and child will review this PSAP.

21. I understand that Heron Bay Academy has a waiting list for the 2011-12 school year; How can I find out if my child is included?

The number of applicants exceeded the number of spaces available. Students who submitted online pre-enrollments by July 15, 2010 were included in an enrollment lottery on Oct 13, 2010.  The results of the lottery along with the waiting lists are posted under the Resources tab of this website.

22. Do homeowners or residents of Heron Bay neighborhood receive priority?

No. The enrollment priorities at HBA are as follows: 1) currently enrolled students and their siblings; 2) students whose parent or guardian is a member of the governing board of HBA or is a full-time teacher, professional, or other employee at HB Academy; 3) any eligible student residing in Henry or Spalding county school systems.

23. Where is Heron Bay Academy located?

Heron Bay Academy is located in Heron Bay Town Center at the intersection of Highway 155 and Heron Bay Boulevard, Locust Grove, GA.

24. Why is Heron Bay Academy open to all residents of Henry and Spalding Counties?

The State of Georgia Charter School Commission requires all charter schools to open enrollment to the communities they serve, which for Heron Bay Academy is Henry and Spalding counties.

25. What is the Heron Bay Academy Parent Advisory Committee?

Heron Bay Academy is vitally linked to the community it serves, and the Parent Advisory Committee plays an important role in forging and maintaining this link. Currently, we have over 100 individuals volunteering their time.
