But to each one of us grace has been given as Christ has apportioned it. Church, herein known as “Guest Church”, has met together and agreed to enter in covenant with the Session of the FORMTEXT ????? Church of FORMTEXT ?????, NJ, herein known as the “Host Church”, believing that both congregations can be supportive of each other in the common cause of Jesus Christ, and recognizing the Host Church as another body of Christ with whom it shares the same basic purpose, and remembering its distinctive heritage and affiliations as diverse but compatible;And whereas, the Session of the Host Church has met together and agreed to enter into covenant with the Guest Church, believing that both congregations can be supportive of each other in the common cause of Jesus Christ, and recognizing the Guest Church as another body of Christ with whom it shares the same basic purpose.We, the Host Church and Guest Church enter into this shared facilities covenant.Potential Benefits and Impact Upon Each ChurchThis covenant is established to affirm our commitment to the mutual support of the purpose, community relationships, and general welfare of each Church.We recognize that this relationship will bring some mutual benefit to each congregation. We pledge ourselves to support one another in love, prayer, and through positive representation to the community of each congregation.Under this covenant relationship, while fulfilling the goals of our respective churches in serving the Lord, we will carefully avoid any harmful attitudes, or activities, that would allow a competitive attitude and/or proselytizing, or any other activity that would harm either our ministry or relationship.We agree to support one another through regular prayer and keeping the spirit of this covenant.Length of Covenant RelationshipThe relationship described in this covenant shall be for FORMTEXT ????? commencing on FORMTEXT ?????.The covenant shall be reviewed and reaffirmed at least FORMTEXT ????? They will have use of the following facilities: FORMTEXT ????? FORMTEXT ????? FORMTEXT ????? FORMTEXT ????? FORMTEXT ?????The Guest Church may meet each FORMTEXT ????? for FORMTEXT ????? from FORMTEXT ????? - FORMTEXT ?????. They will have use of the following facilities: FORMTEXT ????? FORMTEXT ????? FORMTEXT ????? FORMTEXT ????? FORMTEXT ?????The Guest Church may use the following space for storage: FORMTEXT ?????The Guest Church shall have access to all Church facilities for other congregational programs and activities with prior approval of the Session of the Host Church at an additional fee to be agreed upon with each usage.*Specific rooms are subject to change depending on activities going on at the church at that particular date and time.Master CalendarA master calendar shall be maintained by the Host Church. A copy of such shall be posted on the bulletin board in the church office.Use of the church facilities, other than mentioned in Letter A, shall be coordinated by the Session of the Host Church. All requests for additional use of the facilities by the Guest Church shall be made in writing. Rights, Responsibilities, PoliciesUse of Facilities:The Guest Church shall abide by the policies and procedures of Host Church.The existing policies regarding weddings, funerals, etc. and the guidelines and fees associated with such, of the Host Church will be followed by the Guest Church.The Guest Church shall care for the appearance of the church facilities as if they were their own.The cost of repairing any damage to the facilities beyond the normal wear and tear by the Guest Church will be the responsibility of Guest Church. Repairs will be done by the Host Church and will be promptly reimbursed by the Guest Church.Classrooms:The Guest Church shall care for the classrooms and avoid disrupting or otherwise conflicting with the classroom effects. There will be an area for the Guest Church to maintain a storage closet.JanitorialThe Guest Church shall help maintain the cleanliness of the facilities. It shall return any moved furnishings to their original location.The Host Church shall provide janitorial service in order to maintain the cleanliness of the facilities. It shall also provide janitorial supplies and equipment.Prior to the use of any facilities, a representative of the Guest Church will do a visual inspection of the facilities. Any irregularities should be reported immediately by phone to the designated Session representative of the Host Church with a follow-up of the list in writing.Access and Security:The Guest Church shall abide by the policies and procedures of the Host Church relating to access and security.The Guest Church shall be provided keys to the facilities. A log of names and addresses of all people holding keys shall be submitted to the Host Church and updated with any changes as they occur.Following the use of any facilities, a representative of the Guest Church will conduct a visual inspection of the property and building.Insurance and LiabilityThe Guest Church shall carry commercial insurance with a carrier rated A- or better by A.M. Best of an adequate and reasonable amount for Commercial General Liability, Commercial Property and/or Commercial Inland Marine coverages for its own personal effects, and Workers’ Compensation. The Guest Church shall carry a minimum limits of liability as set forth below:Commercial General Liability limits$1,000,000 Each Occurrence Limit (Bodily Injury and Property Damage)$2,000,000 General Aggregates$2,000,000 Products Completed Operations Aggregate$1,000,000 Personal and Advertising Injury LimitWorkers’ Compensation and Employers Liability Insurance$100,000 Each Accident$100,000 Each Employee for Injury by Disease$500,000 Aggregate for Injury by DiseaseAdditional Insured Status on Commercial General Liability and Certificate of Insurance. The Host Church and The Presbytery of West Jersey must be named as Additional Insured on the Commercial General Liability policy, and a completed Acord Certificate of Insurance showing such be mailed to 1701 Sycamore Street, Haddon Heights, NJ 08035, which is The Presbytery of West Jersey office. Copies of all insurance policies shall be provided to the Session of the Host Church and copies of all insurance policies will be kept on file by the Host Church.The Guest Church shall maintain in effect all insurance coverages required under this agreement at the sole expense of The Guest Church for the duration of the covenant.Corporate Status:The Guest Church shall provide evidence to indicate that The Guest Church is a 501 (C) (3) tax-exempt corporation, and exempt from income taxes in both the United States and the State of New Jersey.Loss of tax-exempt status by the Guest Church shall be promptly communicated to the Host Church. No more than five (5) days of the loss of statusAll tax and legal costs from the loss of tax-exempt status by the Guest Church shall be the sole responsibility of the Guest Church.Access:The Host Church has the right to declare the property closed and unavailable to the Guest Church in cases of inclement weather. No adjustments in contribution shall be made in such instances.Sub-let:The Guest Church shall not assign, sublet, or allow any other person or group to occupy the Covenant premises without The Host Church’s prior written consent. No one other than the Guest Church shall use the premises. The Host Church may assign this Covenant at its sole discretion.FinancialThe Guest Church shall render $ FORMTEXT ????? per FORMTEXT ????? to the Host Church for the use of the facilities as agreed. The week will be defined as the time period from Sunday through Saturday.The Guest Church shall render its payment on the FORMTEXT ????? for the weeks of that month. The first payment shall be made by FORMTEXT ?????.The Guest Church shall be held responsible for immediate replacement of any check returned by the bank due to insufficient funds. The Guest Church will also be held responsible for any additional charges incurred by Host Church due to any returned check.Covenant EvaluationAnnually, or as requested by either party, representatives of the Guest Church and the Session of the Host Church shall meet to evaluate the covenant relationship.Covenant AmendmentThis covenant may be amended or expanded with such proposals to be presented via a meeting with representative of the Guest Church and the Session of the Host Church. All such proposals shall require mutual approval.All mutually approved amendments will be attached in writing to the original Covenant Agreement.Copies of any Covenant Amendments will be provided to all parties.Covenant TerminationThis Shared Facilities Covenant agreement may be terminated by either church with a FORMTEXT ????? ( FORMTEXT ?????) day written notice.Default: In addition to other instances noted herein, failure to render payment or breach of other Covenant provisions shall constitute default under this Covenant.
