GENERAL INFORMATION SHEET

Q. What type of accessory structure requires a building permit?

A. All accessory structures for residential use that are larger than 200 sq. ft. require a building permit. All accessory structures for commercial use that are larger than 200 square feet require a building permit. Structures less than 200 sq. ft. that are not attached to an existing structure do not require a permit but must meet all Benton County setback requirements. If you have a question on whether or not you need a permit, please call the Benton County Building Department at (509) 735-3500 from Tri-Cities or (509) 786-5622 from Prosser area. Structures that are placed on slopes greater than 15% may be required to have noncombustible siding and/or soffits and decks may be required to have noncombustible skirting. For buildings for commercial use, all access roads or private driveways over 200 feet long that are over a 12% grade are to be asphalt. Grades over 15% are not permitted. Q. Where to obtain a building permit?

A. Benton County Building Department, 5600 West Canal Drive, Suite C, Annex Building, Kennewick, Monday - Friday, 8:00AM - 12:00 and 1:00 - 5:00PM or the Benton County Planning Department, Planning Annex, Prosser, Tuesday and Thursday only, 9:00 - 10:30AM (except holidays).

Q. What items are required before a building permit application may be submitted?

A. 1. Complete attached building application form. Tax parcel number can be obtained from the property tax statement or from Assessor's office. All plumbing/mechanical fixtures must be listed.

2. One complete set of construction plans, no larger than 24”x36”. Plans must contain a Washington State Registered Professional Engineer's original stamp and must be site specific. Engineered truss information must be supplied for manufactured or onsite trusses. NOTE: FOUNDATION ENGINEERING SHALL BE INCLUDED WITH STRUCTURAL DESIGN.

3. A complete plot plan. All required elements shall be shown (see attached sample).

4. Declaration of Occupancy Use required for all accessory structures, form attached.

5. If new structure is attached to a factory assembled structure/manufactured home, approval from Dept. of Labor and Industries must be submitted.

6. Approval less than one year old from the Benton-Franklin District Health Department for lots one acre or less which are served by a septic system. BFHD recommends an existing septic system evaluation for all construction. Approval is also required if the structure will include plumbing.

7. Approved road encroachment permit from the Benton County Public Works Dept., (509) 736-3084 from the Tri-Cities or (509) 786-5611 from Prosser if the site is vacant of structures. For encroachment to a state road, contact Dept. of Transportation at (509) 575-2541.

• 8. Flood Elevation Certificate if applicable. All structures located within a Floodplain are subject to the requirements of BCC 3.26, including certification by a Washington State Registered Surveyor and/or Engineer.

9. Declaration of Owner Builder if owner is acting as general contractor, form attached.

Q. How long does the plan review process take?

A. If approved and depending on workload, most permits can be issued in 1-2 weeks. Ask at the building department for the current estimated review time.

Q. What inspections are required?

A. Post hole, framing and final. Other inspections may be required if needed.

NOTE: Structures that are placed on fill and or placed on or near slopes may require the approval of a Washington State Registered Geo Technical Report.

POLE BUILDING INFORMATION

INSPECTION REQUESTS: Call the Kennewick office of the Benton County Building Department at (509) 736-2763 or from Prosser (509) 786-5487. This line will be available 24 hours per day, 7 days per week. A minimum of 24 hours advance notice is required. Inspection requests called in on Fridays after 4:00 p.m. will be performed within two working days. Inspection requests called in on weekends and holidays will also be performed within two working days. All information for items 1 thru 6 below must be provided or the inspection cannot be scheduled:

Be sure to have the permit posted in a conspicuous place, the approved set of plans on the job site and a temporary address posted during construction. It is the responsibility of the owner and/or contractor to verify that a final inspection has been completed.

What you should know

While the law provides some protection from fraudulent or

incompetent contractors, it doesn't guarantee honest transactions

or perfect performance. If you're planning to hire a contractor or

remodeler, shop smart.

What does the law require?

In Washington, contractors must register with the Department of Labor and Industries, post a bond and carry general liability insurance coverage.

.

A general contractor must maintain a $6,000 bond. A specialty contractor, such as a painter, must maintain a $4,000 bond. Dissatisfied consumers may pursue restitution by taking civil action against a contractor's bond in Superior Court.

All registered contractors must carry general liability insurance coverage ($20,000 property damage and $100,000 public liability or $120,000 combined single limit).

Contractors must also possess a current unified business identifier (UBI) number and an employer identification number (EIN). (An EIN is optional for a sole proprietorship with no employees.)

protect their financial investment. This brochure

tells you what to look for and avoid, if you’re

planning to hire a contractor or remodeler.

If a contractor is currently registered.

How long the contractor has been registered.

If action against the contractor's bond is pending or has been taken in the past.

The name of the contractor's insurance company, if you want to verify coverage.

If you're not sure whether the work you're contemplating requires a registered contractor, call the hotline. In general, work that "adds to or subtracts from real estate" requires a registered contractor.

Businesses that provide services such as gutter cleaning, pruning, lawn care, or window washing do not need to be registered.

Look for the contractor registration number in

advertisements for contractors. The law

requires this number to be included in all

advertisements, including the Yellow Pages.

Before starting work, a contractor must provide you with a disclosure statement that advises consumers about lien releases. This requirement applies to projects that have a combined cost of labor and materials in excess of $1,000.

Understanding lien releases is very important because a contractor's $4,000 or $6,000 bond may not be enough to cover a claim if one arises on your job. If any supplier of materials, worker or subcontractor is not paid, a lien may be filed against your property to force you to pay. You could pay twice for the same work. Or worse, an unpaid lien could lead to foreclosure. (For remodeling projects, liens can only be filed for the amount left unpaid to the general contractor).

Liens can be avoided. If during your project you receive a "notice of intent" to file a lien on your property, you may ask your general contractor to provide you with lien release documents from the supplier or subcontractor who has sent this notice. You can make the check payable to both the contractor and the material supply house.

The contractor is required to provide you with more information about lien release documents if you request it.

Before you hire a contractor or remodeler:

1. Plan your project carefully. If you know what you want done and can clearly explain it, you're less likely to misunderstand instructions or encounter cost

overruns.

2. Try to interview several qualified contractors and solicit written bids. Bids that are significantly lower than all others should be questioned.

3. Make sure the contractor or remodeler is properly registered and bonded. Ask them to show you their L & I contractor registration card.

4. Ask for references. Then check them out.

5. Be wary of contractors who ask you to pick up the building permit. In most instances, the contractor is required to take out the permits. Permits are your protection. Make sure they are in place as work progresses and that your contractor or remodeler is named on the permit.

6. Try to anticipate problems and inconveniences, such as cost overruns or clean up, and come to agreement with your contractor on how they will be handled before he or she begins work.

Once you have hired a contractor or remodeler:

7. Obtain a written contract that includes price, sales tax and, if applicable, permit fees. Specify the work to be performed, materials used, start and completion dates and payment schedules.

8. Make sure you understand the terms before you sign anything.

9. When advancing money for materials, it may be possible to make checks payable to both the contractor and the supply house. Be very cautious about paying for work not yet completed.

10. Put all change orders in writing. Ask questions as work progresses. If you do not like an answer or don't understand it, stop the work until you do.

11. Make frequent inspections and consult your local building department. Be sure that all permits are in place and that the inspections are in order.

It is illegal for contractors to advertise, submit

bids or perform work without a valid

contractor registration.

BENTON COUNTY SETBACK REQUIREMENTS FOR

ACCESSORY BUILDINGS (GARAGES, SHOPS, AGRICULTURAL BUILDINGS)

DEFINITIONS:

GARAGE: A building or wing of a building in which to park a car.

SHOP: A home workshop.

AGRICULTURAL BUILDING: A structure designed and constructed to store farm implements or hay, grain, poultry, livestock, fruit and other agricultural products. The structure shall not be used for human habitation, processing, treating or packaging agricultural products, nor shall it be a place to be used by the public.

MINIMUM SETBACK FROM AN UTILITY/ACCESS (combined easement, not a stand-alone utility easement) OR TURNAROUND ACCESS EASEMENT: There shall be a setback of not less than 25' from the closest edge of the access easement.

RIVERS/CREEKS - ALL ZONES, ANY SIDE, ANY STRUCTURE TYPE: There shall be a setback of not less than 100' from the high water mark of a river and 50' from the edge of a creek.

FRONT YARD

GARAGE/SHOP - ALL ZONES: There shall be a front yard setback of not less than 55' from the centerline of any street or roadway of 60' or less. If the roadway exceeds 60', the setback shall not be less than 25' from the property line. There shall be a setback of at least 25' from the closest edge of an access easement.

AGRICULTURAL BUILDING - INDUSTRIAL 1, RESIDENTIAL, SUBURBAN or GMA-AG (tracts 5 acres or less): All barns, barnyards or corrals shall be located not less than 75' from any public road or highway. If the front property line is bordered by an access easement located on the adjoining property, the setback shall be 30' from the property line. If the access easement is located on the inside of the property line, the setback shall be at least 25' from the closest edge of the access easement and the total distance from the property line (including the easement) shall not be less than 30'.

AGRICULTURAL or RURAL ESTATES: Accessory buildings ordinarily appurtenant to the conduct of farming and agriculture shall be located not less that 75' from any public road or highway. If an access easement is located on the inside or outside of the property line, the setback shall be at least 25' from the closest edge of the access easement.

GMA-AG (tracts over 5 acres) or UNCLASSIFIED: There shall be a front yard setback of not less than 55' from the centerline of any street or roadway of 60' or less. If the roadway exceeds 60', the setback shall not be less than 25' from the property line. There shall be a setback of at least 25' from the closest edge of an access easement.

SIDE YARD ON INSIDE LOTS

GARAGE/SHOP - IN ALL ZONES EXCEPT THOSE OTHERWISE NOTED there shall be a side yard of not less than 10' on each side of the structure.

GMA-AG zone: There shall be a side yard setback of not less than 20' on each side of the structure.

PLANNED DEVELOPMENT zone: There shall be no minimum required side yard setback within the interior of the development. There shall be a 25' setback from the exterior boundary line of the development.

AGRICULTURAL BUILDING: INDUSTRIAL 1, RESIDENTIAL, SUBURBAN or GMA-AG (tracts 5 acres or less): Buildings shall be no less than 30' from any property held under different ownership from that upon which such animals or poultry are kept.

GMA-AG (tracts over 5 acres): There shall be a side yard setback of not less than 20' on each side of the structure.

AGRICULTURAL, RURAL ESTATES or UNCLASSIFIED: There shall be a side yard setback of not less than 10' on each side of the structure.

SIDE YARD ON CORNER LOT

GARAGE/SHOP - ALL ZONES: There shall be a side yard setback of not less than 55' from the center line of any street or roadway of 60' or less. If the roadway exceeds 60', the setback shall not be less than 25' from the property line. There shall be a setback of at least 25' from the closest edge of an access easement.

AGRICULTURAL BUILDING - INDUSTRIAL 1, RESIDENTIAL, SUBURBAN or GMA-AG (tracts 5 acres or less): All barns, barnyards or corrals shall be located not less than 75' from any public road or highway. PLANNED DEVELOPMENT: There shall be no minimum required rear yard setback within the interior of a planned development. There shall be a 25' setback from the exterior boundary line of the development.

AGRICULTURAL BUILDING: INDUSTRIAL 1, RESIDENTIAL, SUBURBAN or GMA-AG (tracts 5 acres or less): All barns, barnyards or corrals shall be located not less than 75' from any public road or highway. ROAD ENCROACHMENT PERMITS

The Road Encroachment Permit is required if one- or more of the following applies:

1. Any new approach (driveway) to a county road (required for the 1st structure built on a site which is served by either an access easement which comes off a county road or a site which accesses directly onto a county road);

2. The placement/construction of any additional occupied dwelling using an existing approach;

3. Relocation of an existing approach;

4. Any commercial development;

5. Extension of an existing culvert.

All approaches will be constructed to County Standards, which may include paving. Prior to any work being done in the County right of way contact the Public Works Department.

A Road Encroachment Permit is not required if any of the following applies:

1. Replacing an existing manufactured home/factory assembled structure or site built home and utilizing the existing permitted approach;

2. Building a residential garage, storage building or shop if there is an existing dwelling and utilizing the existing permitted approach.

Call the Public Works office to determine if an existing permit is on file.

To obtain the Road Encroachment Permit:

1. Complete Section 1 of the application and return it to the Benton County Public Works office at the Courthouse in Prosser, either by mail, fax or in person. Remember to attach a sketch of the property and approach in relation to the county road.

2. Proposed location of approach will be checked in the field by Public Works staff. Section 2 of the application will be completed and signed by Public Works staff either approving or rejecting the location of the approach and noting any special requirements needed for completion.

3. At this time, the application will be mailed to the address given in Section 1 unless Public Works is notified differently. Turn around time is normally two working days from the time Public Works receives the application until it is mailed back to the applicant.

4. Take the signed application to the Building Department. The Building Department will not issue a Building Permit until Public Works staff has signed Section 2 of the Application for Encroachment Permit.

5. After the approach has been completed, including all special requirements, contact the Public Works Department for a final inspection. This should be done at least 10 days prior to expected occupancy. The Building Department will not issue an Occupancy Permit until Public Works staff has signed Section 3 of the Application for Encroachment Permit.
