FOR

HOT MIX ASPHALT, HOT MIX COLD LAID ASPHALTIC CONCRETE,

AND HIGH PERFORMANCE COLD PATCH

BQ1529

INTENT:

It is the intent of this specification to establish a 24 month master agreement for Hot Mix, High Performance Cold Patch, and Hot Mix Cold Laid Asphaltic Concrete for the City of Dallas (City).

QUALIFICATION OF BIDDERS:

Bids will be considered only from bidders who have been established in the business of producing and/or manufacturing cold patch and asphalt materials for two (2) years or more. If requested, bidders shall provide references to provide proof of at two (2) years in the specified line of business.

To be considered for Groups 1 & 3, bidder shall have a plant located within twelve driving miles from Dallas City Hall 1500 Marilla Dallas, Texas 75201.

Bidders who are submitting alternates to the CURRENTLY APPROVED ITEMS may be requested to provide samples before an award to determine acceptability. R3, UPM and Syl Crete have been approved for the High Performance Cold Patch Materials.

DELIVERY REQUIREMENTS:

The vendor shall deliver orders within forty-eight hours after receipt of any order. In emergencies, the City may need orders within twenty-four hour of notification.

From time to time, the City performs asphalt work on the weekends and holidays. The vendor shall ensure that a minimum quantity of 150 tons of asphalt be a sufficient amount to open the asphalt plant on those days. Vendor shall indicate on the bid sheet if an additional cost is incurred for opening the plant for weekends or holidays.

BID AWARD:

This bid will be awarded by Group to the lowest responsive/ responsible bidder(s). Bidders shall bid all lines within a group to be considered for award. Bidders do not have to bid all groups. The City reserves the right to award by line, by group, or on a total basis depending on which is most advantageous to the City of Dallas. Final bid award will be made to the lowest responsible bidder (s) meeting specifications.

The bid sheet is divided into Groups 1-3. Each Group has several Zones for product delivery, see Attachment A Zone Map.

COMMUNICATION:

The need to respond quickly and clearly is essential to the City. Awardees of this contract must answer written correspondence from the City within three working days. Phone calls from the City must be responded to immediately.

BID SUBMISSIONS:

Sealed bids shall be delivered in person or via mail to the Business Development and Procurement Services office located at 1500 Marilla, 3FN, Dallas, TX 75201, by 2:00 pm on the specified bid due date. Bids received after 2:00 pm on the specified date will not be accepted and will be returned to the bidder unopened. All submissions should include the following outside of the sealed box or envelope: project name and number BQ1529 - Hot Mix, High Performance Cold Patch, and Hot Mix Cold Laid Asphaltic Concrete at Dallas Love Field Airport, firm name, address, telephone number, and designated contact person regarding the submission. Contractors shall submit one (1) original, two (2) copies and one (1) electronic copy (flash drive or CD only) of the bid submission, including an Excel version of the bid sheet with bid prices and all other documents PDF formats.

PRE-BID CONFERENCE:

A pre-bid conference will be held on the time, date and location as listed on the Bid Signature sheet. Attendance is recommended but not required; however, this pre-bid conference is the scheduled time for Contractors to ask questions pertaining to the bid. Contractors are encouraged to attend the pre-bid conference and provide input regarding the specifications and discuss any questions with the user department’s representative(s). This will be the only contact between the bidder and the user department during the bidding process. After the pre-bid conference, all correspondence shall go through the buyer.

SUBMISSION OF QUESTIONS:

Questions should be submitted in writing no later than one (1) day following the pre-bid meeting, unless otherwise instructed by the buyer. Please reference the RFB number BQ1529 in the subject line, company name and representative name on all correspondence to the City.

INSURANCE REQUIREMENTS:

The awarded contractor must provide a certificate of insurance evidencing proof of General Liability, Automobile, and Workers’ Compensation insurance coverage.  The City will be provided a Waiver of Subrogation on the Workers’ Compensation policy.  The City will be shown as the certificate holder.  This insurance must stay in force for the duration of the contract.

ESTIMATED QUANTITIES:

The quantities listed on the attached bid sheet are the City’s best estimates. Quantities purchased can be more or less than the listed quantities during the contract term based on inventory levels and anticipated needs. The City will not be responsible for any anticipated profits or losses, by any bidder, based on these estimated quantities.

SPECIFICATIONS:

Group 1: The specification for the Hot Mix Asphalt is TXDOT Spec. 340 and 340-003 for Type “B, Type “D.” The successful bidder shall provide a price per ton for pick-up or delivery in tandem trucks to different jobs sites within the Zones.

Group 2: The specification for the High Performance Cold Patch Material begins on page 4 of these specifications. The successful bidder shall provide a price per ton for bulk delivery and a price per pail for 50lb pails to all Zones.

Group 3: The specification for the Hot Mix Cold Laid Asphaltic Concrete is TXDOT Spec. 334 for Type “D.” The successful bidder shall provide a price per ton for pick-up or delivery in tandem trucks to all Zones.

TRANSPORT LOAD:

Cold Patch 50lb Pails - Transport Loads shall allow partial truck loads. City may order in quantities of 100 to 200 pails at a time.

STANDING TIME – UNLOADING:

Asphalt Delivery Trucks – The first 30 minutes per truck shall be free unloading at no charge to the City. Standing time in excess of this amount will be bid and charged in increments of one (1) minute. Total minutes shall be listed on the delivery ticket and signed for by city crew leader at the time of delivery.

VENDOR PLANT CLOSINGS:

Vendor shall provide a 48 hour notification, to the City, of their plant closing dates.

PRICE CHANGES:

PRICE DECREASES WILL BE ACCEPTED AT ANY TIME DURING THE CONTRACT PERIOD.

THE OPPORTUNITY FOR PRICE INCREASES WILL BEGIN THE FIRST DAY AFTER THE FIRST SIX MONTH PERIOD OF THIS CONTRACT. (EXAMPLE: IF THE 24 MONTH PRICE AGREEMENT PERIOD IS April 13, 2005 - April 12, 2007, THE VENDOR MAY NOT SUBMIT A PRICE INCREASE UNTIL ON October 14, 2005). THERE MAY NOT BE MORE THAN ONE PRICE INCREASE PER ANY SIX MONTH PERIOD AND NO MORE THAN A TOTAL OF THREE INCREASES DURING THE CONTRACT PERIOD.

THE VENDOR MUST SUBMIT A WRITTEN REQUEST FOR PRICE INCREASES AFTER THE FIRST SIX MONTH PERIOD OF THE CONTRACT TO THE CITY OF DALLAS/BUSINESS DEVELOPMENT & PROCUREMENT SERVICES DEPARTMENT FOR REVIEW. GROUP 2 - SPECIFICATION FOR

HIGH PERFORMANCE COLD PATCH MATERIAL

1. DESCRIPTION

The bituminous patching mix shall consist of asphalt and aggregate within the prescribed quantities to make a mixture which will provide satisfactory coating, workability and adhesive characteristics. The mix shall be capable of maintaining adhesive qualities in patched areas, which are damp or wet at the time of application. A stockpile shall remain pliable and workable down to a temperature of 15( F and shall maintain all of its performance features after remaining in an uncovered stockpile for up to 12months.

2. MATERIALS

A) Aggregate: shall consist of a crushed limestone or an equal approved by the City, complying

with the requirements of ASTM C-136, for stone size #9 or #89 in the following manner:

from a base asphalt stock of either AS-5, AC-10 or AC-20 with a approved blending

formula and shall meet the following requirements:

• This test shall be performed in accordance with ASTM D-5, except that a penetration cone conforming to ASTM D 217 shall be used in place of the standard penetration needle. The total moving weight of the cone and attachments shall be 150(0.1 grams. The transfer dish water level shall be lowered to less than the height of the sample, and then water from the top of the sample shall be decanted before transferring from the bath to the penetrometer.

3. COMPOSITION OF MIXTURE

The mixture shall consist of an aggregate conforming to Group 2 (Line Items14 & 15), and a bituminous material conforming to Group 2 (Line Items 14&15) mixed in the following proportions:

Aggregate 93.5% to 95.0%

Bituminous Material 5.0% to 6.5%

The patching mix shall meet the following requirements:

ASTM D 2172 Extraction of Bituminous Material 3.5% to 9.0%

4. PREPARATION OF MIXTURE

The asphalt blend shall be heated to a temperature of between 190(F and 275(F.

The approved aggregate shall be surface dried. A moderate amount of heat may be applied to the aggregate not to exceed 175F(.

Mixing shall be for 30 to 45 seconds or until the aggregate is uniformly coated.

5. PERFORMANCE GUARANTEE

The supplier of the material shall guarantee the performance of the patching mix to meet the following requirements:

A. The material shall maintain all of its performance features and remain workable after remaining in an uncovered stockpile, for a period of 12 months.

B. Repairs shall not show any significant signs of shoving, rutting, tracking,

kick- up or raveling for a period of 12 months from the time of repair.

In the event the material does not meet all of the above requirements, the supplier shall be required to remove the unused portion of the unacceptable material and deliver an equal quantity of acceptable material at no expense to the City. The replacement material shall be delivered to the location designated by the City within 15 days from the date of written notification.

The vendor shall furnish the address and telephone number of the point of contact responsible for the performance guarantee.

6. AFFIDAVIT

The supplier shall furnish an affidavit, which verifies the product bid meets or exceeds the specifications. The affidavit shall have attached an analysis done by an independent testing laboratory certifying that the material conforms to these specifications.

7. DELIVERY

The material shall be delivered to the various service center locations as designated by the City within forty-eight hours of request.

GROUP 3 - SPECIFICATION FOR

HOT MIX COLD LAID ASPHALTIC CONCRETE

Item 16 - Hot Mix Cold Laid Asphaltic Concrete (per TXDOT 334-Type “D.”

Item 17: Part #234, Tic-Tack (Cold Emulsion); comes in 5LB. Buckets.

Item 18: Instant Road Repair, Class I Rapid Cure (Cold Patch)-in 50LB. Buckets.

DESCRIPTION:

This item shall consist of a pothole patching material to be composed of a compacted mixture of mineral aggregate and asphaltic material. It is the intent of this specification to produce a mixture which, when designed and tested in accordance with these specifications and methods outlined in Texas Highway Department Bulletin C-14, shall have the following laboratory density and stability:

If the mixture produced does not have the specified qualities, it shall be changed until it does.

MATERIALS:

Mineral Aggregate: The mineral aggregate shall be composed of a course aggregate and a fine aggregate. Samples of coarse aggregate and fine aggregate shall be submitted in accordance with the methods prescribed in “control of materials” of the standard specifications, and approval of both material and of the source of supply must be obtained from the Director of Street Services.

Course Aggregate: The coarse aggregate shall be that part of the aggregate retained on a No. 10 mesh sieve; shall consist of clean, tough, durable fragments of stone, or gravel, as hereinafter specified, of uniform quality throughout, it shall be practically free from clay, organic or other injuries matter occurring either free or as a coating on the aggregate. Material removed by decantation (test method Tex 217-F Part II) shall not be more than 2%. The coarse aggregate shall have an abrasion of not more than (40) when subject to the Los Angeles Abrasion Test (Test Method Tex 410-A).

Fine Aggregate: The fine aggregate shall be that part of the aggregate passing the No. 10 sieve and shall consist of sand, screenings or a combination thereof. Sand shall be composed of durable stone particles free from injurious foreign matter. Screenings shall be of the same of similar material as specified for coarse aggregate. The plasticity index of that part of the fine aggregate passing the No. 40 sieve shall be not more than 6 when tested by Test Method Tex 106-E.

Mineral Filler: The mineral filler shall consist of thoroughly dry stone dust, slate dust, Portland cement, or other mineral dust approved by the Director of Street Services. The mineral filler shall be free from foreign and other injurious matter. When tested by Test Method Tex 200-F (dry sieve analysis) it shall meet the following grading requirements:

Passing a 30 mesh sieve 95 – 100%

Passing a No. 80 sieve, not less than 75%

Passing a 200 mesh sieve, not less than 55%

ASPHALTIC MATERIAL:

Paving Mixture: Asphalt for the paving mixture shall be of the types of asphalt cement or oil asphalt as determined by the engineer and shall meet the City of Dallas Specification PA-3416-5436-77 requirements of Asphalt, Additives, and Emulsions.

The grade of asphalt used shall be as designated by the Director of Street Services after design tests have been made using the mineral aggregates that are to be used in the project, and the various grades of asphalt. If more than one type of asphaltic concrete mixture is specified for the project, only one grade of asphalt will be required for all types of mixtures, unless otherwise shown.

PAVING MIXTURES:

Types: The paving mixtures shall consist of a uniform mixture of coarse aggregate, fine aggregate, and asphaltic material. The grading of each constituent of the mineral aggregate shall be such as to produce when properly proportioned, a mixture, which, when tested in accordance with test method Tex 200-F (dry sieve analysis), will conform to the limitations for master grading given below for the type specified. The exact grading of the aggregate and the asphalt content to be used in these mixtures, within the limits specified, will be designated by the Director of Street Services.

The asphaltic material shall form from 4.8 to 8.0 percent of the mixture by weight.

TOLERANCES:

The Engineer will designate the exact grading of the aggregate and asphalt content within the above limits, to be used in the mixture. The paving mixture produced should not vary from the designated grading and asphalt content by more than the tolerances allowed herein; however, the mixture produced shall conform to the limitations for master grading specified above.

Should the mixture produced vary from the designated grading and asphalt content by more than the above tolerances, proper changes are to be made until it is within these tolerances.

EXTRACTION TESTS:

When required by the Engineer, samples of the asphalt mixture may be taken from the plant, trucks or finished pavement for check tests. The minimum weight of the test specimen in grams shall be 3000 times the maximum size of aggregate in inches, and when tested in accordance with A.S.T.M designation D762, it shall not vary from the grading proportions specified, except that the bituminous material shall be not less than 4.0% nor more than 7.5%.

STRIPPING TESTS:

Immediately after mixing, the mixture shall meet the requirements of A.S.T.M. 1664 whereby not more than 5% of the particles shall remain uncoated.

TRANSPORTING:

This material shall be transported from the plant to the designed stockpile in tight vehicles with metal bottoms previously cleaned of all foreign substance.

REJECTION:

The cold patch material may be rejected for failure to meet any of the requirements of this specification.
