ARCHITECTURAL AUTHORITY

The Architectural Review Committee (ARC) is established as a requirement of the Association’s DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS. If you do not have a copy of the DECLARATION, please request a copy from management.

In a planned community such as Wynston, the question naturally arises as how to maintain a harmonious, quality development as the community matures. The following Guidelines attempt to provide a meeting ground between private interests and the broader interest of the Wynston community.

The Covenants run with the land and are binding on all homeowners and renters and should be fully understood. The fact that each homeowner is subject to these Covenants should assure all homeowners that the standards of design quality would be maintained enhancing the community's overall environment and protecting property values.

ARCHITECTURAL GUIDELINES

Please retain these Guidelines as part of your permanent papers. You should make these Guidelines available to any renters of your home.

Please read and follow these Guidelines. You MUST obtain approval IN WRITING from the ARC BEFORE the start of any exterior change. The ARC is allowed up to 30 days to act on an application. Therefore, do NOT commit labor or materials until you have received written approval. If you begin work before approval is given, there will be a $25 fine.

There are three major categories of items for specific home improvement guidelines. These three are very important to you because they identify which improvements are permitted and how approvals can be secured. Items not specifically mentioned here require approval.

CATEGORY 1: BLANKET APPROVALS

Items in this category do not require approval provided the guidelines mentioned are followed.

• Plants, shrubs and flowers planted within three feet of the front of your house, not to grow higher than the lowest portion of the windows.

• Bedding borders, if constructed of common landscaping borders not to exceed 8 inches in height.

• Plantings of flowers and shrubs around trees and mailbox post. No artificial flowers or plants are allowed.

• Hose caddies affixed to the home and portables must be maintained on side and/or rear of home.

• Outside seasonal decorations, displayed up to three weeks before or after the holiday season.

• Vegetables gardening in rear yards provided the plants do not exceed allowed fence heights or grow through to the neighbor’s yard.

• Repainting or re-siding your house in its original color.

• Lawn furniture exposed to the elements, barbecue equipment, toys, bikes, etc., if kept in good repair. These must be stored within the rear area. These items must not be visible from the street when not in use.

• Attic turbines, if they are mounted on the rear of the house roof, extend no higher than the roof peak, and are no more than 12” above the roof surface.

• Mail boxes, if repainted or replaced in the original color of black.

• Mailbox posts, if painted white or replaced with white vinyl, in the same style as original mailbox post. Brass numbers should be visible on the post.

• Flags on outside affixed to home - maximum size of 3’x5’; affixed to mailbox post – maximum size of 11”x17”. Types of flags are limited to religion, sports, seasonal, country. (2 flag maximum).

• Front storm doors must be white or the same color as your existing trim, “full view” design, and the glass must be clear color. Smoked glass, stained glass, or other variation doors must be approved in advance.

CATEGORY 2: COMMON IMPROVEMENTS

Items in this category require approval. An application must be submitted and meet these guidelines. Approval is likely for:

Exterior painting, if:

• You are painting within the same family of colors. Any color change requires approval. You should specify the type and color of paint you will use and include a color sample from the store.

Exterior Facade, if:

• You are refurbishing the façade (siding, trim) within the same family of colors and building materials (no approval is required.) You should specify the type and color of the siding/trim you will use, and include a color sample from the store if you are changing the building materials itself.

Patios and/or decks, if:

• They will not extend beyond the side corners of the house.

• They will pose no drainage problems for you or your neighbors.

• The materials to be used are designed specifically for patio and/or deck designs.

• They are neutral in color.

Satellite dishes, if:

• No more than one meter (39”) in diameter, with hidden cable.

• If placement is necessary in the side yard or front yard (documentation from the satellite company must be provided), screening of satellite dish is necessary after approval from the ARC is obtained.

• Location MUST be approved by committee.

CATEGORY2: COMMON IMPROVEMENTS (CONT’D)

Fences, if:

• They enclose all or part of the back yard, and extend on any Lot no closer than center point of home.

• Maximum height 6 foot privacy fence, maximum height of 4 foot for picket fences. Any other designs must be approved in advance – 6 ft high maximum.

• Fences must be maintained and free of defects. A 15-day grace period is given to repair fences.

• Weatherproofing stain (clear or other) required within the first year of installation.

• Fences may be vinyl, but white colored only. No chain link fences.

• Must meet all requirements of the zoning ordinances and requirements of the Town. A permit must be obtained from the town of Clayton.

Storage Sheds, if:

• They are no larger than 12’ x 14’ in diameter and 10’ at the roof’s peak.

• They are constructed of wood and/or vinyl.

• They are placed on the property behind your home so the shed can not be seen from the road in front of the house.

• Shed may be placed on left or right rear corner of lot, if 6’ privacy fence is installed.

• They must be at least 3 feet from the neighboring property.

• They must be screened from adjacent properties and from street view. The street view in this case would be for lots that cannot properly screen the shed by simply placing shed behind home.

• Siding material must be similar in color and composition to the home.

• Roof must have similar pitch, similar materials and similar color as that of the home.

Light Fixtures, if:

• Exterior light fixtures are replaced with a fixture of similar size and color.

Clotheslines, if:

• Any clotheslines must be erected behind the house.

• Permission is obtained from neighbors who have direct line of sight from their yard to the clothesline.

• No overnight drying. Items must be removed from the clothesline by dark.

• Umbrella style poles must be closed at night.

CATEGORY 3: SPECIAL IMPROVEMENTS

Items in this category include fireplace chimneys, window or door changes, landscaping changes, brick or foundation painting, or other special and major improvements to a home.

These require submission of a standard Architectural Review Committee application for improvement, including complete plans and specifications. The proposed changes and improvements must conform to our community standards and guidelines and to those of the city.

Architectural Review Committee approval does not substitute for approval by the city. These requirements do not in any way mean that these types of changes will not be approved. However, a complete record of all changes must be maintained to ensure that we are acting in the community’s best interests.

APPEARANCE STANDARDS *

• Paint and stain must be maintained in uniform and good repair (with no peeling, chipping, cracking, or discoloration) on the trim or siding. The same applies to mailbox posts.

• Lawns must be well kept with uniform ground coverage. Grass should be kept no more than 4” high. The designated lawn area should be fully covered with grass. Any brown or bare patches should be repaired during the spring or fall seeding season. Dead trees and shrubs must be removed and replaced with plantings of similar size and shape.

• No items (toys, bikes, garden equipment, trash containers, chairs, wood, etc.) may be left in front or side yards.

• No temporary basketball goals may be left in front or side yards when not in use. If the basketball goal is not permanently mounted into the ground (prior approval required) the goal must be removed from front or side yards and placed out of sight when not in use. Basketball goals must be maintained in good condition. They may NOT be attached to the house.

• No parking vehicles on lawns or common areas.

• No parking boats, trailers or campers in driveway. No parking these items on lots without screening from the street.

• The planting of any additional trees in the front yard must be approved. Any trees that die must be replaced.

• Properties should be free of any debris.

• Damaged window treatments that face street view must be repaired or replaced. A 7 day grace period will be given on repairs/replacements. Window treatment external view must be of neutral color.

• No fans are to be placed in windows that are located in front or side of home.

• Any changes to exterior doors that are visible from the street in front of the house (such as additions or design changes) must be approved by the committee.

• Installation of awnings must be approved by the committee.

• No mobile house trailer (whether on or off wheels), vehicle or enclosed body type vehicle (known as “campers”).

• Trash storage needs to be screened from the road. Materials for screening trash containers on side of home must be approved if non-natural. Trash cans and recycling cans must be screened from the front road year round.

• Vegetable gardens are allowed in back yard only.

• No commercial truck, commercial bus, or other commercial vehicle of any kind may be kept or parked overnight upon any portion of the properties.

o Commercial vehicles are defined as vehicles with dual tires or axles used for work.

o Vehicles displaying commercial or weighted plates used for work.

o Trucks or vans with racks, generators, etc. on it including objects attached to the top of the vehicles.

o Vehicles with more than 1 logo on each side or with a logo larger than 2’x3’ and vehicles with logos on the front, back, or top.

o Vehicles stored completely inside the garage will be allowed.

• Automotive repairs may be made inside of garages. Repairs outside the garage must be completed within a 24 hour period (no exceptions). Proper cleanup is required.

• No signage shall be placed or allowed upon any common area in the community. Political and real estate signs of appropriate size may be placed in any individual’s yard. Open House Real Estate sign will be allowed to be displayed on common areas ONLY during the open house hours and must be removed immediately after.

* -- These standards are in addition to any listed in the Declaration of Covenants.

ARCHITECTURAL COMMITTEE GUIDELINES

• The committee consists of a chairperson and at least three members who have been appointed by the board of directors. The liaison (a member of the board of directors) will serve as an interface between the committee and the board of directors.

• The committee will review all requests from homeowners regarding additions, fences, sheds, trees, etc. and vote on the requests. For the homeowner to proceed there must be a majority in favor vote from the committee. Any variation in votes by the committee could result in having the request sent to the board of directors for a decision. If an ARC member has a request, the request will go to the board of directors for approval.

• The committee or any homeowner may report violations of ARC guidelines to the management company. The management will include violations on the monthly report.

• The committee will meet monthly. The chairperson will notify the committee of the date, place, and time.

• The chairperson will make maintain all paperwork along with the management company.

• The chairperson will contact the board liaison of any issues that must be addressed with the board officers.

• Minutes from monthly meetings will be emailed to committee members and the board of directors.

• Committee members that miss two regularly scheduled meetings without notifying the chairperson will be dropped from the committee.

• Homeowners requesting to be on the committee must have no violations and must be current with dues. An application must be completed and approved by the board of directors.

• Committee member terms are a minimum of one year of service.

• Committee members must have a computer in order to communicate with other members.

• The management company will do a monthly drive-through to check for violations and for follow-up on letters that were sent to homeowners in violation. The homeowner’s violation status will be noted in a log. The log will be emailed to the ARC chairperson and board liaison for review and follow-up. If another letter is necessary, the management company will mail the letter. The management company will schedule any hearings for the board of directors after two or more violations of the same offense.

• If the home in violation is rental property, the owner will be sent a letter.

• ARC process:

ARC request by computer or mail to management company

Chairperson contacts committee members by email or meeting

Committee approves, denies, or sends to board for approval

Management company informs homeowner of result by letter

❖ Fences MUST be stained/waterproofed within one (1) year. Additionally, the smooth side of the fence must face out.

❖ Major improvements such as pools, additions, etc. require a neighbor’s signature on the plot map.

I understand that this application will be reviewed by the Board of Directors (or its Architectural Committee). I further understand that the Board of Directors (or its Architectural Committee) has the authority to approve, approve with conditions or deny this request and that there is no appeal other than resubmission of a modified request. I further understand that the placement and design of my improvement must meet the architectural guidelines, regardless of my submission or errant approval of such submission. A variance from standards must be noted by the committee in the comments section below. Please note the Board/Committee is allowed up to 30 days to render a decision.

Disclaimer. The Association reviews applications primarily based upon aesthetic qualities and to a lesser degree, basic construction practices. Owners (and their contractors) are responsible for determining and ensuring that all applicable municipality, county and state requirements are met and all necessary permits, variances, etc. are obtained. Should the requirements set forth by the municipality, county and state be more stringent/restrictive than those established by the Association, the more stringent/restrictive requirements prevail.
