NOTICE OF SALE – Star Trans Mini Busses

The County of Fresno, General Services, Purchasing (hereinafter referred to as “County”) will be selling two (2) 1999 Star Trans Mini Busses, Vehicle ID #2646 and #2647, (as is and where is) currently located at 4525 E. Hamilton Ave. Fresno, CA 93702-4599.

The two (2) Mini Buses were purchased new by the County in September 1999 for use by the County Public Health Department and retired from service at the conclusion of the program.

Prospective bidders may walk through and inspect the Mini Buses by appointment only, no later than September 24, 2010. Contact Shannon W. Kirby at (559) 456-7110 for appointment. See the attached map for location. Bids for one or both of the vehicles must be completed on the attached “Purchase Offer” form and must be submitted with a completed “Disclaimer of Warranties and Liability” form attached, no later than Thursday, September 23, 2010 at 2:00 P.M. to:

Submit in a sealed container per instructions stated under the Conditions of Sale section.

FAXED BIDS WILL NOT BE ACCEPTED

You may contact Shannon W. Kirby at (559) 456-7110 if you have any questions or require additional forms. The highest bidder will be notified by October 5, 2010 at 2:00 p.m. In the event of an identical bid between a tax-based entity and private industry, the bid will be awarded to the tax based entity. Payment must be submitted in full by cashier’s check to the above address no later than October 8, 2010 at 2:00 p.m. The vehicle(s) must be removed no later than October 15, 2010 at 2:00 p.m., or as mutually agreed upon in writing by the County and the Buyer.

CONDITIONS OF SALE

All bids shall remain firm for thirty (30) calendar days after the bid due date.

The Vehicle(s) will not be released until payment in full has been received at the address noted on the Notice of Sale. Should the Buyer not pick up the Vehicle(s) within the time period identified on the Notice of Sale, the Buyer’s rights and claims to the Vehicle(s) shall be forfeited to the County at the County’s option.

Any and all costs for transportation, handling, loading, inspection, etc. of the Vehicle(s) are the full responsibility of the Buyer, at the Buyer’s sole cost and expense. The successful bidder shall assume full responsibility and all liability associated with the removal of the Vehicle(s) and will hold the County, its officers, agents, servants and employees harmless from liability of any nature or kind in regard to this sale.

The Buyer shall pay to the County, California State Sales Tax in the amount of 8.975% of the total purchase. Sales Tax will not be assessed when the Buyer holds a valid California Resale Certificate with bid; form attached, complete and submit with bid if applicable.

The County does not guarantee the condition of the Vehicle(s), appliances and fixtures, and the Vehicle is not subject to return or refund.

The County reserves the right to reject any or all bids and to waive any informality in a bid.

Bidders are to read, understand, complete and return with their bid, the attached Disclaimer of Warranties and Liability.

Buyer shall save and hold harmless the County, its officers, and employees from liability for any damages arising out of the performance of this agreement.

By submitting a bid the bidder agrees to the following conditions. These conditions will apply to all subsequent purchases based on this bid.

1. SUBMITTING BIDS:

A) Each bid must be submitted on forms provided in a sealed envelope/package with bid number and closing date and time on the outside of the envelope/package.

B) Interpretation: Should any discrepancies or omissions be found in the bid conditions, or any doubt as to their meaning, the bidder shall notify the Buyer in writing at once. The County shall not be held responsible for verbal interpretations. Questions regarding the bid must be received by Purchasing at least five (5) working days before bid opening.

C) ISSUING AGENT/AUTHORIZED CONTACT: This Notice of Sale has been issued by County of Fresno, Purchasing. Purchasing shall be the vendor’s sole point of contact with regard to the Notice of Sale, its content, and all issues concerning it.

All communication regarding this Notice of Sale shall be directed to an authorized representative of County Purchasing. The specific buyer managing this Notice of Sale is identified on the cover page, along with his or her telephone number, and he or she should be the primary point of contact for discussions or information pertaining to the Notice of Sale. Contact with any other County representative, including elected officials, for the purpose of discussing this Notice of Sale, its content, or any other issue concerning it, is prohibited unless authorized by Purchasing. Violation of this clause, by the vendor having unauthorized contact (verbally or in writing) with such other County representatives, may constitute grounds for rejection by Purchasing of the vendor’s quotation.

D) Bids received after the closing time will NOT be considered.

DISCLAIMER OF WARRANTIES AND LIABILITY

Buyer acknowledges and agrees that the items being offered under this County of Fresno sale by the County of Fresno at 4525 E Hamilton, Fresno, CA 93702. Buyer has inspected the equipment and Seller has disclosed to Buyer all known defects or faults of this equipment made known to Buyer by Seller to any person to whom Buyer conveys use or possession of this equipment. This equipment is sold subject to NO WARRANTY from Seller to Buyer, nor to any of Buyer's employees, agents, or transferees, and Buyer purchases this equipment in its present condition, as is, with all faults, obvious and latent, as may be discovered at the time of this sale or subsequently. Seller disclaims all liability for damages or injuries caused by this equipment while this equipment is in Buyer's use and possession or after Buyer has conveyed it to subsequent purchasers, lessors or users. Buyer agrees to indemnify and hold harmless Seller for any liability, demands or claims arising because of injuries or damages caused by this equipment, and Buyer agrees to include a provision in any future agreement conveying this equipment which states, “Buyer (or Lessee, Licensee, etc., as appropriate)” agrees to indemnify and hold harmless the County of Fresno for any liability, demands or claims arising because of injuries or damages caused by the equipment which is the subject of this agreement.
