INSTRUCTIONS

A copy of this Notice of Motion and Motion to Expunge an Eviction Case must be served on the opposing side, who has a right to appear and argue against the Expungement. This Motion must be served a minimum of 10 (ten) days before the hearing. Obtain the hearing date from the Housing Court Office (Room 170, Ramsey County Courthouse, 15 West Kellogg Blvd, downtown St. Paul, MN, 55102). This original form and an Affidavit of Service proving that the service was made on the opposing party must be filed with the Court at least 3 (three) business days before the hearing. If these documents are not filed, the hearing will be cancelled. If you have not yet paid a filing fee, you must pay a filing fee of $320.00 to file these documents. Remember, you must show:

1) That the landlord’s case was without sufficient basis in law or fact;

2) That expungement is clearly in the interests of justice, and

3) Those interests are not outweighed by the public’s interest in knowing about the record.

Court clerks cannot give you legal advice or tell you what to say on these forms.

NOTICE
