Motion carried by unanimous vote.REPORT OF THE STATE FIRE MARSHALINFORMATIONAL ITEMSPersonnel ItemsFire Marshal Ingle introduced Michael P. Pfaffenhauser, Deputy Fire Marshal I. He will be assigned to the Sussex County division. Deputy Attorney General Davis-Oliva performed the Oath for Deputy Pfaffenhauser and he was welcomed by the Commission. He is the current Fire Chief of Slaughters Beach Fire Company, has an electrical background and will be an asset to the agency. He has been assigned to Deputy John Galaska as his Field Training Officer. He will begin the Delaware State Police Academy on September 14th. Fire Marshal Ingle introduced William C. Kelly, II Fire Protection Specialist I to the Commission. He will be assigned to the Sussex County division. He comes with a fire service background, Captain at the Dover Fire Department and a NFPA Fire Inspector I.SFPC MinutesAugust 18, 2015Page 3Personnel Items cont.Fire Marshal Ingle received a letter stating Deputy Fire Marshal II Tate Coulbourn resigned his position as of August the 5th. This will leave a vacant Sussex County Deputy Fire Marshal position. It was moved by Vice Chairman Robinson, seconded by Commissioner Marvel to authorize Fire Marshal Ingle to move forward on the hiring process for the vacant Deputy position.Stacy Beckner, Administrative Specialist I in Sussex County has obtained 10 years of state service. Fire Marshal Ingle stated that she is an asset to the agency. State Fire Marshal Grover P. Ingle has obtained 25 years of state service. Commissioner Dicristofaro commented that Fire Marshal Ingle failed to recognize his 25 years of service during his report and wanted to take a moment to thank him for his dedication and commitment to his agency and staff. Chairman Roberts presented Fire Marshal Ingle with a State of Delaware Certificate of Service and 25 year pin from himself and Governor Jack Markell. It was presented in appreciation for his 25 years of faithful service to the people of Delaware.It was moved by Commissioner Dicristofaro, seconded by Commissioner Truitt to send letters of appreciation to Stacy Beckner and Fire Marshal Ingle. Motion carried by a unanimous vote.Scott Walker, Deputy Fire Marshal III will be out on extended medical leave as the result of an off the job injury for six weeks.HB 133 Residential Sprinklers Proposed LegislationFire Marshal Ingle updated the Commission on the bill signing of House Bill133 on August 6th that was sponsored by Representatives Osienski, Heffernan, Johnson, Keeley, Kowalko, Short and Senator Ennis. This bill requires builders of new, one or two family residential dwellings that are 3 stories or less to provide to the purchasers a cost estimate from the builder for an automatic sprinkler system, as well as information from the State Fire Marshal’s Office about the benefits of such a system. Fire Marshal Ingle is in the process of scheduling a meeting with the home builders to review the concerns they may have. Fire Marshal Ingle will be contacting the Home Fire Sprinkler Coalition to see if the brochures can be modified or if they are used with all the information contained in the brochure. Fire Marshal has concerns about listing pricing of the system. The brochure will be completed before January 1st.SFPC MinutesAugust 18, 2015Page 4Annual ReportFire Marshal Ingle reported that the agency Annual Report will be completed and distributed by September 1, 2015.Delaware JunctionFire Marshal Ingle reported that his staff was involved prior to the event making sure that everything was set up and compliant with code. No reports of issues were received from the Office of State Fire Marshal’s perspective duties pertaining to the event.Delaware Burn CampThe Delaware Burn Camp ran from August 10th – 15th. At its conclusion, Fire Marshal Ingle and Chairman Roberts attended events. The camp appears to be growing with each year that passes and is doing fairly well. It is the same number of participants as in years past, but you can see the growth and accomplishments being made. It is a great thing and a very worthwhile program. The benefits are apparent. Fire Marshal Ingle assigned Brian Ferguson to work as well as appointed to the Burn Camp Board of Directors per the statute. Fire Marshal Ingle received good comments about his interaction with the children and is glad that this assignment has worked out well. It is hoped that he will stay involved with the program.DTI UpdateFire Marshal Ingle reported that DTI continues to move forward with the necessary upgrades for the Office of State Fire Marshal technology and equipment. Training is being done today for the phone system in New Castle County. The system is scheduled to go live on August 20, 2015. Sussex County will repeat the same training on August 25th and the go live date for the new phone system will be August 27, 2015. The agency continues to work with Anthony Spiezio, System Control Specialist of DTI with respect to file access and securities. Anthony has been an asset working with the agencies.SFPC MinutesAugust 18, 2015Page 5FY17 BudgetFire Marshal Ingle reported that the FY17 Target Budget meeting has been scheduled for September 11th. He has submitted the agency door openers to the Office of Management and Budget. His request is to finish up the lease funding for the law enforcement vehicles.Major IncidentFire Marshal Ingle updated the Commission on current investigations and a major incident that took place at a vacant structure in Oceanview. The Fire School will be adding Fire Officer III and IV certifications by December 2015.Door Opener budget submittal was provided to the Office of Management and Budget on August 13th. One Year – Long Range Report 2014-2015 – Director Newnam stated that the report shows how much the staff was able to accomplish in the last year. One Year – Long Range Report 2015-2016 – Director Newnam provided the Commission with a proposed Long Range One-Year Plan. A lot of maintenance improvements are in this plan. Renewed through June 30, 2017 to operate as a BLS facility by AHA Budget Target Meeting – September 11th EMT programs – maintaining costs without meals at 136,059.00New Castle Division expansion project has been delayed due to an issue with being considered within a flood plain. Director Newnam has a conference call scheduled for today with Facilities Management and Landmark Engineering to discuss the concerns. They will have to go before the New Castle County Board of Adjustments for a decision. There is a question as to if there should have been an exemption in the Bond Bill which did not take place. Engine purchase – statusCar fire props ordered for the New Castle and Kent Divisions National Fire Academy – Delaware Weekend – November 6-7-8Fuel storage tank State inspection – passed 3 year permit – DNREC will send a letter to verify.Director Newnam addressed student attendance in 2015 there were 22,648 students that passed through the Delaware State Fire School for training. That figure is down by approximately 260 students, but the last three years are the highest numbers ever at the school. The Industrial Classes numbers are up. There were 1,866 that came through this past year. That is the highest number since 2008.Room rentals are up in the building. Mr. Miller was introduced to the Commission and welcomed.BLS MEDICAL DIRECTORNo report submitted.REPORT OF THE INVESTIGATOR/COMPLIANCE OFFICERIn July, Mr. Truax conducted 24 annual ambulance unit inspections. Out of those inspections, one was a new unit at A.I. Dupont. Report of the Investigator/Compliance Officer cont.Case #1419 and #1502 are being rescheduled for the September meeting. Case #1503 is with regard to TransCare leaving the state. Vice President Earl Kossuth informed the Commission that TransCare’s contract was complete with the VA Medical Center effective July 27, 2015. All TransCare vehicles have been removed from the state of Delaware and returned to the Conshohocken, PA operation. Mr. Truax recommended closure on this case because they have met the requirements made of them by the Commission in March, 2015.Case #1507 has been investigated and the findings have been turned over to the Attorney General’s Office. Sufficient evidence for a hearing has been found and Mr. Truax requested approval to schedule this case for a hearing as the calendar permits. It was moved by Commissioner Dicristofaro, seconded by Vice Chairman Robinson to accept the Investigators report, in closing cases 1503 and setting up 1507 for a hearing. Motion carried by a unanimous vote.There are 2 cases that remain pending for 2014 and 5 pending in 2015.SFPC MinutesAugust 18, 2015Page 11REPORT OF THE INVESTIGATOR/COMPLIANCE OFFICER cont.Chairman Roberts asked if the Delmar case is coming before the Commission in the near future. Mr. Truax stated that a meeting should be scheduled in September at the Office of Emergency Medical Services. The Attorney General’s Office is setting the meeting up. Chairman Roberts’s concern is that the case is not delayed any more than it has already been delayed and a resolution is reached. Chairman Roberts stated that he will work with OEMS to make sure someone is available for the meeting and keep the case moving.REPORT OF DEPUTY ATTORNEY GENERALDeputy Attorney General Davis-Oliva reported on the upcoming dates and hearing information for the regulation hearing in September, 2015.A new lawsuit that was received this week, initiated in District Court within the state of Delaware against the Office of the State Fire Marshal. It is arising from an investigation where charges were ultimately dropped. The Office of the State Fire Marshal and one of the Deputies is named in his individual capacity in the lawsuit. DAG Davis-Oliva is working with the Attorney General’s defense group working toward defending this case.DAG Davis-Oliva has worked with DelDOT to determine where the red light camera funds have been distributed. The funds were located and will be directly passed through to the Commission in the future. REGULAR BUSINESSAction ItemsDagsboro/Millsboro Boundary Hearing 10:00 AMDeputy Attorney General opened a hearing between Dagsboro and Millsboro Fire Companies. The purpose of the hearing was not to hear testimony, but to discuss the question of the court as to why the Commission deviated from their 2007 decision. Dagsboro and Millsboro were represented by counsel and given time to make statements on behalf of their clients. The Commission entered and exited deliberation. It was moved by Chairman Roberts, seconded by Vice Chairman Robinson to accept the green line of (2014) agreed to in 2014. The Commission determined that the audit was considered late and an extension was never filed.
