Monthly Board Meeting - Minutes

April 30, 2019

The meeting was called to order at 7:05 pm, by Chairperson Theresa Scavo. The Pledge of Allegiance was recited. Chair Scavo asked that the audience remain standing for a moment of silence to acknowledge the innocent lives lost in the bombings of Sri Lanka and the shootings in California.

PUBLIC HEARING:

Chairperson Scavo introduced Mr. Ronnie Tawil, Co-Chair of the Zoning Committee who would run this part of the meeting:

Mr. Tawil explained the procedure for the Public Hearing and proceeded to call the representative for the first item on the Agenda:

BSA Cal. No. 2019-39-BZ / 2311 East 4th Street

East side of East 4th Street between Gravesend Neck Road and Avenue W

This application is filed pursuant to ZR 73-622 of the Zoning Resolution of the City of New York, as amended to request a special permit to allow the enlargement of an existing single family residence located in a residential (R4) zoning district in the Special Ocean Parkway District.

Questions from the floor were raised regarding: overall height of completed building, will there be parking, side yard waiver.

The Board received 1 letter of objection.

A motion was made to approve by Robert Gevertzman and seconded by Al Smaldone.

A Committee Vote was taken. 12 yes, 0 no. The motion passed.

Located between Avenue R and Avenue S

This application is filed pursuant to ZR 73-622 of the Zoning Resolution of the City of New York, as amended to request a special permit to allow the enlargement of an existing single family residence located in a residential (R3-2) zoning district.

Questions from the floor were raised regarding: the fire from 2011, any construction going on now has DOB approval, the error on the second floor was corrected already and the rear yard is within guidelines.

A motion was made to approve by Robert Gevertzman and seconded by Al Smaldone.

A Committee Vote was taken. 14 yes, 0 no. The motion passed.

Located between Shore Parkway and Emmons Avenue

Special Permit pursuant to ZR 73-622 to authorize construction contrary to ZR 23-141 (b) FAR regulations/lot coverage; contrary to ZR-23-45 (a) front yard requirements.

Questions from the floor were raised: overall height, how many families will live here, how many parking spaces, front yard coverage and how many stories will the house have when completed.

A motion to approve was made by Robert Gevertzman and seconded by Ira Teper.

The Committee vote was 13 no, 1 yes, the motion did not pass.

BSA Cal. No. 2019-11 / 2811 Brown Street

Located between Shore Parkway and Emmons Avenue

Special Permit pursuant to ZR 73-622 to authorize construction contrary to ZR 23-141 (b) FAR regulations/lot coverage; contrary to ZR-23-45 (a) front yard requirements.

Questions from the floor: How high would the homes be after the flood plain was accounted for? 40 Feet was the answer. Will it be a one family or two family home? 2813 will be a two family home, 2811 a one family home. Is it the original owner prior to Superstorm Sandy that is building? The lawyer representing the properties answered he believed yes. Weren’t you rejected when initially seeking a variance for this property? He stated yes they were because they were looking for a larger change; they have modified that request as required by BSA. Are you combing the properties? The lawyer answered no they will remain two distinct properties. One of the properties was completely destroyed so how can you seek a special permit to modify a building that should rightfully be condemned? The lawyer admitting he wasn’t an architect but the architect for the project assured him they would be able to retain a good portion of the original house. When asked what the percentage of the original home they were retaining? He answered that he was unsure of the percentage amount.

Two neighbors residing on Brown Street, Joyce Arberman and Linda Bencivenga addressed the Board to share their strong objections to the two proposed Special Permits on Brown Street.

The Board office received 7 Letters of Objection for these proprieties.

A motion to approve was made by Robert Gevertzman and seconded by Mitchell Shpelfogel.

The Committee vote was 12 no, 2 yes. The motion did not pass.

BSA Cal. No. 2019-65-BZ / 373 Avenue W

Northside of Avenue W between East 1st Street and East 2nd Street

This application is filed pursuant to Section 73-622 of the Zoning Resolution of the City of New York, as amended to request a special permit to allow the conversion and enlargement of an existing two-story family residence to a single family residence in a residential (R4) zoning district in the Special Ocean Parkway District.

Questions from the floor were raised regarding: the new height, which was stated, will be in line with the house next door with a similar height, the driveway will remain intact.

The Board office received 4 Letters of Objection which were noted.

A motion to approve was made by Al Smaldone and seconded by Ira Teper, the vote was 13 yes, 1 no, and the motion was approved.

BSA Cal. No. 2019-67-BZ / 2781 Coyle Street

This application seeks a variance pursuant to ZR Section 72-21 to permit the development of a six-story, three-family residential building at the Premises, contrary to ZR Sections 23-22 (min. lot area), 23-45 (front yard) and 23-631 (street wall, setback and total height).

Questions from the floor were raised regarding: Is this a six floor walk-up? Yes the representing attorney answered. Where will they park? The entrance would be on Coyle Street for 3 cars. Isn’t this property located in front of a bus stop? Yes, but they would not change the bus stop.

The Board office received 0 letters of objection.

A motion to approve was made by Al Smaldone and seconded by Mitchell Sphelfogel, the vote was 5 yes, 9 no, and the motion did not pass.

Topics Discussed:

Stanley Kaplan discussed the need to dredge the bay. Emergency fire boats and the existing Fishing Boats of Sheepshead Bay, now have to wait for high tide to be able to navigate into the Bay. The sand dredged could be used to fill in areas such as plumb beach to combat erosion. Something needs to be done and soon. He stated Congresswoman Yvette Clarke showed an interest in helping, but she doesn’t serve on the right committees. He stated we all need to reach out to our elected officials to take action.

Martin Gangursky complained about gentrification’s effect on businesses in the area. He encouraged the audience to patronize local stores to keep them viable and in business. He mentioned Bay Fest, taking place on May 19th and invited everyone to attend.

Ed Jaworski, President of Madison Marine Homecrest, spoke of neighborhood character and was pleased the Zoning Committee voted down 3 of the BSA’s before it because they appeared unsuitable for the community.

Mr. Jahi Rose of the Civilian Complaint Review Board spoke about how the CCRB independently will accept and investigate complaints against the New York Police Department’s officers. He gave an example of some of the four criteria they will look into, if you are stopped by a police officer: did they use excessive force, was the officer abusive, discourteous or use inappropriate, racially biased language. Mr. Rose would like to educate the public on their rights and would welcome the opportunity to visit with young people, neighborhood groups and community organization and provided his cell phone number to set up a presentation 917 208-9320.

Eric Kumar sent greeting from District Attorney Eric Gonzalez’ Office and provided copies of his latest Justice News on the back table.

Leah Moses, representing Councilman Treyger’s office, spoke of three events the Councilman is sponsoring, May 4 at 10:00am a rain barrel give-a-way in Bensonhurst, May 11th, at 12:00pm free bike helmets at the Marlboro Projects Playground and May 13th, 7:00pm a Victory Day Celebration at the JCH of Bensonhurst.

Reeves Eisen representing State Senator Andrew Gounardes stated that the Senator will have a mobile office at the Gerritsen Beach Library on Mondays 3:00pm-6:00pm and Thursdays 2:00pm-5:00pm. He will appear from time to time on Thursdays there, if his schedule allows, because on Mondays he is up in Albany. He has also worked to pass 13 environmental bills, for clean air, clean water, too numerous to go into great detail tonight.

Lew Fidler, of the Brooklyn Borough President’s office sent greetings from the Borough President, stated he would be in the back for anyone needing to speak with him and on a personal note was pleased the Board voted down the most ridiculous BSA proposal he has every heard for Coyle Street.

Mariyah Markh announced she will now be working with the Mayor’s Community Affairs Unit alongside our liaison Daniel Abramson.

Jack Plushnick representing Councilman Chaim Deutsch discussed that the Councilman will be hosting a Health Fair at the Shorefront Y, 3300 Coney Island Avenue on May 7th from 6:00pm-8:00pm.

EXECUTIVE SESSION:

A Roll Call Attendance was taken by Allen Popper, Secretary; with a Quorum present, Chair Scavo asked for a motion to adopt the Minutes of the General Board Meeting on March 26, 2019.

A motion to adopt the minutes was made by Howard Katz and seconded by Al Smaldone.

COMMITTEE REPORTS:

Commemorative Street Co-Naming Committee

Rabbi Melvin Burg, Chairperson for the Committee, stated that the Committee met earlier in the evening and felt the two proposals brought before the Board for “Penny Lane” at the corner of West 2nd Street and Avenue X for Pandora (Penny) Barbaro and “Hon. Steve C. Arniotes Way” at the corner of East 18th Street and Avenue P, did not meet the criteria set forth by the Community Board and City Council and were not approved by the committee.

A motion to approve was made by Robert Gevertzman and seconded by Pearl Siegelman, by a show of hands, both Street-Co-Naming proposals were unanimously voted on to “not” approve either request.

Health Committee

Jay Lieberman, Chair of the Health Committee, spoke about the guest speakers the Health Committee had arranged for; sighting the insightful look we had into addiction by Dynamite Youth earlier in the year and the upcoming talk in June with Dr. Goldberg from Coney Island Hospital to address Mental Health Issues. He spoke of the upcoming warmer months and the need to prevent insect bites an illnesses caused by mosquitos, ticks and fleas. To kindly remove standing water from your property and use deet on yourself, your children and to protect your animals with veterinary approved products.

Public Safety Committee:

Chick Pallotta, Chair of the Public Safety Committee, stated that the Committee meeting was held at the 61st Police Precinct on Wednesday, April 10, 2019 at 6:30pm; representing the 61st Precinct was its Commanding Officer, Deputy Inspector James King, and it’s Executive Officer Captain Vitaliy Zelikov. Also in attendance from the 61st Precinct was Detective Sam Shaya and Police Officer Danny Chiu.

The commanding officer presented the CompStat report. Year-to-date crime complaints were down 1.7%.

Board Member Morris Harary requested a left hand turn signal at Coney Island Avenue and Kings Highway, Chair Scavo stated that the signal was already requested and approved. There is a work order which will be completed as soon as DOT is able.
