1. All applicants applying for Section 8 assistance must be given notice of the requirement to submit evidence of citizenship or eligible immigration status at the time of application.
2. All family members, regardless of age, must declare their citizenship or immigration status.
3. U.S. citizens must sign a declaration of citizenship.
4. Noncitizens must sign a Verification Consent Form and submit documentation of their status or sign a declaration that they do not claim to have eligible status.
5. If a noncitizen is age 62 and older then they only have to sign a declaration of eligible immigration status and provide a proof of age document.
6. A family/household with one or more ineligible family members and one or more eligible family members is considered a “mixed family” and may receive prorated assistance.
7. Noncitizen students with student Visas are not eligible for Section 8 assistance nor are any noncitizen family members who live with the student. If the noncitizen student is married to a U.S. citizen, the spouse or any citizen children are eligible for Section 8 assistance.
8. Management is responsible for administering the restriction on assistance to non-citizens in accordance with regulations. This means that all applicants must be treated equally in, applying the same noncitizen rule procedures without regard to race, color, national origin, sex, religion, disability, or familial status.
9. Most of the time, management has to consider citizenship/immigration status only once for each family unless the immigration status or family/household composition is likely to change (e.g., when a family/household member applies for a change in immigration status).
10. Management must determine the applicant’s citizenship or immigration status during the initial eligibility determination, prior to move-in.
11. Management must determine, as part of the annual or interim recertification process, the citizenship/ immigration status of any tenant whose documentation was not received or whose documentation suggested that their status was likely to change.
12. The family/household may request an interim recertification if the status of a family/household member in a mixed family/household changes from ineligible to eligible.
