REGULAR SESSION

September 12, 2017

The Lyman County Commissioners met in regular session in the Conference Room in the Courthouse at Kennebec, South Dakota, September 12, 2017, at 8:30 a.m. with the following members present: Chairman Steve Perry, Kim Halverson, Gary Diehm, Bill Lengkeek, Auditor Pam Michalek, and Deputy Auditor Debra Halverson.

CALL TO ORDER:

Chairman Perry called the meeting to order with the pledge to the flag.

ADOPT AGENDA:

Motion by Diehm, seconded by Halverson to adopt the agenda. All voting aye.

APPROVE MINUTES:

Motion by Lengkeek, seconded by Diehm to approve the minutes of August 22, 2017, for the regular commission meeting and the 5 Year Plan meeting. All voting aye.

AUDITOR’S ACCOUNT, ROD & CLERK OF COURTS FEE REPORTS:

Motion by Lengkeek, seconded by Halverson to approve the following August 2017 reports. All voting aye.

AUDITOR’S ACCOUNT: Cash on hand: $789.18; Checks in Treasurer’s possession less than 3 days old: $3,661.18; BankWest Checking: $19,697.08; BankWest Savings: $2,529,853.60; 1st Dakota Bank CD’s: $108,760.94; Dakota Prairie CD’s: $657,318.48 for a total of $3,320,080.46. General Fund: $1,431,445.65; Special Revenue Funds: Road & Bridge Assigned: $1,544,059.92; Secondary Road Restricted: $12,139.00; Highway & Bridge Reserve Restricted: $49,687.36; 911 Fund: $4,746.80; Fire: $85,597.36; Emergency Management: $11,945.93; Domestic Abuse: $345.00; Dissolved Townships: $40,235.96; 24/7 Sobriety: $15,497.04; Register of Deeds M&P: $28,525.95; Trust & Agency Funds: $95,854.49. CLERK OF COURTS FEES: (July) $3,374.80 retained by the County. $9,222.41 less $5,830.07 to Lyman School and $17.54 to Chamberlain School for fines.

BUILDING PERMITS:

Motion by Diehm, seconded by Halverson to approve a building permit submitted by Dakota Mill & Grain, Inc. for a new grain elevator to be located on NE¼SW¼ and NW¼SE¼ 12-105-77 and a side track to be located in the S½ of sections 11 and 12, 105-77. All voting aye.

OCTOBER MEETING DATES:

Motion by Halverson, seconded by Lengkeek to have regular Commission meetings October 10 & 24. All voting aye.

EMERGENCY MANAGEMENT AGREEMENT:

Motion by Halverson, seconded by Lengkeek to approve the 2018 Emergency Management State & Local Agreement with the Department of Public Safety. All voting aye.

4-H/EXTENSION OFFICE:

Motion by Diehm, seconded by Halverson to approve Gayle Mohr as part-time 4-H office personnel through SDSU Extension. All voting aye.

9:00 a.m. 2018 PROVISIONAL BUDGET HEARING:

Motion by Halverson, seconded by Lengkeek to approve the 2018 Provisional Budget. All voting aye.

HWY/WEED DEPT:

Supt. Walt Nagel and Noel Henriksen met with the Commission. Henriksen met to discuss the current condition of 226th St. from the highway into Jones County and 291st Ave. Supt. Nagel will check the roads and look into filling the low spot on 291st. Henriksen thanked the Commission and Supt. Nagel for discussing the roads before leaving the meeting. Supt. Nagel advised the Commission of a rotted out culvert on CO RD 07 in Iona Township. Motion by Diehm, seconded by Lengkeek to temporarily close 1 mile of road around the culvert while options are assessed. The County will begin pulling shoulders on Cooper School Rd from the highway to the Dude Ranch the week of Sept. 18th. Other discussion included: Medicine Creek Bridge replacement has begun, culvert replacement is almost finished on Ft. Hale Bottom, CO RD 11 and 19 had edges pulled, the possibility of purchasing a construction disc, two pickups and a snow plow from state surplus.

DAKOTA MILL & GRAIN INC:

Dave Cole met with the Commission to discuss the new grain facility and the Resolution for Allowing Temporary Road Closure. Motion by Halverson, seconded by Diehm to approve the following resolution. All voting aye.

RESOLUTION FOR ALLOWING TEMPORARY ROAD CLOSURE

BE IT HEREBY RESOLVED by the Lyman County Commissioners in regular session assembled, that Dakota Mill & Grain, Inc. shall be allowed to temporarily obstruct traffic at the railroad crossings on 307th and 308th Avenues in order to accommodate train loading operations upon the following conditions:

There must be rail cars present during any blockage of these crossings.

The siding operator must provide traffic barricades and signage at each crossing as approved by the County and the SD Dept. of Transportation.

The siding operator must name Lyman County as an additional insured on its liability insurance covering railroad operations and must file such proof of insurance with the County Auditor every year beginning January 1, 2018.

Highway Supt. Nagel discussed a grant that could help build up the road going to the facility to allow for heavier truck traffic. Nagel & Cole will work out details for the grant application. Cole left the meeting.

5 Year Highway Plan:

Motion by Lengkeek, seconded by Diehm to approve the 5 Year Highway Plan with the following corrections: addition of Wells Bridge to 2018 with all Local Funding and adjustments to total figures with this addition. All voting aye.

EXECUTIVE SESSION:

10:05 a.m. Motion by Halverson, seconded by Lengkeek to enter into executive session per SDCL 1-25-2 (1). All voting aye. 10:40 a.m. Director of Equalization Joya Jelinek was present.

11:15 a.m. Chairman Perry declared the board out of executive session.

ADJOURNMENT:

Motion by Diehm, seconded by Halverson to adjourn until September 26, 2017 at 8:30 a.m. All voting aye.
