YESEmployee Name:Effective Date:BASIC FUNCTION:Under supervision or general direction of the Assistant Chief Counsel, the Attorney I will work independently and in a team environment in the Health Policy Approval Bureau providing formal, informal, oral, and written legal advice to the Assistant Chief Counsel or Deputy Commissioner for Health Policy on a variety of issues pertaining to the implementation of federal and state health insurance law and review standard health insurance policy forms and other filings from health insurance companies involving individual, small group and large group major medical and specialized health; Medicare Supplement; student blanket health; and health insurance stop-loss. Exercise discretion or work independently, or as a project leader with attorneys, paralegals, and other staff. May provide training to other attorneys, paralegal staff, health specialists, and other units in the Department. Provides advice and counsel to the Deputy Commissioner for Health Policy and Reform, the Deputy Commissioner/Legislative Director, the Legislative Office, the Health Actuarial Office, and other bureaus within the Department. Advises regarding the Department’s rights, duties, and authority pertaining to health reform activities and public policy, current and pending legislation, and health insurance premium rates. Occasional travel may be required within and/or outside the state of California via private or public transportation (i.e., automobile, airplane, etc.). Travel may include overnight stay.This position is designated under the Conflict of Interest Code. The position is responsible for making or participating in the making of governmental decisions that may potentially have a material effect on personal financial interests. The appointee is required to complete Form 700 within 30 days of appointment. Failure to comply with the Conflict of Interest Code requirements may void the appointment.ESSENTIAL FUNCTIONS*45%Review of Health Insurance Policy Forms and ReportsWorks independently or in a team environment to review, research and make recommendations to approve or disapprove on behalf of the Department standard policy forms and reports submitted by health insurance companies, applying both state and federal law, as well as responding to questions or issues from the Health Actuarial Office, Consumer Services and MarketConduct Branch, and other Department units regarding the manner in which insurance contract language is implemented by insurance companies.20%Health Reform Implementation and Federal Health Insurance Oversight Assists the Health Reform Unit and Health Policy Approval Bureau in providing legal analysis and advice in the implementation of federal and state health insurance and health reform law. Provides legal assistance regarding federal and state rate review law in support of the operations of the Health Actuarial Office. Reviews, analyzes, and makes recommendations concerning issues pertaining to the federal oversight of health insurance and health reform.Researches and reviews federal regulatory proposals and current regulations to provide legal opinions, recommendations for state action, and assists senior attorneys or the Assistant Chief Counsel with drafting comments regarding those regulations for submission to federal agencies.15%Legislation and RegulationsAssists senior attorneys or the Assistant Chief Counsel with drafting state legislation or regulations; reviews and analyzes the impact and propriety of proposed health related state and federal legislation, particularly legislation related to implementation of federal health reform legislation; conducts legal research as needed; prepares memoranda detailing analysis and recommendations; reviews and analyzes the impact of adopted legislation on the Department, consumers, and industry; under supervision of the Assistant Chief Counsel, prepares cost analysis of proposed legislation; prepares initial statements of reasons; coordinates development of economic impact analyses with Department economists; prepares notices of public hearings for proposed regulations involving health insurance; consults with the Office of Administrative Law (“OAL”) regarding regulations; arranges for and participates in hearings on proposed legislation; reviews and responds to public comments; revises regulations and statements of reasons; prepares 15 and 45 day notices; prepares final draft of regulations and final statements of reasons; prepares submissions to OAL; analyzes and responds to OAL comments.10%Legal Opinions and Public Inquiry ResponsesPerforms legal research and provides opinions on general and less complex health insurance related matters for the Insurance Commissioner, Deputy Commissioner, Chief Counsel, Assistant Chief Counsel, and management of other divisions and bureaus of the Department. Occasionally responds to both general and legal correspondence and inquiries from the public regarding health insurance legal issues.MARGINAL FUNCTIONS5%State Health Insurance Company Oversight and Enforcement Assistance Under supervision of the Assistant Chief Counsel or with senior attorneys, provides legal guidance to and participates with Legal, Financial Surveillance, and Consumer Services & Market Conduct branches on regulatory issues and actions related licensing, mergers and acquisitions, and examination of health insurance companies.
