D(2018) ...Subject: Opinion on petition No 0607/2016 by Jorge Rodríguez Gómez (Spanish), on behalf of the Castilla la Mancha Union of Unions, on reductions in aid to organic agricultureDear Ms Wikstr?m,Thank you very much for your letter of 3 September 2018, with which you forwarded the above-mentioned petition to the Committee on Agriculture and Rural Development for its opinion.The petitioner complains that, in March 2016, the Ministry of Agriculture, Environment and Rural Development of Castilla la Mancha significantly reduced aid for organic farming in the region; this happened because the Ministry decided to change the regulatory bases for granting that aid which was funded by the European Agricultural Fund for Rural Development (AFRD) under the Rural Development Programme 2014-2020. According to the petitioner, the reductions varied between 29% and 67% and undermined the sustainability of several ecological crops, making it economically impossible to continue that organic farming. In addition, according to the petitioner, the Ministry took that decision with retroactive effect after the farmers concerned had made aid applications in the previous year (March 2015). The petitioner claims that the changes to the regulatory bases also affected the selection criteria for aid applications, thus removing the aid for 2 000 organic farmers who had been practising this form of agriculture for years. According to the petitioner, the removal of aid and the cuts for the rest of the sector would eventually force those farmers, for economic reasons, to convert their holdings to conventional farming, thus wasting 10 years’ worth of effort and public and private investment. In its reply to the petitioner of 31 January 2017, the Commission pointed out that the version of the Rural Development Programme (RDP) for Castilla-La Mancha for the period 2014-2020, as approved by Commission Decision C (2015) 7561 of 30 October 2015, was the only reference that the Commission can recognise as being valid with regard to this RDP. Moreover, the Commission underlined that the Castilla-La Mancha authorities had acted under their own responsibility when they first adopted the order of 24 March 2015 which established certain regulatory bases for granting subsidies with a view to implementing the organic farming measure. Importantly, that order contained a suspension clause making the granting of aid conditional on the RDP being approved in its final version. This fact, as the Commission claims, should have alerted potential beneficiaries to the fact that the amounts referred to in the RDP were not definitive. After this, the Ministry issued the order of 8 March 2016 which set the revised amounts of aid in line with the provisions of the RDP. The Commission claims that this is “neither exceptional nor at odds with the legislation. It corresponds to the choice made by the RDP managing authority with the aim of being able to approve a larger number of applications for a given budget”. Finally, the Commission notes an agreement reached on 11 April 2016 between the regional authorities and the main agricultural unions (all of whom are members of the programme’s monitoring committee), which aims to increase the level of support granted to organic farming. The AGRI Coordinators considered the issue raised in this petition at their meeting of 22 November 2018.Requests by Member States to amend Rural Development Programmes are approved in accordance with Regulation (EU) No 1305/2013 which, in its Article 11, stipulates that the managing authority of a RDP can request an amendment to it, possibly aimed at changing the amount of the aid, and that the Commission shall decide on that request by means of implementing acts. Furthermore, any request to amend the RDP should also be referred to the RDP monitoring committee pursuant to Article 49(3) of Regulation (EU) No 1303/2013. The monitoring committee, if it considers it to be appropriate, shall give an opinion on any amendment of the RDP proposed by the managing authority.The AGRI Coordinators share the Commission’s view that the amount of the aid in question could not be based on the order of the Castilla-La Mancha authorities of 24 March 2015, which those authorities had issued under their own responsibility. The Rural Development Programme approved by Commission Decision C (2015) 7561 of 30 October 2015 is indeed the only valid legal basis. Any requests to amend that Rural Development Programme should be approved by the Commission in accordance with Article 11 of Regulation (EU) No 1305/2013.
