Proposed Handling

This question will come before the Professional Practice Committee at its September 2008 meeting where it will be voted on and action taken. It will then come before the full Board at its September 2008 meeting for final action.

Procedural History

Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.

Background Information

There are 9 licensing petitions and 26 requests for the conferral of the degree Doctor of Medicine for review and approval.

Recommendation

It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.

Timetable for Implementation

Approval of the Committee on the Professions’ recommendations will be effective September 16, 2008.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy Examination.

Statement of Problem: Commissioner's Regulations require that an applicant must pass all parts of the Uniform CPA Examination within an 18-month period. Mr. Danna originally received conditional credit for passing the computer-based Business Environment & Concepts (BEC) section of the examination in May 2005. He needed to pass the remaining three sections by the end of December 2006 to retain credit for this section.

Mr. Danna passed the Audit and Attestation (AUD) section in April 2006 and the Regulation (REG) section in November 2006; however, since he did not take the Financial Accounting & Reporting (FAR) section, he lost credit for the BEC section he passed in May 2005. Consequently, Mr. Danna had to pass the FAR and BEC sections by December 2007 to satisfy the examination requirement and retain credit for the AUD section.

During the first half of 2007 Mr. Danna’s preparation and sitting for the two sections of the examination were interrupted due to a family illness. By December 2007, he had passed the FAR section but not the BEC section. He passed the BEC section in May 2008, five months beyond the regulatory requirement.

Mr. Danna is an articulate individual who struggles with testing situations. He has passed all four sections of the licensing examination but has not passed all four sections within any given 18-month period as required in Commissioner’s Regulations. Given Mr. Danna’s tenacity in sitting and preparing for the examinations in the face of his personal difficulties, the Executive Secretary of the State Board for Public Accountancy supports his request to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

Statement of Problem:  Applicant did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school. Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. Dr. Rotella enrolled in the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester and successfully completed the program in June 2008. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

Statement of Problem:   Applicant completed one of the two years of pre-professional education, including general chemistry, organic chemistry, biology/zoology and physics, required in Commissioner’s Regulations. However, following graduation from dental school, Dr. Ribeiro received a Master of Science degree in Pediatric Dentistry (2006) from the Universite de Montreal, Montreal, Canada. The State Board for Dentistry recommends that her advanced degree be accepted to fulfill the pre-professional deficiencies. Commissioner’s Regulations allow the Committee on the Professions to accept up to 30 semester hours of study completed after the professional program toward the pre-professional education requirement.

Additionally, Dr. Ribeiro did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school. Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. Dr. Riberio enrolled in the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester and successfully completed the program in December 2007. THREE YEAR LIMITED LICENSE IN DENTISTRY

Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.

Statement of Problem: The applicant listed below has satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

The applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. The applicant must sign an affidavit stating the exact location of the shortage area where she will practice before the three-year limited license will be issued.

Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for:   Waiver of New York State requirements pertaining to acceptability of licensing examinations for licensure by endorsement.

Statement of Problem:  Dr. Bailey has not passed a satisfactory licensing examination as required in Commissioner’s Regulations. She graduated from an accredited college of veterinary medicine in Canada in 1982 and was licensed by The College of Veterinarians of Ontario the same year. The applicant did not take a licensing examination for Ontario licensure as it was not required at that time. Thus, she did not take the National Board Examination (NBE) offered at that time in the United States or the Clinical Competency Test (CCT) which was first offered in 1984 or the North American Veterinary Licensing Examination (NAVLE), which latter subsequently replaced the NBE and CCT.

In 1998, Dr. Bailey became a Diplomate of the American College of Laboratory Animal Medicine (ACLAM) after passing its “comprehensive written and practical examination” following the prerequisite training and a peer-reviewed published original paper. Dr. Bailey is Associate Vice-Provost of Cornell University’s Center for Research Animal Resources and Director of Laboratory Animal Services and has been at Cornell University since 2001. She “oversees the care of animals used in teaching and research in over 100 facilities at Cornell University.” In addition, the Department received verification of approximately 19 years of practice in various settings in Ontario preceding her service at Cornell University.

In view of Dr. Bailey’s documentation of numerous years of practice and diplomate certification as evidence of competence, the Executive Secretary of the State Board for Veterinary Medicine recommends waiver of the examination requirement and endorsement of the applicant’s Ontario license for licensure in New York State.

Petition for: Satisfaction of proficiency examination and postgraduate hospital training requirements and endorsement of his medical license from the Norwegian Medical Association.

Statement of Problem:  Commissioner’s Regulations allow endorsement of an applicant’s license from another jurisdiction if appropriate requirements are met, and the applicant has not failed any part of New York State’s licensing examination. A license granted in a foreign country can be endorsed if licensure in that country is regulated by an organization designated as responsible for quality assurance and acceptable to the Board of Regents. Additionally, the applicant must satisfactorily demonstrate completion of an acceptable proficiency examination, an acceptable clinical competency examination, three years of ACGME-accredited postgraduate training or the equivalent, and five years of satisfactory professional experience.

Dr. Bergamaschi has not failed any part of the licensing examinations used by New York State. The Executive Secretary of the State Board for Medicine has reviewed the documentation submitted in support of Dr. Bergamaschi application. He recommends that the Specialty Certificate in General Surgery from the Ordre National Des Medecins of France be accepted to satisfy the proficiency examination requirement. Also, the Executive Secretary is recommending that Bergamaschi’s surgery training in France and Norway be accepted as the substantial equivalence of the three years of ACGME-accredited postgraduate training required for licensure. Lastly, Commissioner’s Regulations allow the Board of Regents to accept appropriate foreign medical licenses and diplomate certificates to fulfill the licensure and clinical competency requirements for endorsement. Dr. Bergamaschi has been licensed by both the General Medical Council of the United Kingdom and the Norwegian Directorate of Health. His license in Norway is active and in good standing. In addition, the applicant has earned specialist certification in general surgery, gastrointestinal surgery and orthopaedic surgery by the Norwegian Medical Association. The Executive Secretary of the State Board for Medicine recommends these qualifications be accepted to fulfill the regulatory endorsement requirements for licensure.

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department.
