APALA Confidential Judicial Questionnaire

1. State full name, residence (street address, city and county), date and place of birth, Social Security number, political affiliation as indicated by your voter registration, and home and work number. Indicate how long you have resided at this address.

2. State any other addresses where you have lived during the past ten years and the specific dates during which you resided at those addresses.

3. State your marital status, whether single, married, widowed or divorced, and if married, whether or not you are separated from your spouse.

4. State the names and ages of all children.

5. State the names, ages and relationship to those persons comprising your household, and state the extent to which each is dependent upon you for support.

6. State the names and relationship, if any, of all other persons dependent upon you for support.

7. State all college(s) and law school(s) attended with dates of attendance and degrees received.

8. Have you had any military services? If so, give dates, branch of service, rank, serial number and present status. If discharged, state character of discharge.

9. State the jurisdictions/courts in which you are presently admitted to practice, including dates of admission in each case.

10. Are you now, or have you ever been, actively engaged in the practice of law? If so, give office location and name of firm and of prior firms with which associated, with dates and whether partner or associate. If you have or have had partners in your present firm, state their names. If practicing alone during any period, so state.

11. If you have practiced in other localities, please specify locality with dates and partners, if any, with whom you practiced.

12. What is the general character of your practice? Indicate nature of typical clients and legal specialties. If nature of your practice has been substantially different in the past, state nature of prior practice in as much detail as possible, including dates.

13. State whether you regularly, occasionally or never appear in court or before administrative agencies. State for the past five years the average number of litigated cases in which you personally appeared, and whether civil or criminal, the particular courts or agencies, whether the cases involved (a) trials, and, if so, whether jury or non-jury, or (b) appeals. Give approximate percentages of cases in each group and of cases which are federal and state reported cases, and indicate whether you have served as chief, associate or sole counsel.

14. Summarize your experience, as in Question #13, prior to the last five years. If during any period prior to the last five years you appeared in court with greater frequency than during the last five years, state periods during which this was so and give as much detail as possible respecting such earlier experience.

15. Have you ever been engaged in any occupation, business or profession, other than the practice of law? If yes, please specify type of work, names and addresses of employers, if any, and place and period of each engagement.

16. Are you now an officer or director or otherwise involved in the management of any business enterprise? Is it your intention to resign such position and withdraw from any participation in the management of any such enterprise if you are nominated and confirmed? If so, give reasons.

17. Do you have or does any member of your immediate family have any ownership interest in any business enterprise other than stock ownership in a publicly held corporation?

(a) If yes, give details, including the name and address of the enterprise, the nature of the business, the names and addresses of all persons who have any ownership position, his or her relationship to you and the nature of the duties performed by him or her, if any.

(b) Is it your intention to divest your personal ownership from such business enterprise if you are nominated and confirmed? If it is not, please state the reasons.

18. Please indicate the range which most accurately represents the average of your last three (3) years’ income derived from the practice of law.

19. List and briefly describe all real estate in which you have an ownership interest and state the nature of that interest, the approximate fair market value of the entire real estate, and the approximate fair market value of your equity interest therein.

20. Have you ever held judicial office? If yes, state the court and period of service.

21. Have any of your present of former law partners or associates held judicial office? If yes, state the court and period of service.

22. Have you ever been a candidate for elective public office? If yes, state the date you were a candidate for each office, each office sought, each office, if any, to which you were elected, and the dates you occupied each office. If you have ever occupied some other office, state each office occupied and the dates between which you occupied it.

23. Have you ever been arrested, taken into custody, charged with, indicted or tried for a crime or petty offense other than a traffic ticket? If yes, give details.

24. Have you, to your knowledge, ever been under a federal, state or local investigation for possible violation of a criminal statute? If so, give particulars.

25. Have you or has any firm of which you have been a principal ever been sued by a client? If yes, give details.

26. Has any claim of legal malpractice ever been asserted against you or against any firm of which you have been a member? If yes, give details.

27. Have you ever been a party of otherwise involved in any other legal proceedings? If so, give the particulars. Do not list proceedings in which you were merely a guardian ad litem or stakeholder. Include any legal proceedings in which you were a co-respondent, and any grand jury investigation in which you figured as a subject, or in which you appeared as a witness.

28. (a) Have you ever been disbarred, suspended, censured, reprimanded, admonished, or otherwise disciplined as an attorney?

Include all obligations for which you are a personal guarantor. Please indicate whether these obligations are current. If not, please give details.

34. Do you currently have a physical or mental condition which in any way limits or impairs your ability, or fitness to properly exercise your duties as a member of the judiciary in a competent and professional manner? If yes, please describe.

35. Are the limitations or impairments caused by your physical or mental condition reduced or ameliorated because you are receiving ongoing treatment (with or without medications) or participating in a monitoring program? If yes, please describe.

36. Does the use of chemical substance(s) (drugs, alcohol or medications, including prescribed medications) in any way limit or impair your ability or fitness to properly exercise your duties as a member of the Judiciary in a competent and professional manner? If yes, please describe.

37. Have you ever been diagnosed as having or have you ever been treated for any of the following: pedophilia; exhibitionism; or voyeurism? If yes, please describe.

38. In the past five years, have you ever been declared legally incompetent or have you or property you own been placed under any guardianship or committee? If yes, please describe.

39. Are you currently engaged in the use, addicted to or dependent upon the use of controlled dangerous substances? If yes, please describe. If yes, are you currently participating in a supervised rehabilitation program or professional assistance program which monitors you in order to assure that you are not using illegal controlled dangerous substances? If so, please describe.

40. In the past five years, have you been reprimanded, demoted, disciplined, placed on probation, suspended, cautioned or terminated by an employer for absenteeism? If yes, please describe.

41. Have you published any legal books or articles? If yes, list them, giving citations and dates.

42. List any honors, prizes, awards or other forms of recognition which you have received (including any indication of academic distinction in college or law school) other than those mentioned in previous answers.

43. List all bar associations and professional organizations of which you are a member and give the titles and dates of any offices which you have held in such groups. List also chairmanships of any committees in bar associations and professional societies, and memberships on any committees which you believe to be of particular significance in relation to legal ability and interests and qualifications for judicial office.

44. State any other information you regard as pertinent to your evaluation for judicial appointment. Include specialty certification(s), if any.

45. Please provide, as references, the names, addresses and telephone number of five persons (not related by blood or marriage or present or past business associates) who are well acquainted with your legal ability.

46. Please state the names and addresses of any judges (you need not list more than five) who are well acquainted with your legal ability.

47. Please enclose a brief resume or biography of yourself to be used for press release, publicity, etc., should it be needed.

I understand that I have an affirmative and continuing duty to disclose all required information to APALA, and that this duty continues until the effective date of appointment, should there be one. I understand that I have a duty to amend this questionnaire within thirty days of any occurrence that would change or render incomplete any answer contained herein, and to immediately notify APALA of the impending change.
