TITLE: Legal Specialist (Unclassified)
LOCATION: Division of Mental Health, Central Office, Trenton, NJ
SALARY: Commensurate with Education and Experience
DEFINITION: Under direction of the Chief Executive Officer or other supervisory official in a state department, institution, or autonomous agency, performs confidential legislative, legal, and policy- influencing research related to department programs, in conformance with guidelines established by the State Attorney General; acts as liaison between a state department and the Office of the Attorney General in receiving, formulating, and transmitting requests for legal advice on behalf of a state agency; prepares reports and recommendations on the impact of proposed or existing legislation; does related work as required.
SPECIAL NOTE: This position reports to the Legal Liaison, Division of Mental Health and Addiction Services and will engage in activities which include, but are not limited, to coordinating requests for legal advice from the Attorney General’s office, providing guidance regarding various statutes and regulations, handling all aspects of the Division’s rulemaking process, commenting on legislation, and providing litigation and other support as requested by the Attorney General. This position is responsible for preparing or reviewing legal notices, enforcement letters, and providing administrative, policy and technical advice for implementation of activities to create and maintain compliance with state and federal law. This position requires strong analytical and critical thinking skills, orientation to detail, and ability to multi-task, an ability to work in a cooperative, efficient and effective manner with multi-levels of staff and constituents. Admission to the New Jersey State Bar is preferred.

REQUIREMENTS
EDUCATION: Graduation from an accredited law school with Juris Doctor (J.D.) or a Bachelor of Laws (L.L.B.) degree.
OR
EDUCATION: Graduation from an accredited college or university with a Bachelor's degree.
EXPERIENCE: Three (3) years of experience involving legal or legislative research, drafting of rules, regulations, legislation, amendments, and/or the interpretation of statutes.
NOTE: Appointees currently matriculating in an accredited law school as an LL.B or J.D. candidate may substitute such enrollment for the three (3) years of required experience on a year-for-year basis.
NOTE: The legal specialist may be a fulltime law school student working for the state on a limited part-time basis or during periods when law school is not in session.
SPECIAL NOTE: Experience in civil commitment process, confidentiality of medical records, informed consent and guardianship proceedings would be a plus.
Residency Law
Pursuant to N.J.S.A. 52:14-7 (P.L. 2011 Chapter 70) also known as the “New Jersey First Act”, effective September 1, 2011, all employees of state and local government must reside in the State of New Jersey, unless exempted under the law. If you already work for state or local government as of September 1, 2011, and you do not live in New Jersey, you are not required to move to New Jersey. However, if you begin your office, position or employment on September 1, 2011, or later, you must reside in New Jersey. If you do not reside in New Jersey, you have one year after the date you take your office, position or employment to relocate your residence to New Jersey. If you do not do so, you are subject to removal from your office, position or employment.
LICENSE: Appointees will be required to possess a driver’s license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.
