NEGOTIATIONS
Greetings.
In the spirit of the wonderful PE Governance Training we received I will keep my report brief. Having said that it continues to be extremely busy on many fronts.
The important thing to remember is that as a union we are continuing to build our strength and solidarity in the key areas that our members rely upon us for: i.e. bargaining strong collective agreements and our ability to resist cuts and to fight for improved conditions for our members and the services they provide to Albertans.
The current rounds of bargaining, most noticeably (but not limited to) the GOA Master Agreement, are essential in continuing to build upon our strength and vision. I would like to thank the GSBC for organizing the many town hall meetings that, at time of writing, are just underway. Reaching out to our members in this way is a clear indication of our determination to conduct a successful round of bargaining.
Also, we continue to be the voice and muscle that stands up for our members and all Albertans. The role of the Provincial Executive is key to this goal and I personally want to thank you for your leadership at our very successful convention and also your commitment to improving the governance of AUPE as we move forward to confront new and existing challenges.

NEGOTIATIONS

General Services (GOA)
Negotiations continued through to October with no real progress. The parties have signed off only limited undisputed items. The GSBC has planned a road trip from November 15 to December 1 and will hold town hall meetings in several locations throughout the province. The parties will return to the bargaining table on December 7 with several more days scheduled through to December 16.
Health Sector
Alberta Health Services - General Support Services
New GSS Members from Northern Lights, Chinook, Palliser and AADAC
The parties met with the Special Officer on November 4 & 5. The report is expected soon.
Covenant Health - Auxiliary Nursing
Consolidated Agreement
Negotiations are ongoing to bring the previously separate ANC bargaining units, St. Michael’s Health Centre (Lethbridge) and St. Joseph’s Auxiliary Hospital into the previous MER ANC (now Covenant) collective agreement.
The Good Samaritan Society

The parties have exchanged proposals and have several dates scheduled in November and December.

The committee met on October 28 to prepare for negotiations and will meet with the employer on November 25 to exchange proposals.

Education Sector
Grande Prairie Regional College (Fairview College)
The parties reached a tentative agreement on October 6 that was ratified by both parties on October 28. The agreement contained parity in total compensation with the non-union Employee Association at GPRC and provides for a job evaluation process and salary equity to the EA salary grid on July 1, 2011.
Hours of work are reduced to 35 hours a week over a 27 month period with no reduction in annual salaries (up to a 12% increase in hourly rates of pay for 40 hours a week employees), Vacation Schedule is improved retroactive to July 1, 2009 (quicker accruals), and Dependant Scholarships/Professional Developments funds have been added to the contract.
University of Calgary
The Parties continue to attempt to negotiate a new collective agreement.
SAIT
The Union applied for Mediation and there are two dates scheduled in December.
NorQuest College
The parties reached an agreement on the wage re-opener for 2010 that was ratified by both parties. The deal contained no increases to wage rates but provided for three additional paid vacation days off and an increase to the Health Spending Account of $125.00.
Boards, Agencies and Local Government Sector
Alberta Innovates - Technology Futures
The Union applied for Mediation to resolve the wage re-opener for 2010.
Special Areas Board
The employer and the members rejected the Mediator’s Recommendations. There has been no progress in negotiations.
Saddle Hills County
The Union was successful in getting the Strike Vote. The employer asked to meet again on November 9, 2010 where a tentative agreement was reached. The employer will vote on November 23 with the Union following shortly thereafter.
AIMCO
The parties met on November 8 & 9 to exchange proposals.
Travel Alberta
The parties met in October for two days before the process broke down. The employer is attempting to negotiate the term “team member” into the agreement wherever “employee” appears.
ALMA
The parties have exchanged proposals and are scheduling further dates.
The City of Cold Lake
The committee is meeting on November 10 to prepare their proposals.
Alberta Gaming & Liquor Commission
The committee is meeting on November 10 to prepare their proposals.

ORGANIZING
Internal Organizing:
Save Our Seniors Homes
The move of residents was completed in Red Deer Nursing Home, however Valley Park Manor’s transfer was halted part way through due to staffing issues at Extendicare. Layoff notices for the staff were rescinded, and Red Deer Nursing Home staff began working at Valley Park Manor.
On October 25th, 6,600 petition signatures were presented in the Legislature by the New Democrats and Liberals with AUPE members from Locals 044 and 057 present, President Smith and Vice-President Bates-Renouf, as well as our supporters in Friends of Medicare, the Central Alberta Council on Aging and Council of Canadians.
The transfers from Valley Park Manor resumed, and are expected to be completed on November 8th.
AUPE has recognized the small window of opportunity to pressure the Government – tying the emergency wait times in with the long term care wait lists.
A rally was called at Convention; and another held on November 3 in Red Deer to Save Valley Park Manor. Over 150 supporters attended. Zwozdesky and Jablonski have remarked that Valley Park Manor “may be in play” to address issues around alleviating emergency room wait lists through long-term care placement.
Mobilizing Course:
With the Government of Alberta entering into bargaining, a Mobilizing for Bargaining course was developed through modifications to the 2010 Mobilizing Course. A course was held on September 24th for the GSBC as well as GOA bargaining committee members. Courses have also been held for Local Council members in Local 003, 004, 006, 009, 010, 012 as well as GSS Locals 054 and 056, and AGLC Local 050.
There was also a course held in Calgary for GOA members.
Future courses are scheduled for Local 001 in November as well as 057 and 005 in December.
External Organizing
The campaigning for Saving Our Seniors Homes in Red Deer paid off in a big way with Michener Hill employees voting on September 14, 2010 to have AUPE become their official bargaining agent. This organizing drive was extremely successful because our members at Red Deer Nursing Home and Valley Park Manor working at Michener Hill wanted to be represented by AUPE not CUPE. CUPE received a voluntary recognition from Extendicare. Usually this tactic of voluntary recognition is done by those organizations not considered to be part of the larger labour movement. A quote in response to Red Deer Advocate story; AUPE, CUPE vie to represent Extendicare Staff, published August 26, 2010, says it all “No one wants to be represented by a union who is in bed with the employer.” There were many things that contributed to this successful organizing drive. But the main reason for the success was the relationships that we developed during the Save OUR Seniors Homes Campaign, which allowed us to know what was happening on the Michener Hill site and be able to react in a positive manner.
The organizing department’s work on the Fairview College file; concluded with a successful ratification of a new contract by AUPE members at Fairview College on October 21, 2010. The organizing department was successful in defeating a decertification attempt on June 16, 2010 (93 members were on voters list ).
On October 7, 2010 AUPE received notice from the Alberta Labour Relations Board that employees at the City of Cold Lake wanted to have a vote to decertify from AUPE. The decertification process is never a nice process to be going through. Although it seems that the employer might have played some part in this process; and unfair labour practices have been filed with the Labour Relations Board. Part of the problems with this Chapter is that it was recently organized in 2008 and had a high staff turn over with less than half of the original employees that voted to join AUPE still working for the city. By meeting with the members of this Chapter and finding out what the issues were, AUPE was able to win the vote by a higher margin then when they first voted to join AUPE.
We have been helping in a supportive role with negotiations at County of Saddle Hills. This resulted in the department supervising an Alberta Labour Relations Board certified strike vote on October 7, 2010, for our members working at the County of Saddle Hills.
During the AUPE Convention the Organizing department helped with the successful rally held at the Alberta Legislature. In addition we also provided support for the November 3, 2010 rally in Red Deer to try and keep Valley Park Manor open.

LABOUR RELATIONS BOARD AND COURT ACTIVITY
Court Activities:
In May 2010, the arbitrator ruled in favour of AUPE’s estoppel argument in the transfer of Correctional Medical Staff to AHS. The employer initiated judicial review was heard at Court of Queen’s Bench in early July. The Court of Queen’s Bench decision allowed the transfer of the Correctional Medical Staff to AHS, granted a three-day stay to deal with the administration, denied AUPE’s application to have the stay extended, and advised AUPE to seek an injunction at the Court of Appeal. The injunction was denied at Court of Appeal on August 25th. The members have been transferred as of September 13, 2010. AUPE is preparing an appeal.
Labour Board Activities:
Bargaining Certificates:
A Memorandum of Understanding, to consider a resolution with respect to the application for variance with Shepherd’s Care Foundation and Kensington (consolidation of certificates) is still a work-in-progress.
Applications for Determinations/Reconsiderations/Successorships:
The Labour Board granted an adjournment till October 29th for the parties to pursue an agreement on the successorship application, filed in March, 2010, for Alberta Research Council and Alberta Innovates Technology Future.
Two other successorship applications have been filed for Alberta Innovates Bio Solutions, and Alberta Innovates Energy & Environment Solutions on October 29, 2010.
HSAA filed an application for determination for the Mental Health Therapy Asst. at Alberta Children’s Hospital. AUPE filed a response on October 25th r requesting a summary dismissal; the employer requested an extension to respond by November 5th.
An application for determination and reference of difference has been filed for AADAC Client Care Asst. (CCA), Addictions Counsellors I – III for inclusion in the ANC certificate and agreement. Since that application was filed, AHS has agreed to move the Client Care Assts. (CCA’s) to ANC. A transitional agreement is being negotiated between the parties for the CCA’s moving into ANC collective agreement. A Resolution Conference is scheduled for January 6, 2011 for a determination on the other classifications.
Hearing dates have not been set for UNA’s application for determination for 32 Operating Room Techs at Royal Alexandra Hospital.
The hearing for NAIT’s inclusions/exclusions under Public Service Employee Relations Act was held the week of September 27, 2010.
AUPE’s determination application for the Ortho-techs, in the Calgary zone, is set for a Resolution Conference on December 20, 2010. UNA was denied intervenor status on this file in early October.
The hearing for a ‘common employer declaration’ against Alberta Health Services and Paladin Security regarding the Protection Services is scheduled for December 6 and 7th and other hearing dates are being set for later.
Unfair labour practice complaints:
AUPE filed an unfair labour practice complaint against Hong Lok Management Services on October 28, 2010. On October 29, 2010 their legal counsel called AUPE to determine how to resolve the matter. A resolution is being worked out between the parties.
An employee of Cold Lake filed an‘unfair labour practice complaint’ against AUPE regarding an incident that occurred during the revocation organizing drive; then the employee withdrew the complaint on October 26, 2010.
ACVOCACY
Disputes and Arbitrations
From October 1, 2010 to November 8, 2010 eighteen (18) new files were conveyed to arbitration. During the same time period, fifteen (15) arbitration files were closed; some as a direct result of arbitrations but most as a result of settlements. Eight (8) Professional Licensing/Regulatory files are currently active.
Two Arbitration Decisions were released during the above noted time period:
In one decision the Grievor was a 5 year Clerk III employed at public health clinics with AHS. She was the object of a letter of expectation, a letter of warning, a one day suspension, a three day suspension, a five day suspension and a termination. The progressive discipline was directed essentially towards the grievor's allegedly numerous and continuous booking errors and her allegedly constant insubordination. The Arbitration Board held that the Employer was justified in termination the Grievor because the progressive discipline that had been meted out had no effect on her attitude and her continued errors.
In another decision the grievor was a unit clerk who went on and off sick leave in 2004 and 2005. She made an attempted return to work in 2005 but again became physically and mentally disabled in September 2005. She was put on unpaid leave and the Union alleges that the Employer was negligent in failing to take the steps necessary to ensure that the grievor received her disability benefits. When the Union learned of the problem a grievance was filed, appeals were brought before the insurer (Great West) and finally the insurer retroactively recognized the grievor's LTD and paid her benefits from September 2005 onward. The Union continued the grievance in order to claim damages for the Employer's alleged negligence. Two weeks before the hearing the Employer raised two preliminary objections raising the timeliness of the grievance and the Arbitrator's jurisdiction.
The Board held that the grievance was continuous and, in any event the Employer was late in raising the timeliness objection.
The Board held that it had jurisdiction to hear the case since the issue arose from the employment relationship.
As of August 18, 2010, we are waiting for eight (8) arbitration and licensing decisions.

Research
The October 2010 version of the quarterly Economic Profile Report was published and distributed for November 1st.
The project providing a comparison of strike pay across various unions was completed.
A response was written and provided to Alberta Health Services discussion paper "From Forecasting to Planning: Modeling Options for the Alberta Nursing and Health Care Aide Workforce".
AUPE filed a Freedom of Information request on contracting out at Children and Youth Services.
Continued, and further consultation with the Parkland Institute on Facilities Maintenance contracting out research project.
COMMUNICATIONS
The fast pace experienced by the Communications Section in the run-up to the 2010 Convention has continued without abating. Communications staff members are working on projects related to General Service bargaining, the continuation of various advertising and mobilizing campaigns, bargaining-related video production, and negotiations in the health and education sectors.
A second “flight” of TV advertisements in the image and anti-privatization campaigns commenced at the start of September and ended in mid-October. A fall flight is now under way, running from the week of Nov. 1 until Dec. 5. The most recent public opinion research, conducted as part of the image advertising campaign, shows awareness of AUPE remains high and constant at 84 per cent. However, the proportion of respondents that gave AUPE members a high rating for the importance of their work slipped, likely as a result of the mix of ads selected. Adjustments have been made to the November-December flight in response.
The fall edition of Direct Impact was mailed to members in late September. Work will start soon on the next edition. Communications staff members are looking into appropriate and cost-effective ways to respond the decision by Quebecor to close the Edmonton press that prints Impact. There has been very little reaction, none negative, to the decision not to include the Annual Report within the pages of Impact, but to post it on-line instead. To date, there has only been a single request for a hard copy of the Annual Report.
Last month, AUPE Webmaster Vanessa Bjerreskov successfully launched AUPE’s staff Intranet, designed to assist AUPE’s employees in carrying out their work on behalf of the union’s members, to very positive reviews. Visits to the main AUPE Website were up marginally in the third quarter over the second quarter to 77,008 visits compared with 76,696 visits in the previous quarter.
Routine work on media relations, website updates, COPA servicing, production of brochures and posters, and materials produced in coalition with other labour organizations continues at a normal pace.
