Introduction

The General Assembly, at its second session, on 21 November 1917, adopted a resolution (177 (II? in which it entrusted the formulation of the principles of international law recognized in the Charter of the Nfirnberg Tribunal and in the judgment of the Tribunal to the Interna.tional Law CoIIJJcission. The resolution reads as follows:

Formulation of the principles recognized in the Charter of the Nilrnberg Tribunal and in the judgment of the Tribunal

The General Assembly

Decides to entrust the formulation of thr. principles of international law recognized in the Charter of the Niirnberg Tribunal and in the judgment of the Tribunal to the International Law Commission, the members of which wil!, in accordance with resolution 174 (Il), be elected at the next session of the General Assembly, and

Directs the Commission to

(a) Formulate the principles of international law recognized in the Charter of the Niirnberg Tribunal :md in the judgment of the Tribunal, and

(b) Prepare a draft code of offences against the peace and security of mankind, indicating clearly th.e place to be accorded to the principles mentioned in sub-paragraph (a) above.

By another resolutiun adopted on the same day (175 (II?, the General Assembly instructed the Secretary-C ~eral to do the necessary preparatory work for the beginning of the activity of the Intemational Law Commission. The following is the text of this resolution:

Preparation by the Secreta.riat of the work of the International Law Commission

The General Assembly,

Considering that, in accordance with Article 98 of the Charter, the Secretary-General performs all such functions as are entrusted to him by the organs of the United Nations;

Considering that, in the interval between the first and the second sessionf of the General Assembly, the Secretariat of the Un:ted Nations contributed to the study of problems concerning the progressive development of intemationallaw and its codification;

Instructs the Secretary-General to do the necessary Dreparatory work for .the beginning of the activity of the International Law ?Commission, particularly with regard to the questions referred to it by the second session of the General Assembly, such as the draft declaration on the rights and duties of States.
