Federal Court Challenges Under 47 U.S.C. § 252(e)(6)

The following cases represent the only ongoing litigation under 47 U.S.C. § 252(e)(6) that relates to interconnection agreements approved by the Kansas Corporation Commission and the Oklahoma Corporation Commission.

1) Southwestern Bell Tel. Co. v. Ed Apple, No. 00-6030 (10th Cir. filed Jan. 25, 2000). This case involves an appeal of a district court decision upholding in part and vacating in part the Oklahoma Corporation Commission’s arbitration of SWBT’s Oklahoma interconnection agreement with AT&T. It is currently in mediation.

2) Southwestern Bell Tel. Co. v. AT&T Communications of the Southwest, Inc., No. 00-4137-sac (D. Kan. filed Aug. 28, 2000). Here, Southwestern Bell claims that Kansas Corporation Commission pricing decisions are unlawful because they apply TELRIC.
