General Summary of Institutional Types

(Numbers correspond to the row numbers of the institutional types included in the reference chart on the preceding pages.)

1) A for-profit or non-profit organization may be considered a proprietary school under the Career School Law (Texas Education Code, Chapter 132). (See #2 below for the definition of Career school under this law.)

2) Under Section 132.001 of the Career School Law (Texas Education Code, Chapter 132), "career school" is defined as "any business enterprise operated for a profit, or on a nonprofit basis, that maintains a place of business within this state [Texas], or solicits business within this state, and that is not specifically exempted by this chapter and: (a) that offers or maintains a course or courses of instruction or study; or (b) at which place of business such a course or courses of instruction or study is available through classroom instruction or by correspondence, or both, to a person for the purpose of training or preparing the person for a field of endeavor in a business, trade, technical, or industrial occupation, or for vocational or personal improvement." (See #3 below for general information regarding exemptions from the provisions of this law.)

3) Under Section 132.002 of the Career School Law (Texas Education Code, Chapter 132) is a listing of schools and educational institutions that are specifically exempted from this law. However, an institution should not assume an exemption. TWC is responsible for determining operations that comply with the Career School Law's exemption provisions. TWC has the legal authority to impose penalties or sanctions for violations of this law or TWC’s rules pertaining to this law. 4) A private institution of higher education subject to regulation under Texas Education Code, Chapter 61, Subchapter G is an institution (1) not accredited to offer degrees at a specific level by an accrediting agency recognized by the Coordinating Board; or (2) not approved by a Texas state agency which authorizes the school’s graduates to take a professional or vocational state licensing examination administered by that agency. (See note at the bottom of this page for a list of Board-recognized accrediting agencies.)

5) A private institution of higher education exempt from regulation under Texas Education Code, Chapter 61, Subchapter G is an institution (1) accredited to offer degrees at a specific level by an accrediting agency recognized by the Coordinating Board; or (2) approved by a Texas state agency which authorizes the school’s graduates to take a professional or vocational state licensing examination administered by that agency.
