Annex

Customs Clearance Notice for the 7th CISM Military World Games 2019

The Customs of the People’s Republic of China will provide all-round quality service for the 7th CISM Military World Games 2019 (hereinafter referred to as the Games) and carry out supervision on inbound and outbound materials of the Games pursuant to laws and regulations, including the Customs Law of the People’s Republic of China, the Law of the People’s Republic of China on Import and Export Commodity Inspection, the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine, the Frontier Health and Quarantine Law of the People’s Republic of China, the Food Safety Law of the People’s Republic of China and the Regulations of the People’s Republic of China on Import and Export Duties.

The Notice shall apply to the customs clearance of related personnel and goods and materials during the Games and its preparatory period.

I. Information Registration and Record Filing

Wuhan Customs will perform temporary registration, recording and coding for the Executive Commission of the Games (hereinafter referred to as the Executive Commission). To facilitate expedited customs clearance for personnel and goods and materials for the Games upon their arrival, the Executive Commission and its entrusted customs agents shall provide the Customs with information about such personnel and goods and materials in advance.

II. Customs Guarantee

In terms of temporary imported goods and materials for the Games, the Executive Commission provides the bank guarantee to Wuhan Customs to process the guarantee for duty and tax payable. Overseas missions or customs agents submit to the Customs the Certification for Import Goods for the 7th CISM Military World Games (hereinafter referred to as the Certificate, see Appendix 1) and List of Import Goods for the 7th CISM Military World Games (hereinafter referred to as the Materials List, see Appendix 2) issued by the Executive Commission, instead of guarantee for each transaction.

III. Pre-Import Record Filing and Approval

(I) Importers, or their agents, of food products, animals and plants and relevant products shall go to the customs office to complete the record filing formality in advance.

(II) For animals, plants and relevant products, Special Articles (Appendix 3), and animal-derived foods, plant-derived foods and edible aquatic animals requiring quarantine approval for entry, the GACC authorizes Wuhan Customs to carry out the quarantine approval. Importers or their agents must handle the approval procedures in advance.

The examination and approval of imported special articles for the Games shall be performed through the special-item examination and approval system of Wuhan Customs and the process will be concluded within 3 working days.

(III) Overseas missions importing food products, special articles and animal and plant products for their self-use shall submit to the Executive Commission the List of Mission Self-use Goods and Materials Imported for the 7th CISM Military World Games (hereinafter referred to as the Self-use Item List, see Appendix 4), Certificate of Mission Self-use Goods and Materials for the 7th CISM Military World Games (hereinafter referred to as Self-use Item Certificate, see Appendix 5) and Statement of Taking Responsibility for the Safety and Hygiene of Mission Self-use Goods and Materials for the 7th CISM Military World Games (hereinafter referred to as Safety and Hygiene Responsibility Statement, see Appendix 6), and the Executive Commission will issue a Guarantee for Mission Self-use Goods and Materials for the 7th CISM Military World Games (hereinafter referred to as Self-use Goods and Materials Guarantee, see Appendix 7) to ensure the quantity is reasonable. Where quarantine and examination are necessary, missions shall submit in advance the certificates of origin and valid quarantine certificates to the Executive Commission, which will apply to Wuhan Customs for quarantine and examination.

(IV) Goods and materials imported for the Games, which involve wild animals and plants, medicine, healthcare products, horses and relevant equipment, radio transmission equipment and supplies, satellite television and radio ground receiving equipment, inbound foreign transportation means, firearms and ammunition, shall be approved by the competent authorities of the state concerned in accordance with relevant laws and be subject to the approval formalities as stipulated in relevant regulations.

IV. Customs Clearance of Inbound Goods and Materials

(I) Goods and materials for temporary entry.

Sports equipment, medical equipment, security equipment, communications equipment, television-broadcasting and news-reporting equipment shall be declared upon entry at the Customs, which will verify the Certification for Import Goods, List of Import Goods and the guarantee and release the equipment with temporary import formalities in accordance with relevant regulations.

(II) Entry for duty-free goods and materials.

In line with the Notice of the Ministry of Finance, State Taxation Administration and General Administration of Customs of the People’s Republic of China on the Taxation Policy for the 7th CISM Military World Games (No. 119, Finance and Taxation [2018]), consumables which are imported by the Executive Commission and directly used for the Games, specifically the ones that may not be produced domestically, or the performance of domestically produced counterparts does not satisfy the Games requirements, will be exempt from customs duties, import VAT and consumption tax. The above-mentioned consumables that have arrived at the port of entry before the authorities concerned approve and confirm the list of scope and quantity of the duty-free consumables may be released with priority upon presentation of the Certification for Import Goods, List of Import Goods and customs guarantees. Once the lists of scope and quantity of consumables eligible for duty exemption are issued, the following formalities shall be completed, including the approval and confirmation of duty reduction and exemption, duty levy and exemption and guarantee revocation, according to relevant regulations.

Other duty-free inbound goods and materials shall be subject to the formalities as stipulated.

(III) Inbound goods and materials requiring special permission in accordance with laws.

For inbound goods and materials requiring special permission in accordance with laws, the customs office will verify the approval documents from competent authorities of the state concerned before releasing.

(IV) Inbound goods and materials subject to inspection and quarantine.

1. Inbound food products (including those for healthcare purpose), cosmetics, animals and plants and relevant products.

(1) Entry through recommended ports, designation of supervisory areas and other special administrative measures and regulations are to make in place for the inbound food products (including those for healthcare purpose), cosmetics, animals and plants and relevant products.

(2) Following the quarantine at the port of entry, food products (including those for healthcare purpose), cosmetics, animals and plants and relevant products shall be sealed on-site before being transported to the supervisory areas as appointed by Wuhan Customs, which will be responsible for the inspection, quarantine and subsequent supervision and control.

(3) Inbound food products (including those for healthcare purpose), cosmetics, animals and plants and relevant products shall satisfy the food safety standards for the Games as proposed by the Executive Commission. For those that the Executive Commission has no such requirements, the mandatory requirements of the technical specifications and relevant laws and regulations of China shall be satisfied.

2. Food products and cosmetics for overseas missions’ self-use

(1) On the premise of collective customs declaration, food products and cosmetics for overseas missions’ self-use shall be released by presenting Self-Use Item List, Self-Use Item Certificate, Safety and Hygiene Responsibility Statement and Guarantee for Self-Use Goods and Materials from the Executive Commission.

(2) The same customs clearance formalities as stated above apply to the food products and cosmetics specially provided by overseas sponsors for overseas missions.

3. Other imported goods and materials requiring inspection and quarantine shall be subject to applicable rules.

V. Supervision and Control of Imported Goods and Materials

(I) Supervision and control of goods and materials for temporary entry. Goods and materials for temporary entry shall be re-exported within 6 months from the date of entry. For those imported goods requiring an extended time limit, re-export may be postponed after the Executive Commission submits the extension request to the customs authorities and obtain their approval; however, re-export after an extension shall take place no later than July 27, 2020.

(II) Supervision and control of food products (including those for healthcare purpose), animal and plant products and cosmetics for overseas missions’ self-use and those specially provided by overseas sponsors for missions. The Executive Commission shall exercise control over the food products (including those for healthcare purpose), animal and plant products and cosmetics for missions’ self-use and those specially provided by overseas sponsors in the Athletes’ Village and ensure all of those are solely for the use of the missions. The remaining goods and materials shall be re-exported or destroyed under the supervision of Wuhan Customs and may not be sold in China.

VI. Supervision and Control of Inbound and Outbound Personnel and Articles

(I) Personnel: Personnel receiving the entry quarantine must, according to requirements of quarantine doctors, truly report the physical condition, and show the certificate of prophylactic vaccination for infectious disease, health certificate, or other valid certificates. Foreigner proved to be with entry-forbidden diseases (serious mental disease, infectious phthisis, or other infectious diseases possible to cause major dangers to public health) by Port Quarantine shall not be permitted for entry.

(II) Personal articles: The principle of “self-use and reasonable quantity” shall be followed for general daily articles carried by individuals. The personal articles within the duty-free scope ruled by the Customs will be exempted from import duties and taxes, but the articles exceeding the aforesaid scope will be taxed, and then, permitted for entry. The procedures of customs clearance shall be processed pursuant to relevant rules in the event of personal articles exceeding the scope of “self-use and reasonable quantity”.

The articles carried by individuals shall meet the requirements of the Administrative Measures on Quarantine of Articles Carried by Entry-Exit Passengers (originally announced in the No. 146 Decree of General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China, and revised according to the No. 238, 240 and 243 Decree of the GACC), Catalogue of Animals and Plants, Animal and Plant Products Prohibited from being Carried or Posted into the People's Republic of China (Announcement No. 1712 of the Ministry of Agriculture and the General Administration of Quality Supervision, Inspection and Quarantine), List of Articles Prohibited from being Carried into and out of the People’s Republic of China and List of Articles Restricted from being Carried into and out of the People’s Republic of China.

When special articles (biological or blood products) carried by individuals for self-use and only for prevention or treatment of diseases enter the border, related hospital diagnosis certificate or prescription shall be showed to the Customs pursuant to the Administrative Regulations for Health Quarantine on Special Entry-Exit Articles (originally announced in the No. 160 Decreed of General Administration of Quality Supervision, Inspection and Quarantine and revised according to original No. 184 Decreed of General Administration of Quality Supervision, Inspection and Quarantine and No. 238, 240 and 243 Decreed of General Administration of Customs), and the carried quantity for a course of treatment determined by the prescription or specification is allowed. The Application of Import/ Export Special Articles for Verification of Health and Quarantine shall be provided in accordance with the Administrative Regulations for Health Quarantine on Special Entry-Exit Articles for the self-used special articles unable to offer evidentiary materials pursuant to the requirements, and such articles shall be inspected and quarantined by the Customs.

VII. Journalists’ Reporting Equipment

Overseas journalists with the accreditation issued by the Executive Commission and the confirmation letter shall declare their reporting equipment upon their entry and complete the customs clearance formalities with the Certification for Import Goods and List of Import Goods.

Non-accredited overseas journalists entering with reporting equipment shall complete the customs clearance formalities in accordance with the applicable rules of Announcement No. 104 of 2008 and No. 19 and No. 31 of 2009 of the GACC.

VIII. Other Matters

(I) The Executive Commission recommends the following ports of entry for the personnel and goods and materials of the Games:

Personnel: Wuhan Tianhe International Airport, Beijing Capital International Airport, Shanghai Pudong International Airport and Guangzhou Baiyun International Airport.

Goods and materials: Wuhan Tianhe International Airport, Port of Wuhan, Wuhan Terminal of CRIntermodal, Beijing Capital International Airport, Shanghai Pudong International Airport and Guangzhou Baiyun International Airport.

(II) Dedicated Games channels and counters will be set up at the main ports of entry to facilitate the customs clearance of inbound and outbound personnel and goods and materials.

(III) Food products and cosmetics specially for foreign missions’ self-use will be exempt from adding Chinese labels and signs.

(IV) Inbound and outbound goods and materials for the Games that fail to go through customs formalities shall be disposed in accordance with the applicable rules of the Customs Law of the People’s Republic of China and Regulations of the People’s Republic of China on Implementing Customs Administrative Penalty.

Matters not specified in the Notice shall be handled in accordance with applicable laws and regulations and shall not affect the execution of the new regulations of the Customs.
