Temporary Permit Template

Trustees of the California State University grant permission to (Insert name of Grantee) (Grantee), its officers, agents, and invitees, to enter upon the portion of the Trustees’ property shown on Exhibit A and to use that property to (Insert permissive rights, e.g. "install, construct, repair water pipelines"), (Insert words appropriate to location, e.g. "over, under, above, and through, etc.") the property.

The permissive rights hereby granted shall be for the period beginning (Insert beginning date of permit) and ending (Insert ending date of permit), or two calendar months after the completion of construction, whichever occurs first. After Grantee completes the task described above and satisfies all other conditions of this Permit, a Trustees' Agreement and Grant of Easement shall be executed.

Grantee agrees to indemnify Trustees and its agents and employees, for any loss caused by the exercise of this Permit, and Grantee agrees to indemnify and defend Trustees and its agents and employees from all loss or liability they incur which is in any way connected with Grantee’s exercise of the rights granted by this Permit, except those arising out of the sole negligence of Trustees.

Additional conditions on page 2 of this document constitute a part of this Permit.

ADDITIONAL CONDITIONS OF PERMIT:

1. (Insert name of Grantee) will advise the (Insert name of campus), Facilities Office of the work schedule prior to starting construction.

2. (Insert name of Grantee) will provide as-built drawings to the campus Facilities Office at the completion of construction.

3. (Insert name of Grantee) is hereby advised that utility lines of unknown nature and origin may be present in the proposed easement area.

4. Using the record of survey for the campus as the referenced record map, the basis of bearings, and the point of commencement, (Insert name of Grantee) will provide a metes and bounds or other appropriate legal description, in accordance with the requirements of Business and Professions Code, and a plat of the easement as-built location to the campus and to the Land Records Section of the Division of Capital Planning, Design and Construction within twenty-eight (28) calendar days of the completion of construction in order that an Agreement and Grant of Easement may be timely granted. Upon request, the Land Records Section will provide a copy of the campus record of survey for the use of (Insert name of Grantee)

5. (Insert name of Grantee) will ensure that its employees, contractors, and agents will coordinate with the campus Facilities Office with respect to other ongoing work on the campus and with respect to allowable work hours.

6. (Insert name of Grantee) shall bear all expenses to restore any element of the campus that they damage or destroy.

7. All construction areas are to be kept clean, safe, and orderly at all times.

Note: When form is completed by campus, send to Land Title at the Chancellor's Office for review and execution by University Counsel.
